NEW ZEALAND POLICE GAZETTE. PUBLISHED BY AUTHORITY. WELLINGTON, WEDNESDAY, JULY 26, 1911. NOTICE.— For instructions as to the manner in which reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. • AUCKLAND.— 13th instant, on warrant for failing to provide his wife, Jessie Bellshaw, Penrose, with adequate means of maintenance, William Charles Bellshaw, age twenty- eight, height 5 ft. 10 in., farmer, native of New Zealand, slim build, fair complexion, light- brown hair, grey eyes, long nose, small face, clean- shaved. Offender's photo- graph is filed in the Inspector's Office, Auckland. He is supposed to have gone to Patea. AUCKLAND.— 20th March last, on warrant of commit- ment to Mount Eden Prison for fourteen days for failing to comply with a maintenance order for tho support of his five children, Arthur Walter Lewis, age thirty- seven, height 5 ft. 6Jin., seaman, native of England, medium build, fresh complexion, dark- brown hair, brown eyes, name tattooed on left wrist. Arrears to 8th ultimo, £ 4 7s. 6d. AUCKLAND.— 12th ultimo, on warrant of commitment to Mount Eden Prison for seven days in default of paying £ 4 17s. fine and costs for cruelty to animals, Robert John Galbraith, age forty- five, height 5 ft. 8 in., labourer, native of Scotland, medium build, reddish complexion, fair hair, blue eyes, slovenly appearance. He is supposed to have gone to Matiere. AUCKLAND.— 12th ultimo, that he may be served with a summons for cruelty to a horse, Robert John Galbraith. age forty- five, height 5 ft. 8 in., labourer, native of Scotland, medium build, reddish complexion, fair hair, blue eyes : slovenly appearance. HUNTLY.— 17th ultimo, on warrant of commitment to Mount Eden Prison for one month in default of paying £ 2 10s. fine and costs for supplying liquor to a female Native, William Lynd, age between fifty and sixty, height 5 ft. 6 in. or 7 in., carpenter, native of New Zealand, strong build, dark- brown hair, full face; fond of drink; generally dressed in faded dark- brown suit and black hard hat. THAMES.— 8th ultimo, on warrant for failing to comply with the conditions of his release upon probation. John Albert Hill, age nineteen, height 5 ft. 6 in., jockey and labourer, native of Australia, fair complexion, light- brown hair, brown eyes, nose has been broken. GISBORNE.— 28th January last, on warrant of commit- ment to Mount Eden Prison for six months for failing to complv with a maintenance order for the support of his wife, Charles Single, age fifty, height 5 ft. 9fin., butcher and drover, native of New Zealand, fresh complexion, grey hair, brown eyes ; fond of drink ; dressed in grey- tweed suit. He was last heard of at Rotorua. ( See Police Gazette, 1908, page 303.) TAUMARUNUI.— 7th instant, that he may be served with summonses for sly- grog selling, Bertram Barry Farley, age twenty- three, height 5 ft. 11 in., labourer, native of Australia, medium build, fair complexion and hair, blue eyes, faint tattoo- mark on third left finger, scar over left eye ; generally dressed in grey suit, and cap or tweed hat. NEW PLYMOUTH.— 19th instant, on warrant for desert- ing the barque " Margit," Iven Holmberg, Harry Christensen, Oscar Fassum, Olaf Reiersen, and Willy Olsen. First: Age nineteen, height 5 ft. 7 in., seaman, native of Denmark, medium build, pale complexion, black hair, dark eyes, fat face, clean- shaved. Third: Age twenty, height 5 ft. 6 in., seaman, native of Norway, medium build, fresh complexion, brown hair, blue eyes, small brown moustache only. Fourth: Age twenty, height 5ft. 6 in., seaman, native of Norway, medium build, pale complexion, brown hair, blue eyes, small dark moustache only. Fifth: Age twenty, height 5 ft. 6 in., seaman, native of Norway. 342 N E W Z E A L A N D POLICE GAZETTE. i AUG. 16 NAPIER.— 28th ultimo, on warrant for obtaining credit by fraud, William Henry, alias The Cowboy, age twenty- seven, height 5 ft. 9 in., labourer, native of America, strong build, fair oomplexion, fair hair ( bald), clean- shaved, diamond- shaped tattoo- mark on one hand; dressed in dark- blue suit and green cap. Offender obtained goods valued at £ 4 7s. from Pierce James Cotter, draper, by fraudulently representing that he was going to obtain a loan of £ 80 from the Napier Building Society. HAWERA.— 19th ultimo, that he may be served with a notice of fine and costs (£ 3 15s.) for procuring liquor for a prohibited person, Harry Wolfe, alias Henry Kam- mody, alias Kammerley, age forty- four, height 5 ft. 8 in., labourer, native of Prussia, fresh complexion, brown hair, grey eyes, large pointed nose, greyish moustache, dent on Forehead ; fond of drink ; generally dressed in blue suit and black hard hat. ( See Police Gazette, 1898, page 176.) He is supposed to have gone to Banks Peninsula. HAWERA.— 29th May last, that he may be served with a summons for failing to provide his wife and children with adequate means of maintenance at Te Roti, John Currie McDonald, age forty- three, height 5 ft. lOJin., labourer and instructor in physical culture, native of New Zealand, strong build, fair complexion, brown hair, upper front teeth slightly decayed ; fond of drink. His photograph is filed in the Inspector's Office, Wanganui. He was last heard of at Wellington. LEVIN.— 7th instant, on warrant for forgery and utter- ing, Richard Evens, age about thirty- five, height between 5 ft. 9 in. and 8 ft., supposed labourer, supposed native of New Zealand, fairly strong build, ruddy complexion, clean- shaved, heavy- looking lower jaw ; dressed in dark or grey suit, black hard hat, and dark- grey overcoat. He forged a cheque for £ 11 on the Bank of New Zealand, Levin, and uttered it to Harold Cockrell, storekeeper, Otaki. It purported to have been drawn by " J. Pollock " in favour of " — Clark." Other charges are pending. Offender may be identical with Sydney Robert Leane, alias Hackett. ( See Police Gazette, 1908. page 397, and Photographs of Discharged Prisoners, 1908, page 2.) OTAKI.— About 15th December last, that he may be com- pelled to contribute towards the maintenance of his father, George Short, age thirty, height about 5 ft. 6 in., labourer, native of New Zealand, medium build, Jewish appearance, black hair ; fond of drink. Inquiry by Charles Short, Railway Department, Te Horo. MASTERTON.— 19th instant, on warrant for theft of a bicycle ( recovered), valued at £ 7, the property of Howard H. Reynolds. C. H. Capper ( probably fictitious), age about twenty- six, height about 5 ft. 9 in., fresh inclined to fair eomp'exion, fair hair, clean- shaved; spieler appearance; supposed fond of drink ; dressed in green suit and grey cap. He is supposed to have come to Wellington. CARTERTON.— 8th instant, on warrant for obtaining £ 10 from Ralph Edward Halford, hotelkeeper, by means of a valueless cheque, J. R. McDonald, age about twenty- eight, height 5 ft. 7 in. or 8in., dark- brown hair, hazel eyes, clean- shaved ; dressed in dark- blue suit and black hard hat. He is supposed to he identical with George William McDonald, alias Phil Brady, referred to in Police Ga- zette, 1911, page 127. PETONE.— 3rd instant, on warrant of commitment to Wellington Prison for one month in default of paying £ 5 18s. fine and costs for a breach of his prohibition order, Michael McAuliffe, alias Mickey the Goose, alias Fred Jones, age twenty- three, height 5 ft. 6 in., labourer, medium build, fresh complexion, brown hair, grey eyes', clean- shaved ; low appearance ; dressed in brown suit and hard bat. ( See Police Gazette, 1910, page 226.) He is sup- posed to have gone to Sydney. WELLINGTON.— 18th instant, that she may be compelled to contribute towards the maintenance of her two children inmates of the Wellington Receiving Home, Elizabeth Ellen Cutten Wilson, age forty- one, native of New Zea- land. No further description available. She was last beard of at Dannevirke in 1906, when she was supposed to have been living with Sydney Smith. Inquiry by the Education Department. WELLINGTON.— About 3rd instant, on warrant for theft of a caddie of Derby tobacoo ( recovered), valued at £ 5 15s., the property of W. and G. Turnbull and Co., Charles Searle. age about thirty- one, height 5 ft. 3 in. or 4 in., grocer and clerk, native of New Zealand, fresh complexion, sandy hair parted in centre, clean shaved, large mouth, stunted appearance, head and shoulders appear large in pro- portion to legs; well dressed; wears fawn- coloured rain- proof overcoat. He may endeavour to leave the Dominion via Bluff or Auckland. Other charges are pending. REEFTON.— 11th May last, on warrant of commitment to Hokitika Police Gaol for seven days in default of paying £ 1 3s. fine and costs for being found on licensed premises during prohibited hours, Peter McCormack. age about twenty- seven, height 6ft., miner, supposed native of New Zealand, strong build, dark complexion and hair, brown eyes, clean - shaved, stooping shoulders, slovenly gait; dressed in dark clothes and cap. GREYMOUTH.— 11th instant, on warrant for failing to provide for the adequate maintenance of his illegitimate child, Frederick Hawke, age twenty- five, height 5 ft. 9 in., boardinghouse- keeper, native of Tasmania, slight build, erect gait, brown hair, dark- blue eyes, clean- shaved, respect- able appearance ; generally dressed in dark- blue suit and soft green hat. He was last heard of at Otira. Complainant, Bertha Julia Beyer, Otira. ( See Police Gazette, 1910, page 516.) LYTTELTON. — 12th instant, on warrant for deserting the s. s. " Tongariro," John Houston, age twenty- one, height 5 ft. lljin., trimmer, native of England, fresh com- plexion, brown hair, blue eyes. CHRISTCHDRCH.— 27th May last, on warrant for theft of £ 2 from the Temperance and General Mutual Life Assurance Company, Henry George Purdue, age twenty - nine, height 5 ft. 10in., canvasser and labourer, native of New Zealand, slight build, dark hair, blue eyes, generally clean- shaved ; dressed in dark suit and black hard hat. Offender collected the money on behalf of the company, but failed to account for it. He is supposed to have gone to Melbourne. Other charges are pending. CHRISTCHURCH.— 6th ultimo, on warrant for failing to provide his wife, Elizabeth Jane Everitt, 162 Moorhouse Avenue, with adequate means of maintenance, Leonard Manton Everitt, age thirty- eight, height 5 ft. 11 in., hairdresser, native of Oamaru, New Zealand, slim build, fair complexion, very high forehoad, blue eyes, fair mous- tache only, portion of one little finger missing; generally dressed in dark- coloured striped suit, light- brown water- proof overcoat, and grey- felt hat. He was last heard of at Wellington, where he received correspondence at the General Post Office, but may have gone to Australia. ( See Police Gazette, 1911, page 335.) ANNAT.— Harold Jones, wanted on warrant for false pretences : It lias been ascertained by Constable Macgregor, Annat police, that offender's correct name is Harold Joines, and it is uncertain from which hand three of his fingers are missing. ASHBURTON.— 13th instant, on warrant for theft of £ 2 0s. 3d. from Peter Collins Temby, fishmonger, Charles Luxon, age twenty- seven, height 5 ft. 7 in., rouseabout, native of New Zealand, medium build, ruddy complexion, red hair, clean- shaved, stiff high shoulders, head inclined forward, Slightly bow- legged, insolent manner ; dressed in dark suit and cap. AUCKLAND.— About 4th March last, from a picture- shop, the property of CHARLES EDWIN MAJOR, land agent, Epsom, a pen- and- ink sketch intituled " The Lost Soul" ( Satan carrying a nude woman over a precipice), by G. F. Franklin Godfrey ; value, £ 15. Identifiable. EDEN TERRACE ( AUCKLAND).— About 16th instant, from a verandah at 33 Gladstone Street, the property of FREDE- RICK TOLHURST, a gentlemen's black- enamelled Noble motor- bicycle, No. 1000, registration number W1126, nickel- plated curved handles, gold- lined green- enamelled petrol- tank, rusty cranks, rubber- faced pedals; value, £ 25. ONEHUNGA.— About 11th May last, from the Hibernian Hotel, the property of HARRIETT DINGLE, a silver cream- jug, with shamrocks and butterfly engraved thereon; a silver teaspoon, with " H. D." on handle ; a silver table- spoon, with " H. D." on handle ; and a silver- plated butter- fork, with thistle- pattern handle: total value, £ 2 10s. Identifiable. ONOAONGA.— 21st May last, from a paddock at Wakarara, the property of WILLIAM SQUIRE, a black gelding, 14J hands high, well bred, slightly Roman nose, white streak around top of off hind hoof, small lump on off fore fetlock; value, £ 25. LYTTELTON.— Between 26th ultimo and 8th instant, from a cabin on the s. s. " Koonya," the property of ROBERT WILLIAM EDGEWORTH, engine- driver, a gentlemen's nickel open- face keyless watoh ; a heavy 9 ct. gold large and small oval- link- pattern chain ; and a gold- mounted green- stone pendant, with square and compass in centre: total value, £ 8 5s. Identifiable. CHRISTCHURCH.— 27th ultimo, from a right- of- way near the Hereford Hotel, the property of CHARLES W. DODD, 23 Cashel Street, a gentlemen's 22 in. frame Bell bicycle, No. 64509, steel rims, pedals, and mud- guards, Dunlop tires ; value, £ 12. Identifiable. CHRISTCHURCH.— 16th May last, from the premises of C. G. Wood, Tuam Street, the property of W. W. PRICE, plumber, Avonside, a gentlemen's Beeston- Humber bicycle, No. 4293, black grips, steel rims and pedals ; vaiue, £ 5. Identifiable. CHRISTCHURCH.— 25th May last, from Armagh Street, the property of F. E. ORMANDY, painter, Richmond, a gentle- men's B. S. A. bicyole, No. 437 or 1679, top and bottom bars slightly bent, steel rims, pedals, and mud guards, one cap missing from pedals ; value, £ 10 10s. Identifiable. ANNAT. — FRANCIS WATSON'S bicycle stolen : Frank Petersen, alias Parker, & c., was charged with the offence by Acting- Detectives Snow and Osborn, Christchurch police, but the information was subsequently withdrawn. The bicycle has not been recovered. ( See Police Gazette, 1911, page 304, and " Apprehensions, & c.," this issue of Gazette.) DUNEDIN.— 12th instant, the house of HENRY ALEX- ANDER, 24 Moreau Street, St. Kilda, was broken into, and the following articles stolen therefrom : A gold wedding- ring, with " R. A." stamped on inside ; a ladies' amethyst- set gold ring, with " R. A." on either side of gem ; a ladies' gold buckle- pattern keeper- ring ; a gold- mounted anchor- shaped greenstone brooch ; and a greenstone brooch, with fern- leaf and " N. Z." in gold on centre: total value, £ 6 10s. Identi- fiable. PROPERTY RECOVERED. AUCKLAND. — RICHARDSON ATKINSON ABBOTT'S property has been recovered : not stolen. ( See Police Gazette, 1911, page 323.) MARTON. — FRANK HALIGAN'S bicycle has been re- covered : not stolen. ( See Police Gazette, 1911, page 243.) PALMERSTON NORTH. — THOMAS HASTINGS'S bicycle has been recovered, and Arthur Douglas Oldham charged with the offence by District Constable E. G. Walker, Mohaka police. ( See Police Gazette, 1911, page 275.) GREYMOUTH. — J. TRUSCOTT" S bicycle has been re- covered : not stolen. ( See Police Gazette, 1911, page 275.) INVERCARGILL.— MICHAEL HUGHES'S bicycle has been recovered, and James William Bunyan, alias Thomas Bun- yan, alias Scotty Bunyan, alias McKenzie charged with the offence by Detective Hunt, Dunedin police. ( See Police Gazette, 1911, page 335.) ABSCONDING FROM INDUSTRIAL SCHOOL. KIMBOLTON. — Frederick Ralph Littler, age seven- teen, height 5 ft. 7 in. or 8 in., labourer, native of New Zea- land, medium build, fair hair, large eyes, round face, teeth oramped in front. He was licensed out to Mr. John Waugh, farmer, Kimbolton, from the Weraroa Training Farm, and absconded during the night of 18th instant. MISSING. J., PICKFORD AND LUSH, JJ.)— 8TH MAY, 1911.] REX V. ROBERT HICKEY. Criminal Law— Evidence— Statement incriminating Appel- lant made by Fellow- prisoner. Conviotion of the appellant quashed where substantially the whole of the evidence against bim was a statement by the police that a fellow- prisoner on his arrest made a statement incriminating the appellant, and where the appellant denied the truth of such statement and that he was present at the time it was made. THIS was an appeal against conviction. Mr. T. C. Gibbons appeared for the appellant, and Mr. A. J. Lawrie appeared for the Crown. The appellant was convicted at Liverpool City Sessions with other prisoners on a charge of receiving, and was sen- tenced to eighteen months' hard labour. Substantially the whole of the evidence against the appellant was a statement by the police that one of the other prisoners on his arrest made a statement incriminating the appellant. The appel- lant denied that he was present at the time the other prisoner made the statement, and he did not admit its truth. The Recorder nevertheless admitted the statement and did not point out to the jury that it was no evidence against the appellant. MR. JUSTICE PICKFORD said that on the authority of Rex v. Norton ( 26 The Times L. R., 550) it was clear that the evi- dence was not properly admissible and the conviction could not be supported. It must therefore be quashed.
