NOTICE.— For instructions as to the manner in which reports are required to be furnished for the compila- tion of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, should be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. AUCKLAND.— 16th ultimo, on warrant for deserting from the s. s. " Otaki," John Kingsley Wall, age forty- one, height 5ft. Tin., seaman, native of England, blue eyes, hair turning grey, snake and eagle tattooed on chest, butterfly on hip ; dressed in dark suit. AUCKLAND.— 18th uldmo, that a summons may he served on him for a breach of his prohibition order, Thomas Bowden, age twenty- four, height 5 ft. 9 in., labourer, native of Australia, medium build, fresh complexion, brown hair and moustache, nose bent. He may be found working in a stable. AUCKLAND.— Between the 3rd and 17th December last, on warrant for theft of 329 Truth newspapers, value £ 2 14s. 10d., the property of John Norton, George H. Bell, age about thirty- eight, height about 5 ft. 8 in., labourer, native of England, slight build, dark- brown hair, fresh com- plexion, fair moustache only ; dressed in dark sac suit and black hard hat; walks with a limp. Offender received the newspapers from the manager at Auckland, Gordon Hutchi- son, to sell, but failed to acoount for the proceeds. AUCKLAND.— 31st December last, that he may be served with a summons for cruelty to animals, Stephen Orsen. age twenty- two, height 5 ft. 9 in., carter, fair complexion, slight build, fair hair, grey- eyes, clean- shaved, boyish slovenly appearance. He may be found working around stables. ONEHUNGA. — 25th ultimo, on warrant for failing to provide for the maintenance of his illegitimate child, Harold Ardern, age twenty- five, height 5 ft. 9 in. or 10 in., labourer, native of New Zealand, slim build, dark complexion, thick hair ( curly in front), thin nose, hazel eyes, clean- shaved, suffers from hernia and wears a truss ; generally wears a dark suit and hard black hat. His married sister, Mrs. Lloyd, resides at Freeman's Bay. Complainant, Muriel Myrtle Reece. ONEHUNGA.— 17th ultimo, on warrant for theft of a black and tan collie dog, white blaze on face and white round the neck, answers to the name of Bob, value £ 10, Arthur Vetcher, age about thirty- five, height about 5 ft. 7 in., suppose! native of New Zealand, medium build, dark complexion and hair, clean- shaved except dark mous- tache ; dressed in dark coat and vest, dungaree trousers, and dark cap. He was formerly a steward on the s. s. " Rotoiti." HUNTLY.— 19th December last, on warrant for failing to provide for the future maintenance of his unborn illegiti- mate child, Frederick Crookson, age twenty- seven, height 5 ft. 6 in. or 7 in., bricklayer's assistant and trucker, native of England, slight build, fair hair and complexion, longish features, clean- shaved ; usually wea's dark suit and straw hat. GISBORNE.— 16th or 17th ultimo, on warrant for theft of a bay pony gelding, five years ol I, 14 hands high, small white snip on nose, black points, mane and tail cropped short, branded " C " on near shoulder ( rather indistinct), value £ 8, identifiable, Albert Pyle, alias Taylor, age twenty- eight, height 5 ft. 4Jin., groom, native of Australia, fresh com- plexion, reddish hair, clean- shaved; dressed in dark- grey striped sac suit and grey cap. He is also charged on warrant with obtaining from Herbert Lucas, clerk, Coronation Hotel, £ 1 10s. by means of a valuless cheque on the Bank of New South Wales, Gisborne. HAWERA.— 26th ultimo, on warrant for failing to provide for the future maintenance of his uuboru illegitimate child, Frank Blake, age twenty- two, height 5 ft. 10 in., labourer, native of New Zealand, strong build, fair complexion and hair, clean- shaved, peculiar gait; dressed in dark- coloured tweed suit and cap. [ FEB. 2' 2 WAVERLEY.— 1st ultimo, for failing to comply with the conditions of his release under the First Offenders' Pro- bation Act, Thomas Duggan, age twenty- five, height 5 ft. 8 in., labourer, native of Australia, strong square build, fresh complexion, dark- brown hair, blue eyes, square chin, clean- shaved, " T. D." tattooed on left forearm, butterfly on biceps, " True Love " and clasped hands on right biceps ; dressed in dark suit and cap. He was sentenced on a charge of theft at the Stipendiary Magistrate's Court, Waverley, on 21st November last, and has failed to comply with the con- ditions of his release. TAIHAPE.— 24th December last, that summonses may be served on him for drunkenness and using obscene language, Richard Healy, age twenty- two, height 5 ft. 5 in., labourer, native of New Zealand, dark complexion and hair, grey eyes, medium build, rather large nose; generally wears a dark- tweed suit and black soft- felt hat. His parents are boardinghouse- keepers at Taihape. WELLINGTON.— 26th ultimo, on warrants for wilfully damaging stores on the s. s. " Athenic," Alfred Edwin Hall and Thomas Wilson. First : Age nineteen, height 6 ft., steward, native of England, thin build, fresh complexion, fair hair, blue eyes, small fair moustache, shuffling awkward gait, slightly stooped. Second : Age twenty- three, height 5 ft. 8J in., steward, native of Eng- land, medium build, fresh complexion, thiok bushy brown hair, blue eyes, brown moustache. BLENHEIM.— Between 31st December and 7th ultimo, on warrant for theft of £ 1 10s. 6d., the moneys of Edward Stone Parker, trading as the " McKenzie Carrying Com- pany," John William Burke, age twenty- eight, height about 5 ft. 8 in. or 9 in., labourer and carrier, native of New Zealand, medium build, dark complexion and hair, dark eyes, generally clean- shaved ; dressed in dark- tweed suit and black hard hat. He may be found working in a stable or driving an express. The offender was employed by the above firm, and between the dates mentioned appro- priated the money, which he had collected from customers. CHRISTCHURCH.— 14th ultimo, on warrant for theft of a black peggy- bag and purse, value 7s. 6d., Henry Cox, age twenty- two, height 5 ft. 5 § in., labourer, native of New Zealand, medium build, fresh complexion, brown hair, blue eyes; dressed in brown suit and tan boots. He is charged conjointly with John Lee, alias Nettleford, who is in custody for snatching complainant's bag. OHRISTCHURCH.— 18th ultimo, on warrant for failing to provide his wife and child with adequate means of support, Jack Rains, age twenty- eight, height 6 ft. 2 in., butcher and labourer, native of England, slim build, sallow dark complexion, light- brown hair ( two curls in front), blue eyes, reddish moustache ( fairly long), pimple on side of face resembling a wart, carries himself well, deep cut on left thumb ; usually wears a faded brown- check suit. CHRISTCHURCH.— 18th ultimo, that'he may be compelled to comply with an order of Court to pay 5s. a week each for the support of his two brothers in the Christchurch Receiving Home, Robert Bethke, age twenty- nine, height about 5 ft. 6 in., seaman, native of New Zealand, medium build, dark complexion, black hair, hazel eyes ; usually wears dark suit and cap. CHRISTCHURCH.— 20th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegiti- mate child, Harry Staunton, age about twenty- eight, height about 5 ft. 8 in., commercial traveller, slim build, pale complexion, brown hair, grey eyes, clean- shaved, notice- able square jaw, rather pigeon- toed ; dressed in dark tweed sac suit and light felt or hard hat. He is supposed to have gone to Dunedin, where his mother resides. Complainant, Elsie Miriam Stevenson. CHRISTCHURCH.— 23rd ultimo, that notices of fines may be served on him for failing to send his children to school, Charles Tate, age forty, height 5ft. 9 in., asphalter, medium build, clean shaved except moustache ; generally wears a cark grey suit and soft grey hat; foud of drink. RAKAIA.— 24th ultimo, that a summons may be served on him for travelling by rail between Christchurch and Rakaia without paying the proper fare, Thomas Hill ( name sup- posed fictitious), age about thirty- five, height about 5 ft. 7 in., labourer, supposed native of Australia, dark complexion and hair, clean- shaved, medium build ; dressed in dark suit and tan boots. He is supposed to have gone harvesting. OAMARU.— 19th December last, on warrant for theft from the Golf Club of a pair of ladies' golf- shoes, a spoon and fork, and three golf- balls, value £ 1 5s. ( recovered), the property of James Cunningham and others, Alexander Walquist, age thirty- four, height 5 ft. 9 in., labourer, native of New Zealand, fair complexion and hair, blue eyes, clean- shaved except small moustache ; dressed in grey- tweed suit and grey tweed slouch hat. ( See Police Gazette, 1909, page 375.) Offender was arrested on the 22nd ultimo for the offence, and when being escorted to Oamaru escaped with the handcuffs on. DUNEDIN.— 23rd ultimo, on warrant for being absent without leave from the s. s. " Rimutaka," Samuel Dun- stan, age twenty- two, height 5 ft. 6£ in., baker, native of England, blue eyes, dark- brown hair, clean- shaved, tattoo- spot on right forearm, round face, rather small chin ; dressed in blue- serge suit and blue cap. A reward of £ 4 is offered for his apprehension. DUNEDIN.— 20th ultimo, on warrant for being absent without leave from the s. s. " Rimutaka," Peter Schmidt, age thirty- seven, height 5ft. 8in., fireman, native of Den- mark, strong build, dark complexion, brown hair, grey eyes, small scar near right ear, clean- shaved except moustache; dressed in dark suit and blue jersey. A reward of £ 2 will be paid for his apprehension. INVERCARGILL.— 20th ultimo, on warrant for failing to provide for the maintenance of his unborn illegitimate ohild, Edward Raines, age about thirty, height about 5 ft. 7in., butcher's assistant, native of New Zealand, medium build, fresh complexion, dark- brown hair, clean- shaved, short upper lip, front upper teeth decayed ( some of them missing): supposed to be wearing a dark- brown suit and cap. AUCKLAND.— 29th October last, from JOHN RIGG, while under the influence of liquor, a gentlemen's double gold albert curb- pattern chain, silver medal attached with " Buff Orpington, Ulveston, Barrow- in- Furness, England," in- scribed thereon, a George III guinea suspended from the centre of chain ; value, £ 9. Identifiable. AUCKLAND.— Between 18th and 20th ultimo, from the cabin of HELEN CURTIN on the s. s. " Mokoia," between Gisborne and Auckland, a red- morocco jewel- box with silver handle, containing a ladies' gold albert chain, with sliding barrel thereon, gold tassel on end, square belcher pattern ( illustration No. 33), has a gold- mounted greenstone pendant and gold- mounted reddish variegated stone pendant attached; a gold dress ring, set with a diamond and two sapphires ; a gold dress ring, set with a sapphire and two rubies; a gold dress ring, set with an amethyst in centre ( two stones miss- ing) ; a gold dress ring, set with amethyst in centre, oue ruby at side ( oue stone missing) : total value, £ 25. Sus picion attached to a Man ( name unknown) who was drink- ing with complainant, age about thirty- five, height about 5 ft. 4 in., supposed seaman, stiff build, fair complexion, blue eyes; dressed in dark- blue suit and greenish- coloured cap, gold chain across his vest, and represents that he has been in the navy and is a pugilist; fond of drink, and frequents hotels. TOLAGA BAY.— 4th or 5th ultimo, from a paddock, the property of JAMES CALNAN, a dark- bay gelding, about eight years old, 15 hands high, no shoes, long tail and mane, large white star on forehead running towards one eye, thick- set build, branded " 6" on off shoulder, also a brand on near shoulder ( supposed " R") ; value, £ 12. RICHMOND.— 17th ultimo, from Salisbury Road, the pro- perty of GEORGE WELLS, farmer, a gentlemen's open- faced keyleBS silver watch, Roman figures, " Brown and Kerr, Nelson," on dial, No. 1928368, an open brass curb chain attached ; value, £ 2 10s. OAMABU.— 30th or 31st December last the TOKARAHI POST- OFFICE was broken into and a oash- box stolen con- taining about £ 3 worth of silver and coppers, and a stamp- book containing about twelve shillings' worth of stamps from half- penny to sixpenny. WELLINGTON.— Since 1908, John Smart Matthew, age forty- four, height 5 ft. 7 in. or 8 in., book- keeper, native of Aberdeen, Scotland, stout build, pale complexion, black hair, dark eyes, thick mouBtache out short and turned up at ends, wears gold riog set with a bloodstone. He landed in Wel- lington from the s. s. " Athenic " in November, 1907, accom- panied by a young woman. Photograph of Matthew filed in the Inspector's Office, Wellington. Inquiry by his wife, Janet Matthew, Edinburgh, that he may be induced to support her and their children. INQUIRIES, ETC., FROM OUTSIDE NEW ZEALAND. MM— —• NEW SOUTH WALES.— Inquiry requested for Joseph Price, age twenty- five, height 5 ft. 10 in., stout build, about 14 St. weight, fair curly hair, fair complexion, grey eyes, clean- shaved; generally wears blue- serge suit and soft black hat with broad rim, woman tattooed on right forearm, " I love Mary S.," nick- name Pooter. He was working at the Millerton Mine, Westport, and left there in August last, supposed for the North Island. Inquiry by his wife, who is destitute. ( 10/ 2121.) BBISBANE.— A warrant'has been issued at Brisbane for the arrest of Hugh Guthrie Marshall for the attempted murder by poisoning of Mrs. E. Watts on 12th January last. Description: Age twenty- two, height 5ft. 7in., sallow com- plexion, brown hair, clean- shaved, sunken eyes, sickly appear- ance ; usually wears dark- serge fancy vest, boater or black hard hat, has served apprenticeship as a chemist, lately following agency business. He left Brisbane on the 14th January, intending to get a boat from Sydney or Melbourne to New Zealand, and may be accompanied by his friend Bertram Graham Savage. Marshall had an uncle, a retired farmer of same name, in the Auckland Hospital about six weeks ago. Arrest desired. ( 11/ 158.) ENGLAND.— Inquiry requested for John Ritchie, for- merly of Glasgow, butcher, age about fifty- eight. He was last heard of in New Zealand about three years ago, and was supposed to have been in the Napier district, but no trace of him can be obtained there. Inquiry by A. Ritchie, London. ( 10/ 2642.) SCOTLAND.— Inquiry requested for Andrew R. McKel- vie, who was reported drowned about twenty years ago off the American coast, but is now believed to be in New Zea- land farming or mining. He is described as about 5 ft. 7£ in. high, sallow bronzed complexion, high cheek- bones, brown eyes, strong well- knit build, scar on forehead caused when a child, hard reddish- brown or auburn hair, heavy red or brown moustache, heavy square chin with dimple in centre. He was at one time assistant to the water engineer in Dundee, Scotland. Inquiry by his brother, J. G. McKelvie. ( 11/ 141.) MISCELLANEOUS INFORMATION. Resignation. [ COURT OF CRIMINAL APPEAL ( LORD ALVERSTONE, C. J., PICKFORD AND COLERIDGE, JJ.)— 17TH OCTOBER, 1910.] REX V. MORTIMER. Gaming — Betting — Using House for Purpose of receiving Bets on Horse - races — Evidence of User — Betting Act, 1853 ( 16 and 17 Vict., c. 119), ss. 1, 3. The appellant was a bookmaker, and a letter was sent to his premises stating that the writer wished to open a de- posit account with the appellant, and on hearing from him would forward £ 5 ; the writer added that none of his com- missions would exceed that amount without a further remittance. The appellant replied, enclosing a book of rules, and saying that " on receipt of yours, as suggested, I will place you on my list of clients." The money was thereafter sent to the appellant in the form of postal orders. Bets were made by the appellant on behalf of the writer of the letter, and a day or two later the appellant's premises were raided, when books of account, showing betting transactions and about a hundred betting slips, were found. The appellant was convicted upon an indict- ment under the Betting Aot, 1853, for using the premises for the purpose of moneys being received by him as and for the consideration for certain assurances, undertakings, promises, and agreements to pay thereafter certain moneys upon certain events and contingencies of and relating to horse- races. Held, That there was evidence upon which the jury could conviot the appellant. Semble, The receipt of a document which can be turned into money is the receipt of money within section 1 of the Betting Act, 1853. 49 NEW ZEALAND POLICE GAZETTE. . [ FEB. 2' 2 THIS was an appeal against a conviotion upon an indictment under the Betting Act, 1853, at the Southampton Quarter Sessions, charging the appellant with using a certain house for the purpose of certain moneys being received by him as and for the consideration for certain assurances, under- takings, promises, and agreements to pay thereafter oertain moneys upon certain events and contingencies of and relating to horse- races. The appellant was fined £ 25, with £ 20 oosts. Mr. G. W. Ricketts appeared for the appellant; and Mr. Charles for the Crown. Mr. RICKETTS said that in May of this year the police of Southampton were desirous of entrapping the appellant, a bookmaker, into making an illegal bet, and to that end a letter was written from Portsmouth in the name of one Ellison, a bogus name as far as this case was concerned, say- ing that the writer was not desirous of communicating with a local bookmaker, but wished to open a deposit account with the appellant, and on hearing from him would forward a £ 5 noter and that none of his commissions would exceed that amount without a further remittance. This was writ- ten early in May. The death of the King just afterwards put an end to all racing for a time. On May 24 the appellant replied enclosing a book of rules, and saying that " on receipt of yours, as suggested, I will place you on my list of olients." The money was then sent in the form of postal ordere. Bets were made on May 26 and 27. On June 1 a raid was made on the appellant's premises, when books of account showing betting transactions and about a hundred and sixty betting slips were found. By section 1 of the Betting Act, 1853 ( 16 and 17 Vict., c. 119) it was enacted " No house, office, room, or other place shall be opened, kept, or used for the purpose of . . . any money or valuable thing being received by or on behalf of such owner, occupier, keeper, or person as aforesaid as or for the consideration for any assurance, undertaking, promise, or agreement, express or implied, to pay or give thereafter any money or valuable thing on any event or contingency of or relating to any horse- race." By section 3, " Any person who, being the owner or occupier of any house, office, room, or other place, or a person using the same shall open, keep, or use the same for the purposes hereinbefore mentioned, or either of them . . . shall" be liable to certain penalties. Mr. Ricketts, continuing, submitted that there was no evidence that these premises were used in contravention of the statute, for there was only evidence of one transaction. The presence of the betting slips did not show that illegal bets had been made, for they might have been made as records of past transactions, or refer to credit bets. They did not show that money was received beforehand in those cases. The words " I will place you on my list of olients" did not show that these clients were persons with whom the appel lant made illegal bets. He referred to Reg. v. Davies ( 13 The Times L. R., 405; [ 1897] 2 Q. B. 199). The jury was not directed to the consideration of the " purpose" for which the house was used. They returned the verdict " Guilty, but we think he was very reluctantly led into it in this case." That showed that they were thinking of this one case only. The money was reoeived on no consideration whatever; at the time the orders were received there was no contract at all in existence, and the writer of the letter could have de- manded the £ 5 back— The Universal Stock Exohange v. Strachan ([ 1896] A. C., 166). Therefore there was no con- sideration on either side. The money was deposited as security against a debt which might arise from a gambling transaction. The appellant was not guilty at the time he received the orders, which was the only time when guilt oould attach, if at all. These orders were not money, and the indiotment only charged the reception of money, not of anv " valuable thing." Lennox v. Stoddart ( 18 The Times L. R., 585 ; [ 1902] 2 K. B., 21) was also referred to. Mr. CHARLES said that, with regard to the contention that the money was received on no consideration, the letter from Ellison said that he wished to open a deposit- account, and that the commissions would not exceed the amount deposited without a further remittance, and the appellant made bets in consequence. If that did not come within the statute it was difficult to see how any ready- money betting transaction did. With regard to this being a solitary trans- action, the jury was entitled to oonsider the paraphernalia found on the appellant's premises when raided. The LORD CHIEF JUSTICE, in giving the judgment of the Court, said that ho recognized that betting was illegal only in certain cases. In this case the appellant was indicted for unlawfully using a certain hoU6e for the purpose of oertain moneys being received by him as and for the consideration for certain assurances, undertakings, promises, and agree- ments to pay thereafter certain moneys upon oertain events and contingencies of and relating to horse- races. It oould not be said that the attention of the jury was not properly directed to the question whether or not the appellant used the rooms for the above purpose. It appeared that this transaction was the result of a trap set by the police, and, although he ( the learned Judge) did not, any more than did anybody else, like police traps, at the same time there were some offenoes which could not be discovered otherwise, and the offence was none the less an offence because committed as the result of a trap. The Court had no doubt that this particular transaction infringed the provisions of the statute. The £ 5 was sent on the terms that a deposit account was to be opened, and that commissions were not to exceed that amount without further remittances. The meaning of that was, " I do not ask you to give me credit, but to make bets with me up to the amount sent," and the reply was that on receipt of the £ 5 Ellison would be placed on the appellant's list of clients, a book of rules being enclosed. It was unfor- tunate, if the book showed anything in the appellant's favour, that no copy of it had been produced. It seemed to him that the transaction contemplated the naming of horses by Ellison and an undertaking by the appellant to make bets with him up to £ 5. The latter was not wise enough to see that he was on dangerous ground, but kept the money and made bets, and appropriated portions of the £ 5 for that purpose. It seemed to him that the transaction was within the statute. Then it was said that the house was not being used, & c., because only this one instance was proved. It by no means followed that the jury might not convict. It was shown that the appellant was carrying on a betting business, and a number of slips were found relating to bets made on the same day, and he should have thought it a stroDg sug- gestion to say that all these other transactions were on credit as far as the backer was oonoerned. He did not think on the facts proved that they ought to hold that there was no evidence on which the jury oould convict. With regard to the contention that the postal orders were not money, he did not intend to express any final opinion, but his im- pression was that there was authority for saying that the receipt of a document which could be turned into money might be the receipt of money. But they were all of opinion that, even if they felt bound to decide this point in the appel- lant's favour, they would give effect to the proviso to sec- tion 4, subsection 1, of the Criminal Appeal Act, 1907, under which they could in such a case dismiss the appeal if they considered that no substantial miaoarriage of justice had actually occurred.
