WELLINGTON, WEDNESDAY, MAY 3, 1911. \ OTICE.— For instructions as to the manner in which reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." He is well known at Tauranga and Waihi, and haa a sister, Mrs. Hocking, residing in Alma Street, Chrir- tchurch. PERSONS WANTED. AUCKLAND. — 21st February last, on warrant of com- mitment to Palmerston North Prison for fourteen days in default of paying £ 4 8<. arrears due up to the 21* t Novem- ber last for the maintenance of his brother in St. Marj's Industrial School, Thomas Connolly, age nineteen, height 5 ft. 6 in., flax- mill hand, slim build, fair complexion and hair, thin features ; boyish appearance; neat and tidy in his appearance; smokes cigaret es, and fond of company. ONEHUNGA.— lGth January last, on warrant for failing to provide his wife, Marion Elizabeth Rvnn, with adequate means of support, Michael Robert Ryan, age sixtv, height about G ft., labourer, native of Ireland, medium build, reddish- col jured hair and moustache ( turning g> ey), bald on top of head, long thin nose; generally wears dark sac suit and soft- ftlt hat. He was working for W. Smith, contractor, Ohakune, and was seen in Napier about the 1st ultimo. PAEROA.— 19th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegitimate child, Joseph Hanna, age twenty three, height 5 ft. 7in., labourer, florid complexion, black hair, heavy dark eyebrows, I clean- shaved, full red lips, speaks with a North of Ireland ac- cent. He has been two years in New Zealand, and was re- cently employed in the Crown Battery Mine, Karangahake. Complainant, Alice Meagher. AUCKLAND.— 24th ultimo, that he may be served with a summons for the maintenance of his child, an inmate of St. Mary's Indus'rial School, Thomas Taylor, age twenty- eight, height 5ft. 6in., labourer and cab driver, native of New South Wales, thin build, pale complexion, brown hair, grey eyes, left arm has been broken in three places. He is supposed to have gone to Sydney. NEWTON.— 20th ultimo, on warrant for forging the name of his son, A. E. Thomas, to a cheque for £ 98, and uttering the same to the National Bank of New Zealand, Newton, WANGANUI.— John Ford, wanted on warrant for theft of £ 13 12s. 2d., the money of J. A. Bowers: It has been ascertained that offender's correct name is Cuthbert Younghusband. He is a son of Mr. Younghusband, tea- merchant, Auckland, and some two years ago travelled through New Zealand with one of the Williamson Com- panies. ( See Police Gazette, 1911, page 164.) MASTEKTON.— 6th ultimo, on warrant for false pretences on Harry Read, hairdresser, William Hodson, alias Henderson, age about twenty- seven, height 5 ft. 7 in., labourer and auctioneer, medium build, darn hair, clean- shaved, fresh complexion, gocd address, has the appearance of a labourer; dressed in dark coat and vest, light- coloured trousers. Offender gave complainant a valueless cheque on tbe Bank of New Zealand, Wanganui, for £ 3, in payment for goods, and received a balance of £ 2 17s. The blank cheque was obtained from Godfrey Thomas, Secretary to the Wairarana Sawmillers' Association, who knew Hodson as an auctioneer for McFarlane, in Christchurch, some years ago, 202 N E W Z E A L A N D P O L I C E GAZETTE. [" APRIL 26 WELLINGTON.— 18th ultimo, on warrant for breaking into the dwelling of Ernest Alfred Anderson, photographer, and stealing therefrom a ladies' 18 ct. gold hunting- watch, key- winder, No. 73730, Australian coat of arms on front case, " The Australian, Registered," on dial, inscription on inside back case, " To Elsa, from Uncle Ernest, 22/ 3/ 11," value £ 10; two plain gold band rings, value £ 2; and £ 7 4s. 2d. in money : total value, £ 19 4s. 2d. Watch only identifiable, Joseph Thomas Christie, age seventeen, height 5 ft. 7 in., industrial- school ooy, na'ive of New Zea land, stout build, blue eyes, black hair, full round faoe, prominent eyebrows and ears, scar on back of left ear; dressed in dark- tweed suit and cap. He escaped from custody near Woodlands Railway- station on the 11th ultimo, when being escorted to Invercargill for five years' reformative treatment. His finger- prints were found on the windows of complainant's dwelling, and a warrant issued for his arrest. None of the property has been recovered. ( See Police Ga- zette, 1911, page 174.) WELLINGTON.— 24th ultimo, on warrant for deserting from the s. s. " Ruapehu " Andrew Moar, John Hunter Riddell, and William Thomas Jones. First: Age thirty, height 5 ft. 9f in., A. B., native of the Shetland Islands, medium build, ruddy complexion, fair hair, grey eyes. Second: Age twenty- eight, height 5 ft. 10 in., b atswain's mate, native of Australia, medium build, fair complexion, brown hair, hazel eyes, clasped hands, heart, and crown on right arm ; adtiic ed to drink. Third : Age forty- two, height 5 ft. 6$ in., ship's carpenter, native of Wales, medium build, dark complexion, dark- brown hair, blue ey< s, Britannia, shield, and ship on left arm, star on back of left hand, shield, anchor, " W. T. J.," emblem, and crossed flags on right arm, bracelet on right wrist. MOUNT COOK ( WELLINGTON).— 23rd ultimo, on warrant for sly- grog Felling, Fanny Prior, alias McLeod, age forty- five, height 5 ft. 5 in., restaurant- keeper, native of England, stout build, red flushed complexion, brown hair turning grey; sometimes wears glasses; dressed in dark- grey skirt, dark jacket, and fawn mackintosh, black hat with blue veil; addicted to drink. SEDDONVILLE.— 15th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegiti- mate child, Robert Chadwick, age twenty- seven, height 5 ft. 4 in., miner, native of England, medium build, dark hair and complexion, clean- shaved, blue eyes, wears black sac suit; may be employed at some of the mines in the Auckland or Thames district. GREYMOUTH.— Between 20th and 22nd March last, on war- rant for false pretences on Robb and Hempseed, drapers, Charles Smith, alias Hayes, age twenty- five, height about 5 ft. 9 in., labourer, native of England, medium build, dark complexion, black hair, clean- shaved except small black moustache, mark of o d scar on right side of neck ; dressed in dark suit and cap. Offender was employed by Mr. Manderson, dairy- farmer, and obtained goods, value £ 2, from complainants by falsely representing that he had been authorized by Mr. Manderson to obtain the goods on credit. GREYMOUTH. — 19th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegiti- mate child, John Forrest ( known as Nibbie Forrest), age twenty- four, height 5 ft.. 8 in. or 9 in., coal- miner, native of Brunnerton, medium build, dark complexion, black curly hair, dark brown eyes, very long Roman nose, false teeth in upper jaw, top of left forefinger missing; usually wears a blue- serge sac suit, white soft shirt ( no collar), wears a silk handkerchief round his neck. He left Greymouth on the 6th Maroh last, overland for Christchurch. His father resides at Kaitangata. Complainant, Eileen Taylor. CHRISTCHURCH.— 18th ultimo, on warrant for obtaining £ 20 from Walter Henry Overton, licensee, A1 hotel, by means of a valueless draft drawn on Easson and Co., Wel- lington, — O'Brien, age about forty- five, height about 5 ft. 7 in., supposed traveller, fresh complexion, clean- shaved, rather stout built, neck turned to right as if deformed ; dressed in light suit, white vest, and hard black hat; wears greenstone pendant on watch- chain ; good appearance. CHRISTCHURCH.— 18th ultimo, on warrant for disobey- ing an order of Court to pay 7s. 6d. a week towards the support of his child, John Wark, age twenty- five, height 5 ft. 8Jin., brickmaker, native of New Zealand, dark com- plexion, black hair, grey eyes, clean- shaved, anchor tattooed on right arm, anchor and four blue dots on left arm. ( See Police Gazette, 1909, page 342.) On the 18th ultimo he was in arrears £ 3 15s. LYTTELTON. — 20th ultimo, on warrant for deserting from the s. s. " Ruapehu," Alfred Walter Webber, age twenty, height 5 ft. 6J in., ssaman, native of England, fair hair, blue eyes, fresh complexion. A reward of £ 2 will te paid for his apprehension. KAIAPOI.— 23rd January last, on warrant of commit- ment to Lyttelton Prison for seven days in default of paying £ 2 13s. fine and costs for a breach of the Fisheries Act, Thomas Weston, age about thirty- six, height 5ft. 7 in. or 8 in., labourer, native of New Zealand, slight build, thin features, fresh complexion, brown hair; generally wears an old blue suit and black slouoh hat; dirty appearance; and addicted to drink. He follows up grass- seeding and whitebait- fishing. TIMARU.— 22nd February last, on warrant for arson, Charles Thomas, age about forty, height 5 ft. 9 in., showman, native of New Zealand, medium build, dark hair, clean- shaved, large round rough- looking face ; dirty appear- ance ; a showman and ventriloquist. He travels round the country with a horse and trap, giving lectures and exhibiting lantern views. He goes under the name of Professor Thomas. He is charged with setting fir>- to three wheat- stacks, value £ 70, the property of William Beer, farmer. TIMARU.— William Wentworth Ellis, alias Went- worth, wanted on warrant for default of maintenance ; It has been ascertained by Constable W. K. Hay ward, Timaru police, that offender . was working at the North British Freezing- works, Spit, Napier, shortly before Christ- mas last, and may be going under an assumed name. ( See Police Gazette, 1911, page 174 ) OAMARU.— 6th ultimo, on warrant for failing to provide for the maintenance of his illegitimate child, Edward Rutherford, age forty- four, height 5 ft. 8 in. or 9 in., barman and billiard- marker, native of Australia, me. iium build, fair complexion, brown hair, brown moustache ( waxed at the ends), blue eyes, high forehead, walks as if he had corns, stooped shoulders; dressed in blue suit aud hard black- felt hat, keeps his hat down over eyes when speaking. Supposed to have gone to Sydney, where iiis parents are well known, and are said to have kept an hotel there. Complainant, Nellie Wharton. DUNEDIN.— 20th ultimo, on warrant for failing to pro- vide for the future maintenance of his unborn illegitimate child, Walter Ward, age twenty- one, height 5 ft. 9 in. or 10 in., butcher, native of New Zealand, slight build, light- brown hair, blue eyes, clean- shaved, two front teeth missing from front upper jaw, may now have false teeth ; dresses we 1, generally in brown suit and a light- coloured overcoat. He was recently employed at the Belfast Freezing- works. His parents reside at Green Island. Complainant, Margaret Watson, Caversham. SOUTH DUNEDIN.— 16th March ast, for false pretences on Thomas Beattie Mason, outfitter, Man ( name unknown), age a> iout eighteen, height about 5 ft 6 in. or 7 in., apparently a labourer, native of New Zealand, stout build, full face, sallow complexion, dark hair, youthful appearance ; dressed in darkish grey check coat, vest, and pants ( the latter being darker than the coat and vest), dark tweed cap, collar and tie. Offender falsely represented that Mrs. Fitzpatrick, sen., of Macandrew Road, had sent him to get two suits on approval. He tried two suits on and took them away. The suits are described as one being a very dark grey ( almost black) tweed suit, size 4, with an undergrain of blue running through it, a sac coat with vent at back, " Standard Brand " on tab of collar, high- cut plain vest; value, £ 2 2s. 6d. The other is a dark- green- and- brown- striped tweed suit, size 4, plain sac coat, " Standard Brand " on tab, plain high- cut vest; value, £ 2 7s. 6d. Identifiable. No warrant. RIVERTON.— 18th ultimo, on warrant for breaking and entering tlie dwelling of Edmund Howell, and stealing therefrom £ 2 4s., John Taupoki, alias John Walker, age twenty, height 5 ft. 8 in., labourer, native of New Zealand, half- caste Maori, copper complexion, black hair, brown eyes, medium build, very long hair in front, prominent scars on neck ; dres ed in dark suit, tan boots, and black 203 N E W Z E A L A N D POLICE GAZETTE. [" APRIL 26 hard hat. He travelled with Bains's Wrestling Side- show last New Year, and also performed at Invercareill. ( See Police Gazette, 1910, page 490.) He was found in the house, hut escaped from complainant. INVERCARGILL.— 20 h ultimo, on warrant for failing to provide for the maintenance of his illegitimate child, Robert Arthur, age twenty- five, height 5 ft. 6in., carpenter, native of New Zealand, medium build, dark hair, sallow com- plexion, clean- shaved, blue eyes, burn- scar on left side of forehead ; generally wears dark suit and cap. Complainant, Ivy Mary Sharp. The above warrant is issued in lieu of the one appearing in Police Gazette, 1910, page 500, now can- celled. APPREHENSIONS, PERSONS FOUND, ETC. AUCKLAND.-- Nicholas Charles Edwards, default of fine, has paid the amount due to Detective Quartermain, Auckland police. ( See Police Gazette, 1911, page 173.) AUCKLAND.— Frederick Johnston, alias Shiels, theft, has been arrested by Detective Scott, on information sup- plied by Detectives McMahon and Quariermain. ( See Police Gazette, 1911, page 173.) IONEHUNGA.— Man ( name unknown) wanted on warrant for theft of a bicycle, the property of Arthur Taylor, is identical with John Henry Heath, who has been sen- tenced to two years' reformative treatment for this and other offences. Bicycle recovered bv Acting- Detective J. Powell, Auckland police. ( See Police Gazette, 1911, page 163.) HELENSVILLE.— Samuel Johnston, default of fine and costs: Warrant executed by Constable R. Boag, Maungatu- roto police, and amount paid. ( See Police Gazette, 1910, page 314.) RAWENE.— Albert Hewlett, default of maintenance, has been arrested by Constable Devereaux, Auckland police. ( See Police Gazette, 1911, page 119.) TE AWAMUTU.— Thomas Higginson Bond, wanted as witness: Warrant cancelled. ( See Police Gazette, 1911, page 65.) NAPIER.— Hugh Patience, wife- desertion, has been arrested by Sergeant Black and Constable Potter, Danne virke police, and remanded. ( See Police Gazette, 1911, page 147.) WAVERLEY.— Ernest Simmonds, default of fine and cos's, has been arrested by Constable A. Leckie, Auckland police, on information supplied by Constable O'Brien, Waver- ley police, and amount paid. LEVIN.— Reginald Reidy, absconding from industrial school, has been arrested by Constable Annison, Obakune police, on a charge of theft at Tangawai, where he was going under the name of Willie Peters. INVERCARGILL.— Robert Arthur, failing to provide for the future maintenance of his unburn illegitimate child : Warrant cancelled, and a fresh one issued for failing to provide for his illegitimate child. Silvia, deserter from H. M. " Chal- lenger," has been arrested at Sydney. ( See Police Gazette, 1910,. page 509.) PROPERTY STOLEN. AUCKLAND.— 23rd ultimo, the shop- window of FRITZ LARSEN, lapidary, was broken, and about one hundred greenstone ear drop pendants stolen therefrom. They were unmounted, with a large hole in small end, some of them are identifiable by small grooves in them ; value, about £ 80. TE AROHA.— 24th ultimo, from the dwelling of ALFRED WIGG, a small plush box, containing two gold neck- chains, value £ 1 10s.; a gold pendant, value £ 2 10s.; a bracelet, value 15s. ; and 7s. 6d. in silver. TAIHAPE.— 23rd ultimo, from the dwelling of the Rev. HAROLD PEAT, a ladies' open- faced gold watch, engraved back, " G. Wickitt," scratched on case, value £ 4 ; a Kaiapoi rug, fawn- colour, deep check on one side, light check on the other, value £ 2 ; three striped tennis- shirts, value 15s. ; a Gladstone bag, nearly new, lined with striped cloth, value £ 1 10s.; a silver- mounted ladies' hair- brush, with bead of a woman engraved on back, value £ 1 10s. ; a Bengal razor with white handle, extra hollow- ground, " T. P. M." scratched on handle, value 12s. 6d.; and a razor, maker Thomas Turner and Co., Oneore brand, value 10s. Identifiable. FEILDING.— 17th ultimo, from the office of the York Coffee Palace, the property of MARY SH1RWELL, pro- prietor, a black tin cash box, containing about £ 23 in notes, gold, and silver; two ladies' gold rings, one set with an emerald, the other set with a large opal ( small diamonds round it), value £ 7 each ; a promissory note drawn by Wil- liam Danvers for £ 14, payable to Mrs. Sherwell; a cneque for 19s. 6d., drawn by John Graham on Bank of New South Wales, Feilding. SHANNON.— 4th March last, from the whare of HENRY MARSHALL, labourer, a fancy all- wool vest, black, with a very small white spot, two pockets on each side, edged with black braid, watch- pocket slightly frayed, the pockets are woven with the vest; value, £ 2. Identifiable. Suspicion at- tached to Claude Radford, age about twenty- seven, height about 5ft. 7 in., farm labourer, stout square build, fair com- plexion, knock- kneed, square face, fair crispy hair ; has the appearance of a pugilist. He occupied the same whare as complainant, and wanted to purchase the vest, but was re- fused. On the above date he left Shaunon, supposed for Wanganui. [" APRIL 26 WELLINGTON.— JAMES GRANT McRAE'S medals stolen : Suspicion stiongly attached to William Robert Officer, who accompanied the complainant to the steamer at Lyttejton, and left him there. Description : Age about twenty- eight, height 5ft. Gin. or 7 in., sailor and labourer, suppose. i native of Auckland, slight build, fair hair, fair moustache ( curled at ends Kaiser fashion) ; dressed in khaki- coloured suit and returned- trooper's hat; usually has bicycle- clips on trcusers. He was a member of one of the South African contingents, and is fond of displaying his medals He was last heard of harvesting in the Rakaia district. ( Sea Police Gazette, 1911, page 89.) PICTON. — 17th ultimo, from the passage of Oxley's Hotel, the property of EDWARD GIBBS, Levin and Co., a heavy double- breasted green- tweed overcoat, " Union Cloth- ing Company, Manners Street, Wellington," on tab; value, £ 3. Identifiable. CHRISTCHORCH.— 15th ultimo, from the D. I. C. lavatory, the property of LADY CLIFFORD, Fendalton, a ladies' 18ct. gold ' half- hunting watch, Nos. 30231 and 41493, " Gunderson " on dial, a crest consisting of a dragon over a crown and " Semper Paratus" on outside of back case, watch enclosed in a leather wristlet; value, £ 30. Identifi- able. ASHBURTON.— JOHN TEMPLETON OLSEN'S dwelling broken into. The following articles were also stolen: A man's pink Zephyr shirt, 15^ in. collar, with white neck- band ; a navy- hlue silk tie, with white stripes across it; a linen handkerchief. " Jack Olsen " in corner ; a black silk kerchief; and a brown- leather pocket- book. The offender will probably be wearing some of the clothing. On the 21st ultimo Constable O'Grady found on the Ashburton River bank, a dark green tweed suit, with blue- green stripe every 2 in., coat has slit at back, " Standard " on tab, about size 4; a white- cotton shirt, with " Strange and Coy." on collar, a name which has been put on collar with marking- ink is partly torn out; a white- cotton tie, with black stripes; three white handerchiefs. one a ladies' with black deep border, another had " W. Hay " on corner ; also a towel and some receipts which had been stolen from Olsen's. ( See Police Gazette, 1911, page 193.) WAIMATE.— Between 6th February last and 9th ultimo, from a whare, the property of STEWART THOMSON, labourer, a silver open- faced English lever watch, No. 12906402, small dent in back case; a silver curb chain ( pattern No. 15 in illustrations): value, £ 8. Identi- fiable. DUNEDIN. — 28th March last, from the yard of the Waterloo Hotel, the property of ALBERT JOHN GLEN, a gentlemen's black- enamelled bicycle, No. 330501, turned- down handle- birs, " Radium " trade mark on front stem, back- pedalling brake, Phenomenon acetylene- gas lamp attached, " A. C." over " B." underneath the saddle; value, £ 5. Identifiable. SOUTH DUNEDIN.— 28th March last, from Oxford Street, the property of PHCENIX CHEYNE, St. Kilda, a gentle- men's Beeston - Humber bicycle, upturned handles, seat raised 5 in., leather toe- clips, lamp- bracket low on forks, Edie hub, steel mud- guards, right hand grip worn white; value, £ 7. Identifiable. PROPERTY RECOVERED. ROTORUA.— CHARLES BROOM HALL'S bicycle has been traced by Constables Neil and Giles, Rotorua police, to the possession of Charles Lynds, who has been fined for the offence. Some parts only of the bicycle recovered. ( See Police Gazette, 1910, page 516.) Criminal Law — Practice — Statements by Police Officer after Conviction of Prisoner. Where, after a prisoner has been convicted, a police officer makes a statement to the Judge as to the prisoner's antecedents, and the prisoner does not chal- lenge the accuraoy of that statement, the Judge is entitled to take it into consideration on the question of sentence, notwithstanding that some parts of the statement may be hearsay. If, however, the prisoner challenges any part of the statement, the Judge should then inquire into it and if he thinks it of sufficient importance that it ought to be proved by legal evidence he can, if necessary, adjourn the case for such proof to be forthcoming ; or, instead of doing this, he can disregard the disputed part of the state- ment altogether. THIS was an application for leave to appeal against a sentence of three years' penal servitude for false pretences. Mr. ROOME appeared for the applicant. The LORD CHIEF JUSTICE, after stating that the Court saw no ground for giving leave to appeal, said that Mr. Roome had acked him to express an opinion as to the practice of police officers, after a prisoner was convioted, making a statement to the Judge as to the prisoner's anteci d- ei. ts, ttiis practice being, it was said, objectionable on the ground that much of what was stated was mere hearsay, As this matter had bt en under consideration both by the Home Office and by the Judges he would take the opportunity of saying that for many years it had been the practice, after the conviction of a prisoner, for tome lesponsible officer of police to give the Judge all tbe information that had been obtained regarding the prisoner, and to a certain extent legal proof of all such statements could not usually be obtained without great expense. On some circuits, particularly the Northern Circuit, that practice had long been well known andxacted on ; on other circuits ihe practice wa9 not so well known. In consequence of that he ( the Lord Chief Justice) gave instructions some time ago that on all circuits, so far as possible, there should be given to the Judge accurate information as to the con- dition and antecedents of the prisoner— although legal proof as to the whole of the information might not be available at tbe moment. So well known had the practice become that the following words were inserted in subsection 5 of section 10 of the Prevention of Crime Act, 1908 : " Without prejudice to any right of the accused to tender evidence as to his character and repute, evidence of character and repute may, if the Court thinks fit, be admitted as evid- ence on the question whether the accused is or is not lead- ing persistently a dishonest or criminal life." That provision was inserted in order to attract to the procedure under that Act the practice to which he had referred. Occasionally, no doubt, police constables might have said more tban they ought, but there was not the slightest evid- ence of that having occurred in the case now before them. When a statement was made as to a prisoner, and the latter did not admit its truth, he could at once inform the Court of that fact; and this observation was especially appli- cable when the prisoner was represented by oounsel. If a prisoner challenged a statement of fact and said that it was untrue, it was then the duty of the Judge to inquire inio it, and if he thought the matter of sufficient importance that it ought to be proved by legal evidence, he could, if necessary, adjourn the case for that purpose; or the Judge oould adopt the course which was frequently adopted — and rightly adopted— of disregarding the disputed point altogether. Where, however, the prisoner did not challenge the statement made by the police officer the Judge could properly consider it. The application now before them would be refused.
