Field Art. 17 Sept.' 07 81 . 4 T1IE POLICE GAZETTE TUESDAY, SEPTEMBER 24, 1907 EXTRAOT FROM KINO'S REGULATIONS AND ADMIRALTY INSTRUCTIONS FOR APPREHENSION OF DESERTERS- REWARDS, 4ko. 792. The penalties for inducing men to desert or to improperly absent themselves, or for employing or concealing Deserters or Absentees, are set forth in the Naval Discipline Act. See 723 ( Aiding Deser- tion). ***** 793. Every possible effort is to be made to cheek desertion and absence without leave, and by lawful means to detect and apprehend deserters or absen- tees. Descriptions on Form S243 are to be dis- tributed as may be directed by tho Commanders- in- Chief, but at home one copy is invariably to be sent by the Captain to the Chief Constable of the de- serter's or absentee' 6 usual place of residenoe, when it be known, and also to any other place or places v, here he may be likely to have gone. 2. The procedure to be followed in respect of tho arrest and subsequent disposal of deserters and ab- sentees is governed by the provisions of Section 9 of the Act 10 and 11 Vict. cap. 62; and by Section 50 of the Naval Discipline Act. 3. Under the first of those Statutes, any poison arrested on suspicion of being a deserter or absentee from His Majesty's Navy, shall be taken and charged before a Magistrate, and by him, either— ( a). Conveyed to prison pending enquiry of tho naval authorities as to his identity, and afterwards, should such identity bo proved, handed over to Naval custody; or— ( b.) Committed direct to Naval custody on board any one of His Majesty's ships. In either of the above cases, after the de- serter or absentee has been delivered into Naval custody, he may be dealt with under the Naval Discipline Act. 4. If arrested on Naval Warrant under Section 50 of the Naval Discipline Act, the deserter or ab- sentee may be received direct into Naval custody, and dealt with undfer the Naval Discipline Act, but no deserter or absentee who has not been arrested under such warrant shall be received from the Police or from any other person, unless such deserter or ab- sentee has first been charged before a Magistrate. 5. A deserter or absentee who voluntarily sur- renders himself to Naval authority may be dealt with under the Naval Discipline Act, though no warrant for his arrest may have been issued, and without charging him before a Magistrate. 6. Under the provisions of Section 10 of tho Adt 10 and 11 Vict. cap. 62, any person who voluntarily confesses to being a deserter, or an absentee without leave, from His Majesty's Navy, unless ho surrender himself into Naval custody, may either— ( a). Be taken before a Magistrate, and by him delivered into Naval custody; or— ( b.) Be arrested on a warrant under Section 50 of the Naval Discipline Act, and delivered direct into Naval custody. In either case, however, the question whether ho be or be not a deserter or absentee, must be duly in- vestigated by Naval authority, and for that purpose he may be detained for a reasonable time, when, if his confession of desertion or absence without leave shall be found not to be true, then he cannot be punished at all under the Naval Discipline Act, but he may either— ( c.) Be detained and reoeived in His Majesty's Navy; or— ( id.) If not received into His Majesty's Navy, and on conviction of false confession of deser- tion before two Justices of tho Peace, ho may be adjudged to be punished if in Eng- land, as a rogue and1 a vagabond, and if in Scotland or Ireland by commitment to prison, there to be kept to hard labour for any time not exceeding three mouths. 7. When any deserter, or absenteo without leave, whether delivered into Naval custody by order of a Magistrate, or by a warrant issued under Section 50 of the Naval Discipline Act, or by voluntary sur- render, shall be brought before the Captain of any one of His Majesty's ships to be dealt with summarily, his case is to be thoroughly investigated with a view to establish his identity, and a note taken in writing of uie proceedings; the prisoner is at tho same time to ba formally asked if he has any statement to make, and such statement, if made, is to bo signed by the prisoner and duly witnessed; and the accuracy of any such statement is to be carefully tested before the case is finally disposed of. ***** 795. Except in the oases specified in Art. 797, tho Captain may authorise tho payment of a reward not exceeding £ 3 to any Constable or other person by whom a deserter may be brought on board or de- livered up to any duly authorised person within two years of tho date of his desertion. Tho amount of tho award should bo determined by tho attendant circumstances, and ill considering these, tho zeal shown, and tho trouble taken by tho Constable or other person by whom tbo arrest of tho deserter has been effected, should bo duly weighed. Tho above Regulations lor the payment of rewards will not bo held to apply in tho case ol a deserter voluntarily surrendering himself at any Polico Station, or to any Constable or other recognised authority unless it can be clearly shown that such dwjorter had been induced so to surrender himself by tho vigilance and exertions of any such Constable or other person, hut exceptional cases of this descrip- tion are not to bo doalt with without reference to tJio Admiralty at homo or Commanders- in- Chief, or Ofiicors in command of Stations abroad, so that a lull enquiry into tho circumstances can bo uiado if accessary. 2. In eases wliero persons have been mole than two years in a state ol desertion, no reward is to bo paid without previous reference as above; it has been notified to tho Constabulary generally that when de- serters are apprehended in the United Kingdom after such * period of absence, thoy are not to bo removed from their places of confinement until tho Admiralty has boon communicated with. 3. A reward, not exceeding £ 3, may also bo paid for tho apprehension of any person who without being guilty of desertion, in tho opinion of tho Cap- tain of tho ship to which ho belongs, cither gives reasonable ground for considering that he intends to desert, or commit ® any one of the following offences, the particulars of which aro to bo stated i n tho notice to the Police :— ( a.) Breaks out of his ship. ( b.) When on service away from his ship, quits his place of duty and continues to be absent after the time at which he should have re- turned to the ship. ( c.) When his 6hip is under sailing orders, con- tinues to bo absent without leave, after the ship has sailed; provided that tho fact of the ship being under sailing orders was generally known. A reward not exceeding £ 1 may lie paid for tho apprehension of any man who overstays his leave unless thero is reasonable ground lor considering that the man. intends to desert, in which case £ 3 may be paid. In giving these rewards, the same considerations that govern the payment of rewards for the ap- prehension of deserters aro to bo taken into account, both as to arrest and voluntary surrender. 4. No reward is to be paid for the apprehension of any Commissioned, Warrant, or Subordinate Officer, without the sanction of the Admiralty at homo, or of the Commander- in- Chief or Senior Officer present, abroad. 796. In addition to tho foregoing rewards, the Constable or other person bringing deserters or ab- sentees on board may be paid such expenses attend- ing their lodgment, subsistence and travelling, as may appear to havo been fairly incurred and to bo in accordance with the following regulations, viz. ( a.) Railway Fare ( return) of Escort (>.) Railway Fare ( single) of deserter or absentee- - - - As an ordinary rule not to exceed I d. per mile. ( c.) Other sums expended in the actual conveyance of the deserter or absentee, such us for tho hire of cabs, boats, & c. ( d.) Subsistence of deserter or absentee. Not exceeding Is. ti day while under detention, or 2s. 6d. a day when travelling. ( c.) Subsistence of Escort . . At the same rate as that allowed for Petty Officers under Art. 1495, according to the time necessarily occupied in conveying tho deserter or absentee to his desti- nation and returning. (/.) Except in special cases tho only other charges which should bo sanctioned are the statutory fees of 2s. to tho Magistrate's Clerk, and 2s. 6d. to any Medieal Practitioner by whom the deserter or absenteo may have been examined. ***** 2. If no reward should be payable, the Constable, or other person bringing deserters or absentees on board, should bo dirocted, in addition to the above items, to prefer a claim lor such other expenses as ho may consider himself fairly entitled to, but every case of thin description is to be forwarded to the Admiralty for examination and decision. 3. If tho Constable, or other person, bringing a deserter or absentee on board, should object to the Captain's award, tho case is to bo submitted to tho Commander- in- Chief, who if unable to settle the question will forward it for the decision of the Admiralty. ***** The Governor of the gaol will furnish a statement of the number of days' subsistence provided, for which the sum of one shilling per diem is to be added to tbo other charges against tho man's pay if con- victed of desertion or absowe without leave. This particular charge of Is. per diem is to bo shown, with other mulcts, oil tho ship's ledger. ***** 5. With H view of simplifying tho payment of such claims, Magistrates and Governors of gaols when requested to send deserters or absentees back to their ships, shooild be informed that it is desirable that tho men should bo sent in the custody of the Constables who actually apprehended them. 0. Tho foregoing modo of payment does not apply to cases of deserters or absentees apprehended by tho London Metropolitan Polioe. In such rases the following course is to be observed':— No payment is to be made by the Accountant Officer in respect of the expenses incurred by tho Constable, or of any reward which may be due to him. The Constable will produce a form, prepared for the purpose, in which he will include the whole of his expenses, and certify that they were necessarily incurred by him. He will then hand tho form to- the Acountant Officer of the ship, who will, with the approval of tho Captain, charge tho deserter or absentee with the sum shown thereon, together with any reward, if due, and note in the space provided on the form, tho fact of the charge having been made. The form is then to bo returned bo the Constable. The payment of tho expenses incurred, and of the reward, when due, will bo arranged between the Ad- miralty and the Commissioners of Police. 797. No reward under the authority given to the Captain by Article 795 is in any case to bo paid for the apprehension of deserters or absentees within tho precincts of a place where a Police Force in em- ployed in any Naval establishment, but in order to encourage the local police at any such port'or place to search for and apprehend deserters and absentees, the Commander- in- Chief or Senior Officer present, at his discretion, and under 6uch regulations as ho may from time to time lay down, may approve a reward not exceeding £ 1 being paid for eaeb deserter or ab- senteo arrested by a Constable of the lo< al Police within a reasonable period. The reward paid is to be charged on the ship's ledger against, the wages of the deserter or absentee. ***** NOTE.— If any doubt exists as to the address of any ship, the Admiralty should be asked by telegraph for information. Payments are made by the Accountant Officer of the ship. When any Naval authority has ouce been com- municated with as to the disposal of a. deserter or absentee, separate arrangements should not bo made with a second Naval authority without notifying th6 former of the 6teps that are being taken.
