NOTICE.— For instructions as to the manner in which — reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders de'scribed in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Foi'ce in charge of out- stations will forward them direct PERSONS WANTED. — - MM AUCKLAND.— 31st January last, on warrant for obscene language, James Pelly, age forty- nine, height 5 ft. 7£ in., seaman, native of New Zealand, medium build, fresh com- plexion, red hair, light- hazel eyes, flat broken nose. He has been frequently convicted. ( See Police Gazette, 1910, page 504.) AUCKLAND.— 31st October last, on warrant of commit- ment to Mount Eden Prison for seven days in default of paying £ 2 10s. fine and costs for a breach of his prohibi- tion order, Thomas Gavin, age fifty- one, height 5 ft. 5Jin., sailor, native of England, medium build, dark hair and oomrlexion, blue eyes, star tattooed on back of right hand, flower- pot on right forearm, profusely tattooed on body and legs. KARANGAHAKE.— 8th ultimo, on warrant of commit- ment to Auckland Prison for two months in default of paying £ 53 18s. fine and costs for keeping liquor for sale in a no- license district, Robert Harrison, age tbirty- eight, height 5 ft. 8 in., miner and labourer, native of England, medium build, slightly bow- legged, pale complexion, light- brown hair, blue eyes, clein- shaved, prominent nose; usually dresses well in dark- tweed suit and black hard bat; ex- pectorates almost constantly. If located, information to be forwarded to the Inspector's Office, Thames, that a notice of fine may be served before execution of the warrant of commitment. NAPIER.— let instant, that summonses may be served on him for breaches of his prohibition order, Albert Austin, ago thirty- five, height about 5 ft. 8Jin., tailor, dark com- plexion and hair, dark moustache and eyes, medium build; dressed in dark clothes ; respectable appearance. He is sup- posed to be making towards Wellington. FOXTON.— 30th November last, on warrant for perjury, Pingi Tahu ( known as Brownie), age twenty- six, height 5 ft. 7Jin., labourer, a Maori, medium aotive build, copper complexion, clean- shaved, black curly hair, speaks English well; usually wears a dark suit and black cap. WANGANUI — 22nd ultimo, on warrant of commitment to Palmerston North Prison for thirty days in default of paying £ 7 2s. 6d. arrears due up to the 8th ultimo for the mainten- ance of his illegitimate child, Archibald Dick, age twenty- four, height 5ft. 4 in. or 5 in., stableman, native of New Zealand, medium build, fresh complexion, olean- shaved, long narrow face, low forehead, large blue eyes, dark auburn hair, bow- legged; dressed in blue suit and bard black hat. He was ordered to pay 7s. Od. a week towards the support of his child, of which Ada Ivy Elizabeth Smith is the mother, but has failed to do so. 108 NEW ZEALAND POLICE GAZETTE. . [ FeB. 2' 2 WELLINGTON.— 4th or 5th ultimo, on warrant for theft of 25 yd. tweed, value £ 6 2s. 6d., the property of Francis Kitto, tailor, David Irwin, age forty, height 5 ft. 7 in., labourer and seaman, native of Ireland, fair hair, blue eyes, broad nose, usuallv clean- shaved except medium fair mous- taohe, dragon, two roses, & c., tattooed on right arm. ( See Police Gazette, 1904, page 182, 190G, page 236, and 1907, page 106.) Detective Lewis and Acting Detective Andrews recovered 3J yd. of the tweed from a man named Henry Waters, who stated it was given to him by offender, who has' left Wellington. If arrested, every effort to be used to obtain possession of the tweed or trace it if sold. ( For description of the tweed see Police Gazette, 1911, page 79.) WELLINGTON.— 8th instant, that she may be compelled to ( contribute towards the support of her child, an inmate of the Wellington Receiving Home, Mary Crowley, age twenty- eight, height 5 ft. 2 in., domestic, native of Ireland, medium build, dark hair and complexion, dark- blue eyes; wears spectacles. On 10th October, 1908, her address was care Mrs. George, Paparangi, Johnsonville. ( See Police Gazette, 1909, page 97.) WELLINGTON.— 8th instant, on warrant for being absent without leave from the s. s. " Tongariro," C. Hearn, age thirty- five, height 5 ft. 10in., fireman, native of England, fair hair and moustache, strong build. A reward of £ 2 is offered for his apprehension. WELLINGTON.— 7th instant, on warrant for failing to provide for the maintenance of his illegitimate child, Wil- liam Thomas, age thirty, height 5 ft. 8 in. or 9 in., labourer and farmer, native of Australia, fair hair and complexion, blue eyes. Complainant, Florence Astridge, Levin. WELLINGTON.— 4th instant, that she may be compelled to contribute towards the support of her child, an inmate of the Wellington Receiving Home. Elsie Pauline Watson, age twenty- seven, height 5 ft. 2 in., domestic, native of Australia, slight build, fair complexion, dark hair, brown eyes ; wears glasses. On the 10th May, 1907, she was ordered to pay 5s. a week for the support of her child, and on the Gth instant she was in arrears £ 48 10s. ( See Police Gazette, 1908, page 440.) NELSON.— 1st instant, on warrant for disobeying an order of Court to pay 5s. a week for the support of his wife, Sarah Orr, Eric Orr, age about forty- six, height 5 ft. 8 in., labourer, supposed native of Scotland, medium strong build, fair hair, beard, whiskers, and moustache, top front teeth broken, slightly bow- legged. Photograph filed in the In- spector's Office, Wellington. He was recently living with some Maoris near Hawera, and was g'ing under the name of Charles Wilson. He has a brother, Charles Orr, a oarpenter, living in Newtown, Wellington, and a sister, Mrs. Reeves, at Brooklyn, Wellington. WESTPORT.— 19th ultimo, on warrant for theft of a gold- nugget pin ( recovered), value 13s. 6d., the property of James Cook, labourer, William Rodgers. age twenty- four, height 5ft. 8in., hawker and theatrical agent, native of New Zealand, fresh complexion, long dark hair ( parted in centre), clean- shaved, slight build ; dressed in dark- greenish suit. He has been in Fuller's and other companies, but has recently been hawking poli- hing- paste. WESTPORT.— 28th ultimo, on warrant for disobeying an order of Court to pay towards the support of his wife, Lily Fitzgibbon, £ 1 a week, John Joseph Fitzgibbon, age thirty- seven, height 5 ft. 8 in., mirier, native of Ireland, medium build, dark complexion, dark- brown hair, brown eyes; generally wears dark suit. When he left he was £ 10 in arrears. He is supposed to be accompanied by a woman going under the name of Mary Penrose or Mrs. Boyle, age about thirty five, stout strong build, brown hair, pale com- plexion; neat appearance. She has relations at Ngahere, near Grey mouth. Photographs of offender and woman filed in the Inspector's Office, Greymoutb. They will probably travel together as man and wife. CHRISTCHURCH.— 11th instant, that he may be interviewed and steps taken to compel his attendance as a witness in the case Rex v. Saddler and Jack charged with murder, Lyell Hanssen, age twenty- eight to thirty, height about 5 ft. 5 in., wharf labourer, native of Lyttelton, New Zealand, medium build, swarthy complexion, dark- brown hair, clean- shaved except dark moustache ; dressed in dirty blue suit and harp hat; looks like a fireman or sailor ; dirty appearance. CHRISTCHURCH.— 2nd instant, that he may be induced to pay off arrears due for the maintenance of his three children in the Christchurch Receiving Home, Alfred Richardson ( may go under the name of Evans), age forty- six, height 5 ft. 9 in., labourer, native of England, medium build, fo- ir i complexion, brown hair, grey eyes, walks very erect, and V swings his arms when walking. He left the Addington ijj Workshops about five years ago for Auckland, but no traceSj of him can be obtained since. LYTTELTON.— 27th ultimo, on warrant of commitment to Lyttelton Prison for seven days in default of paying £ 1 9s. fine and costs for a breach of the peace, James McKinnon, age thirty, height 5 ft. 8 in., seaman, native of Scotland, fresh complexion, fair hair, blue eyes, nose crooked. TIMARU.— Between 11th and 17th January last, on war- rant for theft of a child's clothing, value £ 2, the pro- perty of Arthur Grafton Kimber, labourer, Charlotte Jane Kimber, age forty, medium height, native of New Zealand, thin features, dark hair and eyebrows ; dressed in grey cos- tume. She has her daughter, Lucy Maria, age eleven, with her. She is believed to have cleared out, taking the child with her to Australia, accompanied by a man named Joseph Franklin, age thirty- three, height 5 ft. 8in., labourer, small features, small ginger moustaohe, dark hair ; dressed in blue suit. Accused is the wife of complainant, living apart from him. TIMARU.— 23rd ultimo, on warrant for theft of a pair of dark tweed trousers and vest, value £ 2, the property of PERCY McGLYNN, and a pair of nearly new lace- up boots, size 9, value £ 1 5s., the property of JAMES MER- CER, — Edwards, age eighteen, height 5ft. 7 in., labourer, native of New Zealand, fair hair and complexion, clean- shaved, square build, round features. He is supposed to be identical with Frank Meagher, a Burnham boy who absconded from school on the 8th ultimo. Offender shared a bedroom with complainants at No. 53 Maori Hill, and were all employed at the freezing- works. DUNEDIN.— 1st instant, on warrant for disobeying an order of Court to pay 2s. 63. a week for the maintenance of '* his child, an inmate of Caversham Industrial School, Adam Edgar, age forty- seven, height 5 ft. 9 in., porter, station cook, and labourer, native of Scotland, fair hair ani mous- tache, blue eyes, impediment in speech, medium build, hair turning grev; fond of drink. The order was made in 1900, and on the 27th April, 1909, he was in arrears £ 14 12s. 6d. DUNEDIN.— 2nd instant, for indecently assaulting Annore May Wilson, a school- girl, six years of age, Man ( name un- known), age about thirty- eight, height about 5 ft. 8 in., sup- posed labourer, medium build, hair inclined to be red, clean- shaved, two or three days' growth of red hair on. face; dressed in dark suit, and was wearing a black hard hat stamped " Herbert Haynes and Co., Invercargill," on inside, and the letters " E. R. A." No warrant. OUTRAM.— 14th ultimo, that a summons may be served on him for procuring liquor during the currency cf his prohibi- tion order, Benjamin Wise, age forty- one, height 5 ft. 8in., labourer, native of Scotland, medium build, dark hair, fair complexion, grey eyes. GORE.— Between the 12th and 19th January last, on warrant for keeping liquor for sale, Charles George Thurston, olias Butters, age sixty- one, height 5 ft. 74 in., agent and farmer, native of England, medium build, fresh complexion, fair hair turning grey, short- clipped ginger beard ( may now bo clean- shaved) ; wears spectacles, and pretends that he is short- sighted ; cunning smile when look ing at any one ; dressed in grey saddle- tweed sac suit and hard black- felt hat; always carries a walking- stick. 109 NEW ZEALAND POLICE GAZETTE. . MASTERTON. — Garioch Davidson, alius George Davidson, disobeying order of Court, has been arrested by Constables Skinner and Quirk, Tauranga police, and Remanded. ASHBURTON.— Stewart Wright Buchanan, default of maintenance, has been arrested by Constable Reed, on infor- mation supplied by Constable J. j. O'Grady, and remanded. DUNEDIN.— George Thomas Sherwood, wanted for wife- desertion : It has been ascertained by Constable Demp- sey, Wellington police, that William Sherwood, who died at the Wellington Hospital on the 5th instant, is identical with offender. ( See Police Gazette, 1907, page 181.) DUNEDIN. — Philip Reeder, disobeying maintenance order, has been arrested by Constable D. M. Mackenzie, Owaka police, on information supplied by Constable G. NEWTON. — 2nd or 3rd instant, the shop of WALTER BUCHANAN, confectioner, was broken into, and a shilling with a hole in it, a German coin resembling a florin, and a counterfeit shilling stolen. A silver- mounted wallet was found in the shop, apparently left by the thief or thieves, the name " Patrick Wilson, 1911," with different Sydney addresses was written inside of it. GISBORNE.— About 20th ultimo, from a paddook, the pro- perty of WILLIAM HENNESSY, bootmaker, a brown pony mare, 15 hands high, " JH " conjoined on near shoulder, two back bits out of cach ear, white star on forehead; value, £ 10. HAWERA— Between 22nd February and 5th instant, from the dwelling of JOSEPH McKENNEY, a gold bangle ( No. 69 in illustration?), has two white and two red stones set in scroll, originally set with five stones ( one missing), a piece of broken chain attached ; a gold chain ( No. 31 in illustrations) ; a plain gold cross, a gold Celtic cross, and a greenstone Maltese cross attached ; a gold neckohain ( No. 31 in illustra- tions) ; a plain gold band ring, " M. R." engraved on it; and a gold Trilby ring : value, £ 15. Identifiable. NORMANBY.— 12th ultimo, the shop of EDGAR ORMOND CHIVERS, storekeeper, Okaiawa, was broken into, and the following stolen : A dark- grey chock Kaiapoi rug, and a dark- brown Kaiapoi rug, value £ 1 each; a pair of gentlemen's light American boots, size 6, " No. 551 " on inside, " U " on sole, value 17s. 6d. ; and a pair of saddle- tweed trousers, value 15s. TAUMARUNUI.— 6th or 7th instant, from tho bedroom of J. W. ELLIS, a gold hunting- watch, glass broken, engraved on inside of case " J. W. Ellis, he tohu Aroha na Manawa," value £ 23 ; and about £ 7 in gold and notes. BULL'S.— 15th ultimo, from outside the Junction Hotel, the property of JOHN MYERS, labourer, a gentlemen's Raleigh bicycle, No. 156982, black- enamelled frame, froe wheel, no grips on handles, no mud- guards; value, £ 8. Identifiable. PETONE.— WALTER HIGGINBOTHAM'S horse stolen on 20th November last : The stolen horse was sold on the 21st November, 1910, to Maurice Joseph Hasler, carpenter, Eastbourne, for £ 12, by a drover named William FiizCun- ningham, who had with him four dogs, one yellow, two black and tan, and one black and white. He stated that he exchanged his horse for the stolen one with two Men who had a wagon near Palmerston North, who were canvassing for orders for enlarging photographs. ( See Police Gazette, 1910, page 493.) NELSON.— 17th ultimo, from tho clothes of HOWARD EARLY, while he was bathing at Tahuna, a purse contain- ing four sovereigns; and a silver keyless open- faoed silver watch, small figures on dial, well worn oases, Bennett and Son, Cheapside, London, makers, value £ 2. ASHBURTON.— 2nd instant, from the pavilion, Ashburton Domain, the property of WILLIAM HAROLD NICOL, clerk, a yellow- leather pouch, containing seven sovereigns, 5s. in silver, a 9 ct. gold medal, the size of a shilling, inscribed " D. A. A. C., 17/ 2/ 06," on one side, and " W. H. Nicol, 1st 120 yards maiden," on the other side, value £ 1 10s. AVONDALE.— 22nd or 23rd ultimo, from the dwelling of BERTHA WILFORD, New Lynn, a rug, tartan- pattern on one side, brown on the other, darned with wool iu the centre, value £ 1 5s. ; a Savings - bank book in name of Sarah Wilford, showing deposits amounting to £ 21 ; and Harry Wilford's Savings- bank book showing deposits amount 110 NEW ZEALAND POLICE GAZETTE. . [ FEB. 2' 2 DUNEDIN.— 22nd ultimo, from the bedroom of Mrs CRA- CROFT WILSON, care of Fuller and Sons, Criterion Hotel, three pairs of new long white- kid gloves, value 12s. 6d. each ; about £ 3 in gold and silver; a white- metal trinket- box, " Useful Things" on top, value 10s.; a gold brooch about size of half- a- crown, emerald in centre, surrounded by leaves studded with pearls, value £ 2 ; a thistle brooch, two thistle- heads, one an amethyst, the other a topaz, value £ 1 ; and a turquoise heart pendant, value £ 1. Identifiable. DUNEDIN.— 21th ultimo, from the bedroom of WALTER ROSS, commercial traveller, Wain's Hotel, a gentlemen's gold watch, value £ 10; a ribbon watch- guard with gold shield inscribed " W. R., from C. H.," a gold- mounted tiger's claw, and a silver cigarette- holder case, value £ 3. Suspicion attached to J. Ross ( name supposed fictitious), age about forty, height about 6 ft., supposed labourer, medium build, clean shaved except dark moustacho, high cheek- bones, large eyes, supposed dressed in dark- tweed suit and cap. The watch was sold at, and has been recovered from, E. D. Prit- chard's second- hand shop. The suspect's description is somewhat similar to that of John Moore, who disappeared from Dunedin about the time the theft was committed. ( See Police Gazette, 1910, page 234.) ABSCONDERS FROM INDUSTRIAL SCHOOLS. AUCKLAND.— lst instant, from Auckland Industrial School, Catherine Peterson, age fifteen, height 5 ft. 3 in., native of New Zealand, medium build, pale complexion, fair hair ; wearing a black- lustre dress, gem hat, and lace- up boots. She has a sister in Newmarket, and a married sister, Mrs. Tanner, living in Devonport. Arrest urgently desired by the Manager of the school. LINCOLN.— Frank Meagher, age sixteen, height 5 ft. 6 in., farm labourer, good build, light- brown hair, pale complexion, blue eyes, broad nose, boil- marks on back of neck; dressed in blue- serge coat, vest, and cap, dungaree trousers, and heavy lace- up boots, " No. 149" on clothing. His mother, Mrs. Edwards, resides at Shea's Road, Waimate. Absconded 8th ultimo. John Henry Heath, age about twenty, height about 5ft. 7 in., farm labourer, good build, brown hair, blue eyes, fair fresh complexion, slightly frockled broad face, large mouth; dressed in blue- serge sac suit, grey- tweed cap, and lace- up boots. His parents reside at Waihi. Absconded on 15th ultimo. Edwin Lloyd Feldwick, age nineteen, height 5ft. 4 in., clerk and labourer, good build, fair pale complexion, fair hair, grey eyes, pug- nose; dressed in brown sac suit, light- coloured tweed cap, and lace- up boots. His mother resides in Linwood, Christchurch. Absconded 15th ultimo. DESERTERS FROM HIS MAJESTY'S SERVICE. From H. M. S. " Powerful." SYDNEY.- William Edward Parkes, age twenty- three, height 5 ft. 4 in., A. B., native of England, brown hair, grey eyes, fresh complexion, scar on right wrist, mole on right leg, tattoo- marks on left forearm, and " Love " on right arm Deserted 20th ultimo. Samuel James Blackwood, age two ty- five, height 5 ft. in., A. B., native of England, dark- brown hair, brown eyes, fresh complexion. Deserted 20th ultimo. Sidney Martin, age twenty- one, height 5 ft. 4Jin stoker native of England, brown hair, fresh complexion. Deserted 23rd ultimo. A reward of £ 3 will be paid for the apprehension of each. From H. ll. A reward of £ 3 will be paid for his apprehension. INQUIRIES, ETC., FROM OUTSIDE NEW ZEALAND. " IRELAND.— Inquiry requested for James Murphy, who commenced sea- life when very young ( with his oousin, Captain Arthur Murphy). About 1885 he wrote to his mother stating that he was living in New Zealand, many miles from a post- office, and directed that letters for bim should be addressed to the Dunedin Post- office. He then intended leaving on a visit to Canada and England, and represented that he was in good circumstances. He would be now about fifty years of age. ( 11/ 300.) HOLLAND. — Inquiry requested by the Consul for the Netherlands, Wellington, on behalf of the Netherlands Indian Government, for Warwolf Cornelis Jacobus Swart, charged on warrant issued on the 6th ultimo for embezzling 80,000 guilders, the money of the Handolsbank. Description : Age twenty- four, smallish build, light- brown hair, clean- shaved, or may have beard and moustache, deep set grey- blue eyes, prominent ears, wearing wedding- ring with " 19.10.07, Anna, 7.12.08," eDgraved on the inside, had with him a red- steel trunk and grey- canvas handbag. [ Before W. G. RIDDELL, Stipendiary Magistrate, Welling- ton.— 25th February, 1911.] BLACK V. GLYNN. Judgment. THIS is an application by the defendant for a rehearing of the iuformation under which he uas convicted for an assault on the informant on the 3rd of February last. The applica- tion is mado under section 120 of the Jus ices of the Peace Act, 1908, which states that any Justice before whom any information or complaint has been heard may in his dis- cretion grant a rehearing of such information or complaint upon such terms as to him seems fit. The application is opposed by the informant on the grounds : - ( 1.) That as defendant lias paid the fine imposed by the Court the matter is res judicata. . ( 2.) That defendant has no statutory or other right to make such an application, as the oflence for which he was convicted is an indictable one, and section 120 does not apply to informations deal- ing with indictable offences triable summarily. The first objection is in. my opinion disposed by the deci- sion in Rex v. Hughes ( 12 G. L. R., 19), where it was held by the Court of Appeal that a person who had served a sentence was not absolutely disqualified from obtaining a new trial, but the application must be made promptly or without unreasonable delay. The second objection is of more impoit- ance ; but, without discussing the distinction between ordin- ary offences within a Justice's jurisdiction and indictable offences triable summarily, it may be noted that section 120 does not refer to any particular kind of offence, but merely confers upon Justices a discretionary power to rehear infor- mations which have already been dealt with by them at some earlier date. I do not think that the position of the section in that part of the Act which deals with the ordinary juris- diction of Justices is conclusive that it refers only to infor- mations concerning offences not indictable. The main object of the Act is to set out the procedure applicable to cases coming within the jurisdiction of Justices, and by sec- tion 4 of the Acts Interpretation Amendment Act, 1908, the division of any Act into parts, and the headings of such parts shall be deemed for the purpose of reference to be part of the Act, but the headings shall not affect the interpreta- tion of the Act. Further, the word " information " is de- fined by the Acts Interpretation Amendment Act as an iuformation made in accordance with the Justices of the Peaco Act, 1908, in respect of an offence punithable on summary conviotion ; and summary conviction is defined as meaning a conviction by a Magistrate or one or more Justices in accordance with the Justices of the Peace Act. I think, then, that the information under which defendant was charged with assault oomes directly within the defini- tions juat referred to, and so is covered by section 120 irre- spective of the fact that the offence is an indictable one triable summarily. I am also unable to see how the pro- cedure or jurisdiction of the higher Court with regard to indictable offences can be affected by holding that Justices have jurisdiction to hear such an application, for subsec- tion ( 5), section 7, of the Crimes Act, 1908, expressly says that nothing in that Act shall be construed to annul or limit any provisions made by any other Act for the trial and punishment of indictable offences in a summary way. Sec- tion 178 of the Justices of the Peace Act, 1908, confers the necessary jurisdiction on Justices to deal with common assaults in a summary manner, and in this case the usual summary procedure was followed. A similar application was considered in 1898 by Mr. Hutchison, Stipendiary Magistrate, iu the case of Rex v. Sjoberg ( 2 Magistrates' Courts Re- ports, p. 27), when he decided that Justices had no jurisdic- tion to griut a rehearing of an information containing a charge of an indictable offence ; and some considerable time ago 1 dismissed an application for rehearing in the oase of Lane v. Carey, partly on the ground that the fresh evidence to be adduced was corroborated only, and partly because I I was not prepared to disagree with Mr. Hutchison's decision. The present application has, however, been argued more fully than that in Lane v. Carey, and after further considera tion I am satisfied that I should not follow the decision in Rex v. Sjoberg.
