Every possible sfiort is to be made to check desertion and absenoe without leave, and by lawful means to detect and apprehend deserters or absentees. Descriptions on Forms 8243 are to be distributed as may be directed by the Commander- in- Chief, but at home one copy is invariably to bo sent by the Captain to the Chief Constable of the Aeaerter's or absentee's usual place of residence, when it is known, and also to any other place or place* where he may be likely to have gone. 2. Ths procedure to be followed in respect of the arrest and inbsequent oLrwsal of deserters and absentees is governed by the provisions of Section 9 of the Act 10 and 11 Vict., cap. 62, and by Section 60 of the Naval Discipline Act. 3. Under the first of those Statutes, any person arrested on suspicion of being a deserter or absentee from His Majesty's Navy, shall be taken and oharged before a Magis- trate, and by him, either— ( a) Conveyed to prison pending enquiry of the Naval authorities as to nis identity and afterwards, • hould suoh identity be proved, handed ever to Naval oustody; cr- ib) Committed direct to Naval custody on board any one of His Majesty's ships. In either of the above cases, after the deserter or absentee has been delivered into Naval custody, he may be dealt with under the Naval Discipline Aot The amount of the reward should be determined by the attendant circumstances, and in considering these, the teal shown, and the trouble taken by the Constable or other person by whom the arrest of tb « deserter he- be » u effected, should b* duly weighed. The above Regulations for the payment ot rewards will not be held to apply in the case of a deserter voluntarily surrendering himself at any Police Station, or to any Con- stable, or other recognised authority, unless it can be clearly pbown that such deserter had been induced so to surrender himself by the vigilance and exertions of any such Constable or other person, but exceptional cases of this description are not to be dealt with without reference to the Admiralty at home or Commanders- in- Chief, or Officers in command of Stations abroad, so that a full enquiry < nto the circum- stances can be made if necessary. 2. In cases where persons have been more than two years in - tate of desertion, no reward is to paid without previous reference as above; it has been notified to the Constabulary generally that when deserters are apprehended in the United Kingdom after suoh a period of absence, they are not to be removeu from their places of confinement until the Admiralty have been communicated with. 4 It arrested on Naval Warrant, under Section 00 of the Naval Discipline Act, the deserter or absentee may be received direct into Naval oustody, and dealt with under the Naval Discipline Act, but no deserter or absentee who has not been arrested under suoh warrant shall be received from the Police or from any other person, unless such deserter or absentee has first been charged before a Magis- trate. 6. A deserter or absentee who voluntarily surrenders himself to Naval authority may be dealt with under the Naval Discipline Act, though no warrant for his arrest may have been isbued, and without charging him before a Magistrate. 8. Under the provisions of Section 10 of the Act 10 and 11 Vict., csp. 62, any person who voluntarily confesses to being a deserter, or an absentee without leave, from His Majesty's Navy, unless he surrenders himself into Naval oustody, may either— ( à) Be taken before a Magistrate, and by him delivered into Naval oustody ; or— ( á) Be arrested on a warrant under Section 60 of the Naval Discipline Act, and delivered direct into Naval oustody. In either case, however, the question whether he be or be aot a deserter or absentee, must be duly investigated by Kaval authority, and for that purpose he may be detained i01 a reasonable time, when, if his confession of desertion • r absence without leave shall be found not to be true, then ha cannot be punished at all under the Naval Discipline Ast, bat he may either— ( e) Be detained and reoeived in His Majesty'* Navy 1 ( d) If not received into His Majesty's Navy, and on oonviction of false confession of desertioD before two Justices of the- Peace, he may be adjudged to be punished, it in England, as a rogue and a vagabond, and if in Scotland, or Ireland by commitment to prison, there to be kept to hard labour for any time not exceeding three months. 1 Wben any deserter, or absentee without leave, whether delivered into Naval custody by order of a Magistrate, or tjy s warrant issued under Section of the Navel I/ iwy. A reward, not exceeding £ 3, may also be paid for the apprehension of any person who, without being guilty of desertion, in the opinion of the Captain of the ship to whioh he belongs, either gives reasonable ground for con- sidering that be intend* to desert, or commits any one of the following offences, the particulars of whioh are to stated in the notice to the Police 1— ( a) Breaks out of his ship. ( fc) When on service away from his ship, quits his place of duty and continues to be absent after the time at whioh he should have returned to the ship. ( e) tVhen his ship is under sailing orders, continues to be absent without leave, after the ship has sailed, provided that the fact of the ship being under sailing orders was generally known. A reward not exceeding £ 1 may be paid tor the appre- hension of any man who overstays hi* leave unless there Is reasonable ground for considering that the man intends to dosert, in which case £ 3 may be paid. In giving these rewards, tbe * ame considerations that govern the payment of rewards for tho apprehension of deserters are to be taken into account, both as to arrest and \ voluntary surrender. 4. No reward is to be paid ror tbe apprehension 01 any Cammisdoned, Warrant, or Subordinate Officer, without the sanotion of the Admiralty at home, or of the Commander- in Chief or Senior Officer present, abroad. 4. The Aocountant Offioerof the ship to whioh the deserter or absentee is brought is to pay to the Polioe, on Form S. 2fi, any reward which may be approved, and the statutary fee ol. 2s. to the Magistrate's Clerk when inourred. 6. With a view to simplifying the payment of suoh slaimr Magistrates and Governors of Gaols, when requested to sent! deserters or absentees baok to their ships, should be informed that it is desirable that the men should be sent in the custody ot the Constables who actually apprehended them. 6. The foregoing mode of payment does not apply tc deserters or absentees apprehended by the London Metropolitar Police. For these the following course is to be observed t— No payment is to be made by tho Accountant Officer In respect of tho expenses inourred by the Constable, or of any reward which may be due to him. The Constable will produce a form prepared for the pnrposo, and will hand it to the Accountant Officer of the 6hip, whe will, with the approval of the Captain, forthwith charge the deserter or absentee with the amount o( any reward, 3 due and note in tho space provided on tho lorm tho fact of the charge having been made. The form is then to be returned to the Constable. No reward under the authority given to the Captali by Article 807 is in any case to be paid for the apprehension of deserters or absentees within the precincts of a plnco when a Police Force is employed in any Naval establishment, bu; in order to encourage the local police at any such port or place to search for ond apprehend deserters or absentees the Commander- in- Chief or Senior Officer present, at hie discretion, and under such regulation* as he may from tims to time lay down, may approve a reward not exceeding £ 1 being paid for each deserter or absentee arrested by a Con- stable of the local Police within a reasonable period Ths reward paid is to be charged on the ship's ledger against thf wages of tho deserter or absentee. NOTE.— If any doubt exists as to tho address of any ship the Admiralty should be asked by teleirraoh for information. 808. For deserters or absentees escortcd by tho Police in Great Britain the only payment* wbicb may be ( auctioned in addition to the foregoing reward* are the ftatutary fees of 2s U ibe Magistrate's Clerk and 2s. 6cL to any medical prac- titioner* by whom the deeerter or absentee may have been examined] Payments are made by the Accountant Offioer of the ship. When any Naval authority has once been communicated with as to the disposal of a deserter or absentee, separate arrangement* should not be made with a second Naval authority without notifying tbe former of the step* that air bring taken.
