NEW ZEALAND POLICE GAZETTE. PUBLISHED BY AUTHORITY. WELLINGTON, WEDNESDAY, AUGUST 30, 1911. XT OTICE.— For instructions as to the manner in which i-^ reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Offender forged a cheque for £ 15 8s. 6d., purporting to have been drawn by P. J. Williams, and uttered the forged document to Frede- rick Charles Henry Cotter, storekeeper, Te Wharau. WELLINGTON.— Inquiry is requested to ascertain the pre- sent whereabouts of William Coleman, alias Sutton, alias Walter McDonald, alias Baker, age thirty, height 5 ft. 8$ in., labourer, native of Australia, dark freckled complexion, black hair, brown eyes, short nose, clean- shaved ; dressed in dark suit and hard black hat. He was declared an habitual criminal, and subsequently re- leased upon probation from the Reformatory at New Ply- mouth ( see Police Gazette, 1910, page 359), but has recently failed to report himself to the Probation Officer. In June last he had a billiard- saloon at Patea, but was last heard of at Feilding. If located, an immediate communication re- garding his employment, conduct, & c., is to be sent to the Commissioner's Office, Wellington. ( 11/ 1486.) WELLINGTON.— 9tb instant, for failing to oomplv with the conditions of his release upon probation, Leslie Ryan, age twenty- three, height 5ft. 5in., labourer, native of Aus- tralia, fair complexion, light- brown curlv hair, blue eyes, large nose, clapped hands over heart and " Maud " on right forearm. On 1st ultimo offender was convicted for forgerv and uttering, and admitted to probation for three years, but he has failed to report himself to the Probation Officer. His arrest is de- ired. WELLINGTON. — 27th instant, for escaping from legal custody. Joseph John Pawelka, age twenty - three, height 5 ft. 10in., butcher, native of New Zealand, medium build, dark complexion, dark- brown hair, blue sunken eyes, medium nose, mou'b, and chin, thin features, very large scar near left shoulder- bl » de, senr on inside of left knee- cop. CHRISTOHURCH.— 22nd instant, on warrant for a breach of the Chattels Transfer Act, 1908, section 52, Carleton Arthur Currie, age thirty- four, height 5 ft. 6 in., engineer, native of England, medium build, fair complexion, very dark- brown hair, greyish- blue eyes, fair moustache only ; dressed in navy- blue suit and black- felc hat or cap. Offender being the grantor of an instrument by way of security authorized the sale without the consent of the grantee of certain articles of furniture comprised in or affected by such instrument, and thus attempted to defraud the grantee of the same. Offender, by falsely repre- senting that he was the authorized agent of Patrick Scul- lion, obtained from Albert lies, auctioneer, Manchester Street, a gentlemen's Gazelle Raleigh bicycle, No. 103150 ( not recovered), value £ 3, the property of Patrick Scullion. TEMUKA.— 23rd May last, on warrant of commitment to Timaru Police Gaol for forty- eight hours in default of pay- ing £ 2 10s. fine and costs for a oreach of the peace, James Liston, alias Barr, age about twenty- one, height 5 ft. 7 in., labourer, native of New Zealand, medium build, brown hair, clean- shaved; dressed in brown suit and cap. DIV. — ( LORD ALVER- STONE, C. J., GRANTHAM AND PICKFORD, JJ.)— 29TH MAY, 1911.] REX V. RICHARD JOHNSON. Criminal Law — Receiving Stolen Property — No Guilty Knowledge at Time of Receipt— Subsequent Knowleage. The appellant was charged with having on the 24th of April, 1911, reoeived a horse kuowing it to have been stolen. It appeared that at the time he received it he did not know that it bad been stolen, but that subse- quently, on being told the faot, he refused to give it up unless he was repaid the amount he had paid to the person from whom he got it. The appellant was convicted. Held, That the conviction must be quashed. THIS was an appeal against a conviction. Mr. Abinger appeared for the appellant; and Mr. S. Moses appeared for the Crown. The appellant was convicted at the Middlesex Sessions on the 6th of May last, of having rectived stolen property, and sentence on him was postponed until the hearing of this appeal. A report of the trial appeared in The Times of the 8th of May. MR. ABINGER said the appeal raised the question whether person who had received property innocently and after- wards retained it when he knew it to have been stolen oould be oonvioted of having received the property with knowledge that it was stolen. It was alleged at the trial that a man named Gough stole a pony on the 22nd of April, that he took it to the appellant on the 24th of April, and ofiered it for sale, auu that the appellant agreed to buy it for £ 8, and paid £ 1 on account. On the 1st of May Gough came to the appellant and asked to have the pony given back to him, as it was stolen property. The appellant said he would give back the pony if Gough would return him the £ 1 paid on account of its purchase, but Gough refused to hand baok the money and went away. Two days later the police oame and found the pony in the appellant's possession. Gough was acquitted. At the Sessions the jury were told that if the appellant had known that the pony was stolen either at the time when he received it or at any later period they would be justified in finding him guilty. The jury found the appellant guilty, intimating that although wnen he received the horse he did not know it was stolen, he retained it in his possession for three days after he knew it had been dishonestly come by. Mr. Abinger submitted that the direction to the jury was an entirely wr< ng view of the law, for to constitute the offence there must be guilty knowledge at the time the goods were received. He referred to Reg. v. Flowers ( 55 L. J., M. C., 179) and Reg. v. Glyde ( 37 L. J., M. C., 107). Reg. v. Riley ( 22 L. J., M. C., 48) was apparently against him, but that case was distinguishable. MR. MOSES, for the Crown, submitted that though there must be guilty knowledge at the time of receiving the receiving here was a continuing offence, or there was in effect a fresh r< chiving on the 1st of May, when the appel- lant first learnt the true position of affairs. He referred to Reg. v. Woodward ( 31 L. J., M. C., 91). MR. JUSTICE GRANTHAM said they felt the conviction could not be supported. When told that the pony had been stolen the appellant refused to part with it unless he was repaid the £ 1 he had given on account of its purchase. Perhaps in doing that he had not acted very honourably, but they need not consider that point to- day. It had been found that at the time he received the pony the appellant had no guilty knowledge; and, that being so, the offence charged was not made out and the conviction must therefore be quashed. In finding that the appellant did not know until the 1st of May that the pony had been stolen the Court below seemed to have taken a view that was very favourable to the appellant.
