V] OTICE.— For instructions as to the manner in which reports are required to be furnished for the com- pilation of the Police Gazette* see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. AUCKLAND.— 28th January last, on warrant for dis- obeying an order of Court to pay 15s. a week for the main- tenance of his wife, Alfred Walter Alexander Barnard, age thirty- one, height 6 ft., employed in theatrical line, native of England, slim build, brown hair, clean- shaved, brown eyes, dark thick eyebrows, small bald patch on top of head, sallow complexion, large hands, may be found with a travelling circus. On the above date he was in arrears £ 2 5s. AUCKLAND.— On warrant for deserting his wife within the last six months and leaving her without adequate means of support, John James McKinnon, age thirty- seven, height 5 ft. 11 in., labourer, native of Australia, broad build, fair complexion and hair, light ginger moustacho, scar on bridge of nose. AUCKLAND.— 10th ultimo, on warrant for failing io pro- vide his wife, Elizabeth Fitzell, with adequate means of sup- port, John Fitzell, age fifty, height about 5 ft. 11 in., farmer, native of Ireland, slight build, dark complexion, very slightly cross- eyed. He has a brother living in Gisborne, and may go there or to Taihape or Dannevirke. AUCKLAND.— 23rd ultimo, that he may ba served with a summons for breach of a prohibition order, Richard Grimwood, age sixty- five, height 5 ft. 7$ in., labourer, native of England, fresh complexion, dark hair turning grey, blue eyes, large nose, left little finger contracted. AUCKLAND.— 24th ultimo, that a summons may be served on him for a breach of the Auokland Tramway By- laws, Edward Thomas, age about fifty, height 6 ft., well built, labourer, native of Now Zealand, dark hair turning grey, long dark beard turnii g grey. RAWKNB. — 18th January last, on warrant for failing to provide I r the maintenance of his illegitimate child, Arthur Warren, age about twenty, height about 5ft. 6 in., labourer and bushman, a half- ciste Maori, medium build, sallow complexion, dark hair and very small dark moustache ; usually dresses well. His mother, known as Fanny Warren and Fanny Gundry, is now residing at Opotiki. Complainant, Lucy te Tai. TAUMABUNUI.— 28th ultimo, on warrant of commitment to Auckland Prison for three months in default of paying £ 26 7s. fine and costs for keeping liquor for sale in a pro- hibited area, Charles Burrows ( known as " Nugget "), ago forty- four, height 5 ft. 3 in , cab- diiver, bookmaker, and racecourse guesser, short thick- set build, full round face florid complexion, light- brown hair turning grey, moustache only, grey eyes, one prominent gold- filled tooth in front, scar on one cheek ; usually wears a dark suit and soft white shirt; invariably wears a grey soft- felt hat. He is accom- panied by a woman ( supposed his wife), age about twenty- five, delicate appearance, slight build, dark hair, and one child about three or four years old. DANNEVIRKE.— 22nd ultimo, on warrant for failirg to providofor the future maintenance of his unborn illegitimate child, Stephen Corlett, age about twenty six, height about 5 ft. 8 in., dairy- factory hand, native of New Zealand, medium build, fair complexion and hair, blue eyes, clean- shaved, pimples on lower parts of face, front upper teeth false; usually wears grey suit and cap and celluloid collar. He was employed at the Umutaoroa Dairy Factory, and left there on the 21st ultimo. Complainant, Rose Mary Augustine. 98 NEW ZEALAND POLICE GAZETTE. . [ FEB. 2' 2 WANGANOI.— 4th ultimo, on warrant of commitment to Wanganui Prison for seven days in default of paying £ 1 7s. fine and costs for drunkenness, Edward McAnulty, age thirty- seven, height 5 ft. 10J in., labourer, native of Ireland, medium build, fresh complexion, olean- shaved except brown moustache, brown hair, blue eyes; sunburnt appearance; does not wear a hat ; dressed in dark- tweed suit and soft dark shirt. ( See Police Gazette, 1911, page 75.) WELLINGTON.— 24th ultimo, on warrant for deserting from the s. s. " Rimutaka," Peter Schmidt, alias Harry Thompson, age thirty- seven, Height 5 ft. 6fin.. fireman, native of Denmark, strong build, fair complexion, light- brown hair, blue eyes, broad nose, scar near right ear; dre.- sed in dark suit and blue jersey. WELLINGTON.— 5th December last, on warrant of com- mitment to Wellington Prison for one month for disobeying an order of Court to pay 10s. a week for the maintenance of his mother, Mary McNab, Robert McNab, age forty, height 5ft. 6Jin., bootmaker and labourer, native of New Zealand, stout build, dark complexion, dark hair, hazel eyes, scar on back of right band and top of left forefinger. On the above date he was in arrears £ 18. CHRISTCHURCH.— 28th ultimo, on warrant for failing to provide his wife, Edith Jane Herdman, with adequate means of support, William Herdman, age forty, height 5 ft. 8 in. or 9 in., late railway- crossing keeper, native of Lancashire, England, slight build, fair complexion, black hair, brown eyes, fair moustache only, left arm artificial, right arm broken between elbow and shoulder, and he is unable to raise it without assisting it by left arm. He may have gone to his brother- in- law, Albert Arnold, farmer, Rongotea. His brother is employed as porter at the Grand Hotel, Palmerston North. CHRISTCHURCH.— 28th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegiti- mate ohild, Logan Elliott, age about twenty- eight, height about 5 ft. 10 in., shipping clerk, native of Victoria, Australia, medium build, dark complexion, black hair, clean- shaved, very square chin; dresses well in navy- blue or grey- striped sac suit. He was last seen in Westport at the end of November, 1910, and is supposed to have come to the North Island. Complainant, Grace Thorn, Christchurch. CHRISTCHURCH.— 23rd ultimo, on two warrants of com- mitment to Lyttelton Prison for forty eight hours in default of paying £ 1 fine and costs for a breach of the by- laws, and twenty- four hours in default of paying 8s. fine and costs for drunkenness, Isaac Michael Charles, age twenty- eight, height 5 ft. 5J in., dentist, native of New Zealand, slight build, fair complexion, long brown hair ( inclined to be curly) ; dressed in blue suit and grey cap. CHRISTCHURCH.— 22nd ultimo, on warrant of commit- ment to Lyttelton Prison for twenty- four hours in default of paying 8s. fine and costs for drunkenness, Thomas Alfred Shields, age twenty- eight, height 5 ft. 8 in., labourer, native of New Zealand, medium build, fresh complexion, fair hair, grey eyes; dressed in grey suit and cap. CHRISTCHURCH.— 22nd ultimo, on warrant of commit- ment to Lyttelton Prison for twenty- four hours in default of paying 8s. fine and costs for drunkenness, David Mc- Donald, age fifty, height 5 ft. 4£ in., labourer, native of Scotland, medium build, fresh complexion, grey hair and eyes. CHRISTCHURCH. — 30th January last, on warrant for failing to provide his wife, Olive Anderson, with adequate means of support, Gordon Henry Rivers Anderson, age twenty- two, height 5 ft. 6 in., pastrycook, native of New Zealand, slight build, fair complexion, red hair, blue eyes, clean- shaved, cut on wrist ( supposed right) ; dressed in brown suit, light waterproof overcoat, hard black hat, and tan boots. He has one brother in Invercargill and another at Saltwater Creek, near Timaru. DUNEDIN.- Charles Hastings Bradley, wanted on warrant for a breach of the Bankruptcy Act : It has been ascertained by Acting- Detective Sweeney, Auckland police, that offender left Auckland for San Francisco on the 17th December last, under the name of Dougall McPherson. ( See Police Gazette, 1911, page 25.) APPREHENSIONS, PERSONS FOUND, ETC. AUCKLAND.— Evelyn V. Kitson, false pretences, has been arrested by the Pousonby police on oharges of a' tempted suicide and forgery. He was then going under the name of Albert L. Gibb. His identity with Kitson was established by Detective Quartermain, Auckland police. ( See Police Gazette, 1911, page 65.) AUCKLAND.— Frederick Campbell Thomas, failing to provide for the maintenance of his daughter : Warrant cancelled. ( See Police Gazette, 1905, page 423.) AUCKLAND. — Percival H. Robert Horner, default of fine, has been arrested by Constable^ Beddek, Shortland police, and lodged in Tbames Prison. ( See Police Gazette, 1911, page 65.) AUCKLAND.— Richard Hammond Henry Wilkes, alias Sydney Wilkes, has been arrested by Constable D. Calwell, Freeman's Bay police, and lodged in Mount Eden Prison. ( See Police Gazette, 1910, page 158.) GISBORNE. — Joseph J. Murphy, sly- grog selling, has been served with a summons by the Feilding police, on information supplied by Aoting- Detective Sweeney, Palmers- ton North police. Offender has been convicted and fined £ 25 and costs, or one month in Wanganui Prison. ( See Police Gazette, 1911, page 55.) LEVIN. — John Thomas Kennedy, alias Wilson, default of fine, has been arrested by Aoting- Deteotive Powell, Auckland police, and lodged in Mount Eden Gaol. ( See Police Gazette, 1911, page 24.) WELLINGTON. — William alias Charles William Johnston, failing to provide, has been located at Cheviot by Constable ( F. Holland, Cheviot police, and has promised, to pav off the arrears due for the maintenance of his children. ( See Police Gazette, 1911, page 66.) CHRISTCHURCH.— Elizabeth McCowan, failing to pro- vide, has been located at Parnell by Constable Turner,, Parnell police. ( See Police Gazette, 1911, page 24.) CHRISTCHURCH. — William H. F. Gibson, indecent assault, has been arrested at M » thven by Detective Miller, Christchurch police, and Constable Moore, Methven police, and remauded. ( See Police Gazette, 1911, page 78.) AUCKLAND.— 4th January last, from a dressing- room at the Albert Street Swimming- baths, the property of JOHN LYNCH, a gentlemen's silver lever hunting - watch, No. 319425; silver double- curb chain, horse- bit bar in centre; a gold- star medal, -' L. O. S." on one side, and " 2- mile Bicyole Handicap, J. E. Lynch," on the other side ; a large silver heart- shaped medal, gold centre, " 8- mile Cycle Handicap, J. E. Lynch," engraved thereon : value, £ 5. Identifiable. AUCKLAND.— 28th January last, from the guards' room at the railway- station, the property of ALFRED JOUGHIN, porter, a gentlemen's silver hunting Waltham watch, No. 8934593, glass missing ; value, £ 6 10s. Identifiable. AUCKLAND.— Between 16th January and 16th ultimo, from a paddock, the property of WILLIAM PRESTON, a bay horse, aged, about 15J hands high; value, £ 5. Identi- fiable. PUKEKOHE.— 26th ultimo, from the Agricultural Show, the property of the HELVETIA OSTRICH COMPANY, nine ostrich- feathers of different colours, two pale blue, two white, one red, one green, one brown, and two magenta; value, from 10s. to £ 1 each. 99 NEW ZEALAND POLICE GAZETTE. . [ FEB. 2' 2 ROTORUA.-— 15th January last, from the railway- shed, the property of JOE EAISA, hawker, a leather trunk, contain- ing a black pocket- revolver, eight assorted combs, two shav- ing- brushes, six gentlemen's white handkerchiefs, a square white faucy table- cover, a pocket- knife, a Crimean shirt, a pair of under- pants, a long cloth wrapper ; value, about £ 2. The trunk was found in tho bush, cut open, and the oontents stolen. PALMERSTON NORTH.— 23rd ultimo, from the bedroom of KATE HURLEY, Railway Hotel, an 18 ct. gold band ring, set with three red stones, two stones missing; a 9ot. gold ring, set with a red stone ; a gold neck- chain with small plain gold cross attached, small stone in centre of cross; a Oct. gold circular brooch, set with six red stones and two pearls ; a Oct. gold bangle, curb and square- band pattern, fastens with locket and thin gold chain : value, £ 7 10s. Identifi- able. Also stolen, a ladies' silver keyless hunting- watch, " M. A. O." engraved on back of case; value, £ 2 10s. ( identi- fiable) ; the property of Mabel Outtram. WELLINGTON.— 21st or 22nd ultimo, from the bedroom of THOMAS JAMES SULLIVAN, labourer, Sydney Street, a gentlemen's silver hunting keyless Waltham watch, No. 213470, " T. Sullivan " on inside back case, value £ 2 15s., a gentlemen's silver hunting Erhardt watch, No. 14340792, value £ 3; a 15 ct. gold chain, open- curb pattern, with 9 ct. gold medallion, " I. O. R." on it, attached, value £ 10; a silver double chain, curb- paitern, value 10s. All identifiable. Suspicion attached to a Man ( name unknown), age forty, height 5ft. 6 in., medium build, brown hair, fair moustache, one finger missing, tattooed on chest and arms, dressed in dark ooat and vest, light- coloured trousers. The suspect was in complainant's house during the night of the 21st ultimo, and disappeared in the morning before complainant was awake. CHRISTCHURCH. — 28th January last, from the Grand Hotel, the property of GEORGE GREENWOOD, run- holder, Amberley, a pair of Goertz prismatic glasses, " G. D. G." on them, enclosed in a leather case, " G. D. G." on case ; value, £ 8 8s. Identifiable. LYTTELTON.— 21st ultimo, from a tent, the property of WALTER TOY, a white- metal watch; a silver sovereign- case, " W. T." engraved thereon, containing three sove- reigns : value, £ 5. Suspicion attached to a Man ( name unknown), age about thirty, height 5 ft. 8 in. or 9 in., fireman, well built, dirty evil appearance ; dressed in dark jacket and dungaree trousers. TIMARU.— 4th ultimo, from behind the Club Hotel, the property of MICHAEL FREDERICK DENNEHY, a gentle- men's black- enamelled bicjcle, No. 32202, straight fixed handles, rat- trap pedals, Oceanic tires, narrow rims, tool- bag on seat; value, £ 5. Identifiable. OWAKA. — 4th ultimo, from outside the store of Millar Bros., the property of W. MILLAR, storekeeper, a gentle- men's Union Speoial B. S. A. bicycle, 20 in. frame, Eadie hub, nickel rims, leather grips, rat- trap pedals, half- racing handles, celluloid mud- guard on back wheel, tool- bag and pump attached, Brooks saddle, one spring broken ; value, £ 8 10s. Identifiable. PROPERTY RECOVERED. AUCKLAND.— CALVERT FRODSHAM'S property stolen: Roderick Ryan has been arrested for thiB offence by Detec- tive Cox and Acting- Detective Sweeney, Auckland police, and committed for trial. The stolen articles have not been recovered. No further suspicion attached to the other sus- pect. ( See Police Gazette, 1911, page 67.) WAIKINO.— THOMAS ROWLAND'S saddle has been re- covered. ( See Police Gazette, 1911, page 26.) ONGARUE.— ELIZABETH KING ( or WIGG): The rings reported stolen have been recovered. ( See Police Gazette, 1911, page 26.) RAKAIA. — JOHN THOMAS STEVENSON'S dwelling broken into: The suspect, William Duncan, alias Billy Eriwata, has been arrested for the offence by Constable Bingham, Geraldine police. He was found wearing part of the stolen property. ( See Police Gazette, 1911, page 79.) OWAKA.— ROBERT LANDRETH'S bicycle has been re- covered: It was left outside Millar Bros, store in place of W. Millar's bicycle which was stolen. ( See " Property stolen," this issue of Gazette, and 1911, page 58.) GORE. — THOMAS GARRICK'S property has been re- covered : not stolen. ( See Police Gazette, 1911, page 68.) INQUEST. Man ( name unknown). OAMARU.— On the 20th February, 1911, the above man, name unknown, was arrested for drunkenness at Oamaru. He was attended to by a doctor, but died at 12.45 a. m. on the 21st February in the lock- up. He came from Timaru on the 20th February by the slow train which arrived in Oamaru at 8.20 p. m. There were no external injuries, and the Coronor's verdict was that deceased died from heart- failure due to acute alcoholic poisoning. Description : Age about fifty, height 5 ft. 5 in., medium build, dark hair, fair moustache ( both turning grey), bald all over top of head, blue eyes, fresh complexion, round full face, about 11 stone weight, fair hair on chest ( turning grey), " L. T." tattooed on back of left hand and four or five horizontal lines on left forearm, sailing- ship, anchor, and " S. A. M." on right fore- arm. He was wearing a blue- serge coat with maker's name, " A. Begg and Co., Tailors, 156 High Street, Christchurch," on tab, a grey waistcoat, dark- and- red- striped dark- tweed trousers, grey- woollen shirt ( size 6), white- woollen under- pants, dark heather- ooloured undershirt, grey socks, blucher boots ( size 8), black muffler, narrow waist- belt. His swag contained a flask of whisky; a piece of comb ; a white pocket- knife ( handle worn, small blade broken, shield on handle); a cherry- wood pipe, thread wound round tho mouthpiece; two bottles Ward's beer; two white handker- chiefs ; a billy- can, narrower at top than at bottom, lid made so that it can be used as a pannikin ; a white towel; three small white bags, two containing sugar and one tea ; two single blankets, white, red, and brown stripes ; a piece of tent; an old brownish- coloured coat, with blue and yellow stripes, very much faded ; a pair of dungaree khaki pants ; a tweed cap, with grey- green checks, no lining ; seven plugs of Havelock tobacco; a new Bengal razor; a new dessert- spoon ; a shaving- brush, with wooden handle ; a blue shirt, sleeves cut off at the elbow ; a navy- blue flannel; a ladies' waist- belt; a razor- strop ; and a red handkerchief with white spots. PICTON.— Harry Clifford Mason Room, agenineteen, height 5 ft. 5in., seaman, native of Bristol, England, light- brown hair, hazel eyes, fair complexion. Deserted 15th ultimo. A reward not exceeding £ 3 will be paid for his apprehension. From H. M. S. " Powerful." SYDNEY.— Arthur Thompson, age twenty- two, height 5 ft. 3 in., Btoker, native of England, black hair, brown eyes, dark complexion, " E." on left forearm and scar over left eye. Deserted 14th ultimo. " Challenger." 13th February, 1911. SYDNEY.— Harold H. Huntingford, ago twenty- two, height 5 ft. 3 in., stoker, native of England, dark- brown hair, brown eyes, sallow complexion, scar on forehead. Bernard Fowler, age twenty- six, height 5 ft. 6 in., stoker, native of England, dark- brown hair, grey eyes, fresh oomplexion. A reward of £ 3 each is offered for their apprehension. MISSING. AUCKLAND.— Since 13th ultimo, William Sedgwick Kent, age eighteen, height 5ft. 7 in. or 8 in., solicitor's clerk, native of New Zealand, fair ruddy complexion, long face, prominent nose, large ears, slight build, thick lips ; dressed in new brown sac suit with dark stripe, slit in back of coat, new Gem straw hat or cap, soft coloured shirt, and turn- over linen collar; walks with a short, quick shuffling step. He loft home unexpectedly, and, as be is supposed to be suffering mentally, fears are entertained for hia safety. Inquiry by Mestrs. Earl and Kent, solicitors, Auckland. AMERICA. — Inquiry requested for David Helier Gaudin, who sailed from South Africa for New Zealand a year or two ago. He is an eleotrical engineer, and was supposed to be employed in the New Zealand Government service, but no trace of him can be obtained. No descrip- tion given. Inquiry by Albert Heathcock, Wyckoff, N. J. ( 11/ 492.) BERWICK- ON- TWEED.— Inquiry requested for William Pringle, age thirty- four, height 5 ft. 11 in., joiner and carpenter, fair complexion. He left Kimberley, South Africa, for Napier, New Zealand, about two years ago, and stopped at the Scinde Private Hotel. He was employed on the railway- construction works at Towai, Auckland District, and also worked at Wellsford, and left there ab ut August last, supposed for Auckland. Inquiry by his wife. SYDNEY.— Stolen, on the 4th February last, from a yard at Albury, the property of EIOHAED SKUTHOEPE, buck- jumping show, a bay buok- jumping horse, branded " GS" with " U" sideways ( position not known), mark of old wound on wither, black points, 15 hands high, six years old ; value, £ 300. Criminal Law — Habitual Criminals — Previous Convictions — Convictions before a Magistrate— The Crimes Act, 1908, Section 29. The previous convictions requisite under section 29 of the Crimes Act, 1908, to enable tbo Court to declare a piisoner an habiiuil criminal need not necessarily be con- victions on indictment, but may be oonvictions before a Magis'rate, so long as they are convictions for the offences mentioned in Classes I or II of the section. So held by the Court of Appeal ( Stout, C. J., and Wil- liams, Edwards, Cooper, and Chapman, JJ.). CASE stated by Edwards, J., for the opinion of the Court of Appeal under sections 442 and 443 of the Crimes Act, 1908. Tlu prisoner was convicted on the 8th of February, 1909, in the Supreme Court at Auckland, upon two indictments chaiging him ( a) with forgery, uttering and attempted false pretences ; ( 6) with theft. The calendar of his convictions showed that lie had been previously convicted four times upon iudictment of offences within Class II as defined by section 29 of the Crimes Act, 1908. These convictions were admitted by the prisoner, and he was, in addition to his term of imprisonment, declared to be an habitual criminal. It afterwards appeared that the calendar was erroneous, and that the prisoner had not been four times convicted upon in- oictment of such offences, but twice upon indictment and twice before a Magistrate. Tne question for the opinion of the Court was whether in the above circumstances the pri- soner had been lawfully declared to be an habitual criminal. The Solicitor- General, for the Crown :— The question is whether the previous convictions under section H9 ( 6) must be convictions on indictment. The of- fences must be such as can be punishable on indictment, but need not necessarily be so punished. Section 29 ( 2) shows that the convictions need not be under the Crimes Act, and convictions on indictment are unknown in many parts of the world— e. g., Australia. Therefore only the nature of the offence is to be ascertained. There is no dis- tinction in principle between summary convictions and con- victions on indictment. The Legislature has under sec- tion 30 intentionally limited the Magistrate's jurisdiction. The prisoner was not represented. Cur. adv. vult. STOUT, C. J.:— The question in this case is as to the meaning of the words in seotion 29, subsection 1 ( 6), of the Crimes Act, 1908. In dealing with habitual criminals and offenders this subsec- tion provides that where such oonviction is in respect of an offence included in Class II, and such person has been previ- ously convicted on at least four occasions of any offence men- tioned in Classes I or II, whether of the same description of offence or not, the Court may, in his discretion, declare . . . such person is an habitual criminal. Class II refers to cer- tain offences, and after the words describing tho offences there appears certain sections of the Crimes Aot: for ex- ample, in describing Class II the following appear— Wound- ing ( sections 195, 197, and 198): theft ( section 247). It appears that this prisoner had been convicted four times, and on two of the occasions he had been convioted before a Magistrate for theft. The question is whether those two offences which were dealt with by the Magistrate and for which he was convicted can be counted as two of Class II. It was first suggested that Class II must only refer to in- diotable offences. To that a reply was made that where the offenoe was indictable, as appears in other seotions of the Act ( as in seotion 30), the words " on indictment" appear with the word " convicted." There is no suoh limitation here. It is true that in the first subseotion of section 29 the words used are " convioted on indictment," but when they 1911.] NEW ZEALAND POLICE OAZKTTE. 101 come to deal with the class of offence of whioh the prisoner had previously been convicted the words " on indictment" are left out. It was also pointed out that subsection 2 of section 29 shows that the sections quoted in ihe definition of the offences under Class II were only to be used for the purpose of showing the class of offence, because if not so used subsection 2 could not apply to the class at all, as it provides for looking at the previous convictions of prisoners whioh have been recorded against them in foreign countries. What, then, was the need of adding section 247, if theft was sufficient. I think it must have some meaning. It seems to me it must mean an offence that can be punished under section 247. It is not suggested that the offonces for which the prisoner was convicted could not be punished under sec- tion 247. If so, though convicted by a Magistrate, he has been convicted for an offence of the same class as appears in subseotion dealing with Class II. There is no doubt by so construing the Aot, and not inserting the words " convicted on indictment," peculiar provisions appear: for example, if a prisoner is convicted on an indictment for an offence, and it is proved that there are four convictions against him for theft, he may be declared an habitual criminal. If, how- ever, he is convicted before a Magistrate for theft, which may be of the same class as under section 247, though not liable to the same punishment, and though it is a theft of goods not of high value, still, if he is convioted before a Magistrate and had bee n previously convicted, even on in- diotmenc, on four oocasions of theft, the Magistrate could not commit him to the Supreme Court to be dealt with as an habitual offender unless he had in addition been convicted summarily on six other ocoasions; so that a man may be deolared an habitual criminal in the Supreme Court for fewer offences than a man can be declared an habitual of- fender by the Supreme Court, if he has appeared before a Magistrate and his last conviction is before him. This seems an anomaly that requires immediate alteration. Though I have some doubt about the matter, I do not think the Act can read in any way but that there was power in this case to declare the prisoner an habitual cri- minal ; and that declaration must stand. IN exercise of the powers vested in me by the Animals Protection Act, 1908 ( hereinafter called " the said Act "), I, John Poynder Dickson- Poynder, Baron Islington, the Governor of the Dominion of New Zealand, do hereby make the following regulations prescribing the deer- shooting season in the Marlborough Acclimatization District, com- prising the Counties of Marlborough and Sounds, and the conditions affecting the same, and also the form of license and the fee payable therefor. REGULATIONS. 1. DED- DEER stags and fallow- deer bucks may be taken or killed within the Marlborough Acclimatization District from the 24th day of February, 1911, to the 24th day of April, 1911 ( both days inclusive). 2. Licenses to take or kill such deer may be issued by the Chief Postmaster at Blenheim, and the Postmaster at Havelock, on payment of a license fee of £ 1, in the form prescribed in the Schedule hereto, and subject to the said Act and these regulations: Provided that not more than one such license shall be issued to the same person. 3. No licensee shall take or kill more than six red- deer stags or fallow- deer bucks. 4. No doe, hind, or fawn shall be taken or killed on any pretext whatever; and no licensee shall allow any dog to accompany either himself or any attendant he may have with him. 5. Nothing herein contained shall extend to authorizing any person to sell any deer or portion thereof. 6.
