N OTICE.— For instructions as to the manner in which reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct PERSONS WANTED. John Robert McGregor, age twenty- six, height 5 ft. 3 in., groom and labourer, naiive of England, medium build, fair complexion and hair, blue eyes, soar on left forearm, left little finger broken ; generally dressed in light ooloured suit and cap. Bradey ( probvbly fictitious), age about thirty- three, height about 5ft. 9in., medium build, light- brown hair, slight fair moustache only; dressed in dark- tweed suit and black hard hat. Offender forged the name " R. Davis" to a cheque for £ 6 15s., drawn on the National Bank of New Zealand, Wellington, and uttered the same to Charles Arthur Harrison, hotelkeeper, indorsing it " J. Bradey." He is supposed to have gone to Leeston. CHRISTCHURCH.— 26th ultimo, on warrant for theft of £ 5 from Philip Munn, tobacconist, Colombo Street, J. Nicholson ( probably fictitious), age about twenty- five, height about 5ft. 6in., chemist's assistant, native of Vic- toria, slight build, pale sallow complexion, dark hair and eyes, prominent front teeth ( one of which is decayed) ; fond of drink; dressed in dark striped suit and black hard hat; has the appearance of a racecourse- guesser. CHRISTCHURCH.— 31st March, 1907, that he may be com- pelled to comply with an order of Court to pay 5s. a week for the maintenance of his son at Weraroa Training Farm, John J. He was committed from Invercargili, where his mother resides, on 15th October, 1906, for theft. Absconded from Burnham 8th ultimo. LINCOLN.— Anthony Reuben Anderson, age seven- teen, height 5 ft. 8 in., labourer, native of Australia, well buiit, fair fresh complexion, brown hair, blue eyes, full lips, smart appearance ; dressed in dark- striped brown- tweed coat, dark- tweed vest, and grey- tweed trousers. Clothing num- bered 145. His mother resides in Melbourne, and his sister at 6 Jones Street, Dunedin. ( See Police Gazette, 1910, page 280.) Absconded from Burnham 7th ultimo. LINCOLN. — William Duncan, alias Billy Eriwata, age nineteen, height 5 ft. 5 iu., labourer, native of New Zea- land ( aboriginal), good build, dark eyes, large mouth ; dressed in dark- tweed coat and vest and whipcord beaver trousers. ClotbiDg numbered 142. On 12th December, 1908, at Wel- lington, he was sentenced to two years for carnal knowledge and three months for breaking, entering, and theft. (" Times Law Reports," Vol. xxvii, page 541.) [ JUDICIAL COMMITTEE OP THE PRIVY COUNCIL ( LORD LORE- BURN, L. C., LORD HALDANE, LOBD MACNAGHTEN, LORD SHAW, LORD DE VILLIEBS, AND LORD ROBSON). — 13TH J. ULY, 1911.] THE ATTORNEY- GENERAL FOR THE DOMINION OF CANADA V. FEDOEENKO. Canada— Extradition Treaty with Russia— Arrest without Formal Requisition from Foreign State— Validity. Article VIII of the Extradition Treaty with Russia pro- vides that a requisition for extradition shall be made through the Diplomatic agents of the high contracting parties, and Article IX provides that, after the requisition, the authorities of the State applied to shall proceed to the arrest of the fugitive. Held, That there was no inconsistency between the pro- visions of the Canadian Extradition Act and the provisions of the Treaty with Russia, and that Article IX did not involve that there can be no arrest of a fugitive for the purpose of extradition until there has been a formal requi- sition under Article VIII. THIS was an appeal by special leave from a judgment of Mr. Justice Robson in the Court of King's Bench for Manitoba of the 17th December, 1910, by which it was decided that the respondent, who had been committed to prison as a fugitive criminal under a warrant of committal of Chief Justice Mathers with a view to his extradition to Russia, was entitled to be discharged from custody. Sir Robert Finlay, K. C., Mr. E. L. Newcombe, K. C. ( of the Canadian Bar), and Mr. Theobald Mathew appeared for the appellant. In the course of 1909 the Canadian Minister of Justice re- ceived a letter from the Russian Consul stating that the Russian Government had instructed him to have the requi- site measures taken for the arrest and extradition of two Russian subjects, one of whom was the respondent, who were said to be domiciled in Winnipeg. On the 26th Sep- tember, 1910, Chief Justice Mathers, of Manitoba, as a Judge under the Extradition Act, 1906, issued a warrant for the arrest of the respondent, who was thereupon brought before him. The proceedings were based upon an informa- tion sworn by a police officer at Winnipeg, the charge being one of murder alleged to have been committed in Russia in January, 1908. After hearing evidence the Chief Justice decided that the respondent should be surrendered under the Extradition Act, and issued a warrant of committal for the delivery of the respondent into the oustody of the keeper of the gaol at Winnipeg. In the course of the proceedings before the Chief Justice it was not proved that any requisition for the arrest of the respondent had been made in accordance with Article VIII of the Extradition Treaty with Russia. On the 20th Ootober Mr. Justice Robson, after hearing counsel for the respondent, ordered the issue of a writ of habeas corpus, and iu November a motion was made before the Judge for the discharge of the respondent. It was argued on his behalf that the absence of proof that a requi- sition for his extradition had been made under Articles VIII and IX of the Treaty invalidated the warrant of committal. Mr. Justice Robson agreed with that argument and ordered his discharge from custody, and he was accordingly released. Sir ROBEBT FINLAY, for the appellant, said that this was an appeal from an order releasing on habeas corpus a man who had been arrested in Canada on a charge of murder alleged to have been committed in Russia. He was a Russian subject, and he was arrested on proceedings under the Canadian statute. Mr. Justice Robson was of opinion that the Treaty had not been complied with, and on that ground he dis- charged the man. The point was one of very great general importance relating to the manner of carrying out extradi- tion in Canada. The warrant for the arrest of the man was issued by the Chief Justice under section 10 of the Extradi- tion Act of Canada, which was in the following terms :— " Whenever this Part applies, a Judge may issue his war rant for the apprehension of a fugitive on a foreign warrant of arrest, or an information or complaint laid before him, and on such evidence or after such proceedings as in his opinion would, subject to the provisions of this Part, justify the issue of his warrant if the crime of which the fugitive is accused, or of which he is alleged to have been convicted, had been committed in Canada. . . The Judge shall forthwith send a report of the fact of the issue of the warrant, together with certified copies of the evidence and foreign warrant, in- formation or complaint, to the Minister of Justioe." The ground on whioh the release was ordered was under seotion 3, which said,— " In the oase of any foreign State with which there is an extradition arrangement, this Part shall apply during the 462 N E W Z E A L A N D P O L I C E GAZETTE. [ OCT. 18 continuance of such arrangement; but no provision of this Part wbich is inconsistent with any of the terms of the arrangement shall have effect to contravene the arrange- ment; and this Part shall be so read and construed as to provide for the execution of the arrangement." Articles VIII and IX of the Extradition Treaty were as follows: — " Tbe requisition for extradition shall be made through the diplomatio agents of the high contracting parties respec- tively. The requisition for the extradition of an accused person must be accompanied by a warrant of arrest issued by the competent authority of the State requiring the extra- dition, and by such evidence as, according to the laws of the place where the accused is found, would justify his arrest if the crime had been committed there. ... If the re- quisition for extradition be in accordance with the foregoing stipulations, the competent authorities of the State applied to shall proceed to the arrest of the fugitive." In this oase, Sir ROBERT FINLAY contended, the accused was arrested without any requisition, and the law of Canada was advii- edly framed in that way for the reason that it wa9 found that if they waited for a requisition in the usual diplomatic way a criminal would escape, and it was neces- sary to provide for his being arrested at once, the requisition, however, being nece- sary before he was handed over to the authorities of the State which desired to deal with htm as a criminal. Mr. Justice Robson had said that the Act was inconsistent with the Treaty. It was impossible to read seotion 3 of the Act as in effect an enactment that in no case should Canada proceed to the arrest of foreigners in her jurisdiction until a requisition had been made. He sub- mitted that there was nothing whatever inconsistent with the right of Canada to arrest without requisition with a view to extradition. In Canada they found that unless they could take proceedings at once it was very little use, for, having regard to the extensive frontier, a man was very likely to disappear. Russia did not consider that the Treaty had been violated. The LORD CHANCELLOR, in delivering judgment, said: The only question in this appeal is whether the absence of a requisition by the Russian Government for extradition viti- ated the proceedings under which this accused was arrested and committed for surrender. Mr. Justice Robson held that these proceedings should be founded upon a certain pre- liminary requisition, and that therefore, as there was not such a prelim; nary, the accused should be discharged. His reason was that upon his construction of the Treaty with Russia this condition had to be complied with, and ihat in so far as tbe Canadian Extradition Act ( c. 155 of Revised Statutes, 1906) was inconsistent with that Treaty, the Treaty must prevail. Their Lordships are of opinion that what was done in the arrest and committal was in accordance with section 10 of the Extradition Act, and that there is no inconsistency between the Act and the Treaty. The Treaty provides by Article IX that after a requisition in due form the authori- ties of the State applied to shall proceed to the arrest of the fugitive. In that case the proceeding to arrest is obligatory. The article does not provide that there shall be no arrest till after a requisition. Their Lordships desire to say that nothing has come before this Board except this point of law. The other rights of the accused and of the State remain wholly unaffected. Their Lordships will humbly advise His Majesty that this appeal should be allowed, and that the order of Mr. Justice Robson, dated 17th December, 1910, should be discharged. WHEREAS by sections eighty- three and ninety- four of the Fisheries Act, 1908, it is enacted that the Governor may from time to time, by Order in Council gazetted, make regulations, to have force and effect throughout New Zealand or only in such waters or places as are specified in the regulations, for, amongst other things, the erection or construction in any river, stream, or waters in which salmon or trout exist, or have been liberated or may hereafter be liberated, of fish- ladders or other means of ingress and egress for fish, by persons constructing dams or weirs, so as to allow fish to pass and return at all times : And whereas it is desirable to make regulations for the purposes hereinbefore mentioned : Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the hereinbefore- recited power and authority, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation. REGULATION. 1. EVERY person who shall construct or who has con- structed a dam or weir in any river, stream, or waters in the Taranaki Acclimatization District in which salmon or trout exist, or have been liberated, or may hereafter be liberated, shall erect or construct proper fish- ladders or other means of ingress and egress for fish so as to allow fish to pass and return at all times. 2.
