WELLINGTON, WEDNESDAY, MARCH 1, 1911. \| OTICE.— For instructions as to the manner in which • i- ' reports are required to be furnished for the com- pilation of the Police Gazette! see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. AUCKLAND.— 19th September last, on warrant for dis- obeying an order of Court to pay 5s. a week for the main- tenance of his mother, Jane Thorn, the sum of £ 4 10s. being due on the 19ch September last, James Thorn, age twenty, height 5ft. 10in., labourer and bushman, native of New Zealand, slight build, fair hair and com- plexion, grey eyes, clean- shaved, nose slightly crooked ( high on bridge), old scar of abscess on one side of face. ( See Police Gazette, 1910, page 313.) AUCKLAND.— 10th ultimo, on warrant for theft of a swag, value £ 3 15s., the property of Sumner Orrison Mar- son, labourer, Daniel O'Connor, age about fifty- five, height about 5ft. 6in., labourer and gum- digger, native of Ireland, medium build, rough brown moustache turning grey, nose has been broken ( very noticeable), two fingers missing from one hand ( supposed left) ; dresses slovenly. On the above date offender sold part of the contents of the swag at Lindsay's second hand shop. AUCKLAND.— 11th ultimo, that a summons may be served in him for the maintenance of his son, an inmate of the draining Farm, Weraroa, William Wilton, age forty- eight, height 5 ft. 2Jin., fireman, native of England, fresh complexion, light- brown hair, grey eyes, large nose ; dressed in grey coat and cap. ( See Police Gazette, 1910, page 220.) AUCKLAND.— 4th ultimo, on warrant for theft of £ 50, the money of William Dow, cab- driver, Philip E. Arnot, age about twenty two, height about 5 ft. 9 in., labourer, native of England, thin build, fair complexion, clean- shaved, prominent nose, fairly good teeth ; dressed in dark suit ( trousers torn below one knee), and soft- felt hat. A motor- car was given to the offender by complainant to sell at Christchurch. He put the car into the auction- mart there, and sold it for £ 75. He received £ 50, and has failed to aocount for the money. AUCKLAND.— 18th ultimo, that a summons may be servec on him for the support of his son, Michael Hoare, an inmate of St. Mary's Industrial School, Takapuna, William Kent age forty- five, height about 5ft. 8in., labourer, native o England, fresh complexion, dark hair and moustache, maj now have a beard, rather long features, grey eyes. AUCKLAND.— 6th ultimo, on warrant of commitment to Auckland Prison for seven days for disobeying an order of Court to pay 15s. a week towards the support of his wife, William John Patterson, age sixty, height 5 ft. 8 in., labourer, native of England, medium build, dark com- plexion, blaok hair, clean- shaved except dark moustache turning grey, bald head, stoops slightly when walking. On the above date he was. in arrears £ 2, and costs £ 1 Is. AUCKLAND.— On or about the 13th January last, on warrant for theft from the paddock of David Morgan of two horses ( recovered), value £ 60, James Fitzgerald ( name supposed fictitious), age thirty- five, height 5 ft. 8 in., labourer, native of Australia, medium build, dark- brown hair, sallow complexion, clean- shaved, has a blood- red scar resembling the letter X on obeekbone above the right ear ; generally wears dark suit and hard black hat. The horses were taken by rail to Auckland, and Bold at the Buckland Saleyards by a man of the above name and description. AUCKLAND.— 6th ultimo, on warrant for deserting his wife, Louisa Augustus Rice, and leaving her without adequate means of support, William Henry Rice, age thirty one, height 5 ft. 5 in., plumber, native of New Zea- land, medium build, thin pale face, dark hair, bald head ( patch on top), greyish- brown eyes, red spot on each cheek under the eye, false set of upper teeth ; dresses in greenish- coloured suit, white- straw hat, and a cap when he is worK- ing. [ FeB. 2' 2 HUNTLY— 17th ultimo, on warrant for failing to provide for the maintenance of his child, John Lewis Hansen, age fifty- one, height 5 ft. 11 in., storekeeper and gum- dealer, native of Norway, strong build, dark - brown hair, dark brown moustache only, dark eyes and complexion, full round face; usually wears dark suit, hard black hat, and Chesterfield coat; invariably carries an umbrella. He is an undischarged bankrupt, and may be heard of in Auck- land. PETONE.— 14th January last, on warrant of commit- ment to Wellington Prison for fourteen days in default of paying £ 2 3s. fine and costs for procuring liquor while pro- hibited, Arthur Gilbert ( known as Butcher), age twenty- three, height 5 ft. 7Jin. labourer, native of Australia, dark complexion, brown hair, light blue eyes, long nose, scar on left instep ; generally wears dirty dark clothes and dark cap. PETONE.— 11th ultimo, on warrants of commitment to Wellington Prison for seven days in default of paying £ 1 3s. fine and costs for drunkenness and fourteen days in default of paying £ 1 3s. fine and costs for breaoh of prohibition order, Robert Cornick, age twenty- two, height 5 ft. 7 in., labourer, native of New South Wales, medium build, sallow complexion, brown hair, grey eyes, cross on left forearm ; generally wears dark suit and straw hat. WELLINGTON.— 21st ultimo, on warrant for disobeying an order of Court to pay £ 1 a week towards the maintenance of bis four children, Joseph Samuel Perkins, age forty, height 5 ft. 7 in., barman and cook, native of England, medium build, blue eyes, heavy dark eyebrows, long dark eyelashes, dark hair ( bald on top), rather thin face, false set of upper teeth, walks with slight limp, scar on one knee ; usually wears dark- blue suit. He was employed at the White Hart Hotel, New Plymouth, and left there on the 16th January last for Auckland. On the 23rd January last he was in arrears the sum of £ 60 12s. WELLINGTON. — Alexander McCrae, wanted on war- rant of commitment in default of paying £ 2 10s. fine and costs for being found on sly- grog premises: It has been ascer- tained by Constable Carney, Lyttelton police, that offender signed on as a member of the crew of the s. s. " Waitemata," for India, about 1st January, 1911. ( See Police Gazette, 1911, page 56.) WELLINGTON.— 21st ultimo, that he may be compelled to pay £ 6 12s. arrears due for the maintenance of his children, John McConkey, age forty two, height 5ft. 11 in., labourer, native of Ireland, medium build, fresh complexion, fair hair, blue eyes, clean- shaved, sandy moustache ; generally wears dark suit; fond of drink. BLENHEIM.— Edgar Charles Quartly, wanted on warrant for a breach of the Bankruptcy Act: The creditors will not take any aotion for the return of this offender to the Dominion. ( See Police Gazette, 1911, pages 24 and 66.) CHRISTCHURCH.— 10th ultimo, on warrant of commit- ment to Lyttelton Prison for six months in default of entering into a bond of £ 50 and finding a surety in same amount to provide for the future maintenance of his unborn illegitimate child, Charles Hawes, age twenty - eight, height about 5 ft. 8 in., painter, native of New Zealand, slight build, dark complexion, black hair and moustache, brown eyes; usually wears dark coat and trousers, light- coloured vest, and hard black hat. He was born at Rangiora, and his relatives reside there. CHRISTCHURCH.— 13th January last, on two warrants of commitment to Wellington Prison for one month on each in default of paying £ 4 14s. on each for trespassing on the Riccarton Raceoourse without being licensed as a bookmaker, D. Philp, age twenty- five, height about 5 ft. 9 in., book- maker, native of New Zealand, active build, sandy com- plexion and hair, olean shaved ; generally wears a blue or brown suit. ANNAT.— 14th ultimo, on warrant of commitment to Lyttelton Prison for fourteen days in default of paying fine and costs for us- ing dynamite in Stevens Creek, Cato Cooper, age about thirty- two, height about 5 ft. 9 in., labourer, stout build, full round face, fair hair and moustache, fresh complexion. The fine and costs amounted to £ 8 7s. 4d., he paid £ 6 13s., leaving a balance now due of £ 1 14s. 4d. ( See Police Gazette, 1909, page 352.) TIMARU.— 15th ultimo, on warrant of commitment to Timaru Prison for forty- eight hours in default of paying 13s. fine and oosts for drunkenness, Luke McCrann. age thirty- four, height 5 ft. 7 in., labourer, native of Ireland, medium build, dark complexion and hair, brown eyes, clean- shaved ; dressed in blue suit and black hard hat. TIMARU.— 10th ultimo, on warrant for theft from Prances Tate, fish- dealer, Richard Bennett, age thirty, height about 5 ft. 8 in., fish- liawker, native of New Zealand, dark- brown hair, clean- shaved, ruddy complexion, stout build, sharp pointed nose. Offender received from complain- ant fish to the value of £ 17 9s. 9d., on terms requiring him to account for the proceeds. He failed to do so. and is supposed to have gone to Sydney. TIMARU.— 4th ultimo, on warrant of commitment to Timaru Prison for forty- eight hours in default of paying 12s. costs of medical treatment for helpless drunkenness, Robert Russell, age thirty- five, height 5 ft. 4 in., labourer, native of New Zealand, medium build, fresh complexion, light- brown hair, hazel eyes ; dressed in blue coat and brown pants, slouch hat; very untidy appearance. DUNEDIN.— 17th ultimo, that he may be compelled to pay arrears due for the maintenance of his two illegitimate children, inmates of Caversham Industrial School, William Wilson Henry Cahill, age thirty eight, height 5 ft. 11 in., labourer, native of New Zealand, medium build, round- shouldered, sallow complexion, dark hair turniug grey ( inclined to curl), dark moustache only. On the 14th instant he was in arrears £ 173. ( See Police Gazette, 1905, pages 73 and 106.) INVERCARGILL.— 18th ultimo, on warrant for failing to provide for the maintenance of his illegitimate child, Charles Legerwood, age thirty- six, height about 6 ft., baker and cook, native of New Zealand, slight build, light- brown hair, clean- shaved except fair moustache, sharp features. AUCKLAND.— Alfred Ashenden, default of fine, has been arrested by Deteotives Hollis and Quartermain, Auck- land police, and lodged in Mount Eden Prison. ( See Police Gazette, 1904, page 279.) AUCKLAND. — J. Love, theft, has been arrested by Con- stable Carney, Lyttelton police, on information supplied by Detective Ward, Dunedin police, and fined 15s. or seven days. ( See Police Gazette, 1909, page 495.) NGARUAWAHIA.— M. F. Fischer, theft, has been arrested by Constable J. McNamara, Cambridge police, on informa- tion supplied by Acting- Detective Powell, and remanded. ( See Police Gazette, 1911, page 77.) Offender is identical with Martin Frederick Fischer. ( See Police Gazette, 1910, page 258.) MOUNT COOK.— William Johnson, default of fine, has been arrested by Constable O'Halloran, Woodville police, and amount paid. AUCKLAND.— 14th or 15th ultimo, from a motor - launch, the property of JOHN BROWN, a head- lamp, with round glass in front, two small rings broken off the top; a hurri- cane- lamp ; a dark- tweed coat, white stripe running through it; a pea- rifle, 22 calibre, with brass plate screwed on stock over a broken part; a pair of wire- cutting plyers with small gap out of each side ; and three tins of benzine : value, £ 4 10s. Identifiable, except benzine. TE AWAMUTU. — About 26th November last, from the dwelling of ALICE SPRAGGS, a ladies' small open- faced gold Geneva watch, No. 163911, in leather wristlet, " Made in Sweden " engraved on case ; value, £ 4 10s. MARSDEN, waitress, Marine Parade Hotel, a ladies' open faced keyless silver watch, gold hands ; a ladies' 18 ct. plain gold band ring, " F. M." engraved on outside, and " From Mother " engraved on inside : value, £ 2 10s. Identifiable. MAUNGATUROTO.— About 25th January last, from Matakohe, the property of RICHARD C. SMITH, farmer, a light- chest- nut heavy- draught mare, lighter colour on hind quarters, silver mane and tail, white face, about 16 hands high, eight years old ; value, £ 40. Identifiable. ONGARUE.— Between 30th December last and 13th ultimo, from Moore's Stables, the property of WILLIAM GRAHAM, labourer, an open- faced silver English lever watch, made by Reid, Coventry, " W. Graham" engraved on inside of case ; a silver curb chain ; a gold scarf- pin, horse- shoe pattern, set with pearls and cat's- eye stones in centre ; a diamond- shaped gold scarf- pin, set with a ruby; a red- silk handker- chief, with " L." in white in corner; a Chilian ooin; a George III halfpenny ; and 3s. in silver : total value £ 3 15s. Suspicion attached to John Morris, age twenty- four, height 5 ft. 7 in., groom and labourer, native of England, fair com- plexion and hair, clean- shaved, stout build ; dressed in dark suit and straw hat. He was employed as groom at the stables, and left suddenly. He was formerly employed by the Eltham County Council. TAUMARUNUI.— 14th ultimo, from a railway- carriage in the siding in the station- yard, the property of the Hon. THOMAS McKENZIE, three travelling- rugs. No. 1 rug has the McKenzie tartan on both sides, the colours as woven being green, black, white, red, a> id blue cheok, better known as the 42nd Black Watch plaid, the fabric is not very thick; No. 2 is a light colour, crowned with dark- brown and light- brown shades; No. 3 is a light grey with red stripes forming check, the reverse side is dark grey with fringe of grey: value, £ 6. PALMERSTON NORTH.— 11th January las', from Motu- rimu, the property of FRITZ KRUGER, mill hand, a five- year- old dark- bay saddle and harness mare, about 15 hands high, scar on near thigh, off hind foot white near the fet- lock, in good condition, very showy appearance, no bran is; value, £ 20. Suspicion attached to Edward George Hansen, age twenty- seven, height 5 ft. 5J in., labourer, native of New Zealand, medium build, sallow comploxion, brown hair, hazel eyes, clean- shaved exept brown moustache; generally wears a dark suit. PALMERSTON NORTH.— 11th January last, from the hut of EDWARD BRAGGE, sawmill hand, Moturimu, a gentle- men's 18 ct. gold ring, sot with a light- blue sapphire in claw setting; value, £ 5. SEDDON.— About tiie 15th January last, from the farm of THOMAS FRANCIS AND SONS, Awatere, one hundred and eighty half- bred ewes and lambs ( ewes only), branded with lamp- black on side, two shoes joined with a bar. earmarked with two foro bits and two back bits out of near ear, and round punch- hole out of off ear ; value, about £ 120. " Arahura," at Nelson, a silver • hunting- watch, maker Baume, No. 1643871, value £ 3; a silver albert curb- chain with silver match- box and green- stone pendant attached; value, 10s. MISSING. —.- L- a- a- o-:- — AUCKLAND.— Sinoe 1st July last, Frederick Sydney Graham, age fifty, height 5 ft. 7 in., civil and mining engineer, native of Australia, very military appearance, small deep- set eyes, brown moustache ( turned up at ends), brown hair turning grey ( bald on top, ourly at sides), one finger of left band crushed ; dresses neatly; wears gold chain with a French coin pendant. He speaks three languages, and generally associates with Army or Marine offioers. Photograph filed in the Inspector's Office, Auck- land. He was last heard of in Brussels on the above date. Inquiry by his wife, who is stewardess on the P. and O. boat " Matua." TAIHAPE.— Since about 1st January last, Annie Hamil- ton, age sixteen, height about 4 ft. 6 in., native of New Zealand, fresh oomplexion, fair hair worn down her back, stout build, large grey eyes. She may be accompanied by William Rees, age about thirty- five, height 5 ft. 6 in., carpenter's labourer, dark complexion, medium build, small moustache only. They are supposed to have gone south, and may be living together as man and wife. Inquiry by her father, John Hamilton, cordial- manufacturer, Taihape. LAW REPORT. [ EXTRACT from the Otago Daily Times of the 10th February, 1911, of a judgment given by His Honour Mr. Justice Williams in the case of Wittingham v. Lopdell.] In the Supreme Court in Banco at Dunedin, on the 9th February, 1911, a question of special interest to brewers was brought before His Honour Mr. Justice Williams for his decision. The case was one in which an appeal was stated against the conviction of Richard Wittingham, of Invercar- gill, brewer. Briefly, the facts are these : — Wittingham was charged at Balclutha, on the information of Constable Lopdell, that on the 13th August, at Waikiwi, he sold five gallons of beer to the order of P. Neilson, of Waimahaka, situated in the no- license district of Clutha, and, being aware that the liquor so ordered was to be sent to a no- license district, he failed to furnish to the Clerk of the Court at Balclutha a statement in writing of the name and address of the person ordering the liquor, and the person to whom it was sent. Mr. Bartholomew, S. M., held that the notice thould have been posted contemporaneously with the despatch of the beer, and convicted, fining Wittingham £ 1, and costs. Wittingham now appealed from that decision on the ground that the Magistrate was wrong in holding that the notice must be sent at the same time as the goods. In giving judgment, His Honour said ; The appellant sold and delivered the liquor on Saturday, the 13th. He did not on that day furnish the statement required by subseotion ( 6) of section 147 to the Clerk of the Magistrate's Court. On Monday the 15th, therefore, and up to Tuesday the 16th, no statement had been forwarded. If any person sells any liquor to or for delivery to a resident outside the district without furnishing a statement to the Clerk of the Magis- trate's Court he is guilty of an offence. It seems to me that on the Monday, taking the literal wording of the Act, the appellant had been guilty of an offence. He had sold and delivered the liquor on the Saturday, and he had not given the requisite notice. If it were the intention of the Legis- lature that the notice could be given after the sale and delivery the Aot would have said so. The whole object of this provision of the Act is that immediately upon liquor being sent into a no- license district there shall be a record in that distriot in order that the police may know where the liquor is. In construing the Act one has certainly to take into consideraticn the manifest intention of the Act. Taking, however, the literal wording of the Act, the appellant in the present case, on Monday the 15th, and Tuesday the 16th, bad been guilty of the omission which the Act makes an offence. He had sold and delivered the liquor, and had not, as the Act requires, forwarded a statement to the Clerk of the Magistrate's Court. In my opinion the Magistrate was right, and the notioe should be given simultaneously, or practically simultaneously, with the sale and delivery of the liquor, in order that when the liquor arrives in the district the police may have the infoimation which the Act contem- plates they should have for the purpose of preventing sly- grog selling. IN exercise of the powers vested in me by the Animals Protection Act, 1908 ( hereinafter called " the said Act"), I, John Poynder Dickson- Poynder, Baron Isling- ton, the Governor of the Dominion of New Zealand, do hereby make the following regulations prescribing the deer- shooting season in the Wanganui Acclimatization District, comprising the Counties of Wanganui and Waitotara, and the conditions affecting the same, and also the form of license and the fee payable therefor. REGULATIONS. 1. FALLOW- DEER bucks may be taken or killed within the Wanganui Acclimatization District from the 1st day of April, 1911, to the 15th day of May, 1911, both days in- clusive. 2. Licenses to take or kill such deer may be issued by the Chief Postmaster at Wanganui on payment of a license fee of £ 1, in the form prescribed in the Schedule hereto, and subject to the said Act and these regulations. The number of such licenses shall not exceed thirty : Provided that not more than one such license shall be issued to the same person. 3. No licensee shall take or kill more than two bucks, and no buck shall be killed carrying antlers with less than four points. 4. No doe or fawn shall be taken or killed on any pretext whatever; and no licensee shall allow any dog to accom- pany either himself or any attendant he may have with him. 5. The licensee must give notice to the said Chief Post- master of the date on which it is his intention to stalk deer; such notice to be posted, or delivered, or telegraphed three clear days before such date. 6. Nothing herein containe'd shall extend to authorizing any person to sell any deer or portion thereof. 7. Any person committing a breach of any of these regu- lations shall be liable, on conviction, to a fine not exceed- ing £ 20. SCHEDULE.
