In the case of Marines not embarked who have deserted from the head quarters of their Divisions, the Army Descriptive Return, as specified in the 4th Schedule of the Army Act. 1881, should be used. Every possible effort is to be made to oheck deser- tion and straggling-, and, by lawful means, to detect and apprehend deserters or absentees without leave. Descriptions in the established form are to be distributed as may be directed by the Commanders- in- chief, but at home one copy is invariably to be sent by the Captain to the Chief Constable of the deserter's or absentee's usual place of residence, if it is known, and also to any other place or places where he is likely to have gone. 2. The procedure to be followed in respect of the arrest and subsequent disposal of deserters and absentees is governed by the provisions of Section 9 of the Act 10 and 11 Vict., cap. 62 ; and by Section 50 of the Naval Discipline Act. 8. Under the first of these Statutes, any person arrested on suspicion of being a deserter or absentee from Her Majesty's Navy shall be taken and charged before a Magistrate, and by him, either— ( a.) Committed to prison pending inquiry as to his identity, and afterwards, should such identity be proved, handed over to Naval custody, or— (>.) Committed direct to Naval custody on board any one of Her Majesty's ships. In either of the above cases, after the deserter or absentee has been delivered into Naval custody, he may be dealt with under the Naval Discipline Act. 4. If arrested on Naval Warrant under Section 50 of the Naval Discipline Act, the deserter or absentee may be received direct into Naval custody and dealt with under the Naval Discipline Act; but no deserter or absentee who has not been arrested under such warrant shall be received from the Police, or from any other person, unless such deserter or absentee has first been charged before a Magistrate. 5. A deserter or absentee who voluntarily surrenders himself to Naval authority may be dealt with under the Naval Discipline Act, though no warrant for his arrest may have Been issued, and without charging him before a Magistrate. 6. Under the provisions of Section 10 of the Act 10 and 11 Vict., cap. 62, any person who voluntarily confesses to being a deserter, or an absentee without leave, from Her Majesty's Navy, may, unless he surrenders himself into Naval custody, either— ( a.) Be taken before a Magistrate, and by him be delivered into Naval custody, or— ( J.) Be arrested on a warrant under Section 50 of the Naval Discipline Act, and delivered direct into Naval custody. In either case, however, the question whether he is or is not a deserter or absentee must be duly investigated by Naval authority, and for that purpose he may be detained for a reasonable time, when, if his confession of desertion or absence without leave shall be found not to be true, then he cannot be punished at all under the Naval Discipline Act, bnt he may either— ( a.) Be received and detained in Her Majesty's Navy, or— ( 6.) If not received into Her Majesty's Navy, he may, on conviction thereof before two Justices of the Peace, be adjudged to be punished, if in England, as a rogue and vagabond, and if in Scotland or Ireland, by commitment to prison, there to be kept to hard labour for any time not exceeding three months. 7. When any deserter, or absentee without leave, whether delivered into Naval custody by order of a Magistrate, or by a Warrant issued under Section 50 of the Naval Discipline Act, or by voluntary surrender, shall be brought before the Com- manding Officer of any one of Her Majesty's Ships to be dealt with summarily, his case is to be thoroughly investigated, and a note taken in writing of the proceedings ; the prisoner is at the same time to be formally asked if he has any statement to make and such statement, if made, is to be signed by the prisoner, and duly witnessed ; and the accuracy of any such statement is to be carefully tested before the case is finally disposed of. 766a. The penalties for inducing men to desert or im- properly absent themselves, or for employing or concealing deserters or absentees, are set forth in the Naval Discipline Act. ***** 770. Except in the cases specified in Art. 772, the Com- manding Officer of a Ship may authorise the payment of a reward not exceeding £ 3 to any Constable or other person by whom a deserter may be brought on board the Ship to which he belongs, or delivered up to any duly authorised person within two years of the date of his desertion. The amount of reward should be determined by the attendant circumstances, and, in considering these, the zeal shown, and the trouble taken, by the Constable or other person by whom the arrest of the deserter has been effected, should be duly weighed. The above Regulations for the payment of rewards will not be held to apply in the case of a deserter voluntarily surrendering himself at any Police Station, or to any Constable or other recognised authority, unless it can be clearly shown that such deserter had been induced so to surrender himself by the vigilance and exertions of any such Constable, or other person; but exceptional cases of this description are not to be dealt with without reference to the Admiralty at home, or Commanders- in- Chief or Officers in command of Stations abroad, for full inquiry into the circumstances. 2. In cases where persons have been more than two years in a state of desertion, no reward is to be paid without previous reference as above; and it has been notified to the Constabularly generally that when deserters are apprehended in the United Kingdom after such a period of absence, they are not to be removed from their places of confinement until the Admiralty has been communicated with. ***** 3. A reward, not exceeding £ 3, may also be paid for the apprehension of any person who, without, in the opinion of the Captain of the Ship to which he belongs, being guilty of desertion, commits any one of the following offences, the par- ticulars of which are to be stated in the offer of reward :— ( a.) Breaks out of his Ship. ( 6.) When on service away from his Ship, quits his place of duty, and remains absent after the time at which he ought to have returned to the Ship. ( c.) When the Ship is under sailing orders, remains absent without leave until after the Ship has sailed ; pro- vided that the fact of the Ship being under sailing orders was generally known. A reward, not exceeding £ 1, may be paid for the appre- hension of any man who overstays his leave. In giving these rewards, the same considerations as govern the payment of rewards for the apprehension of deserters are to be taken into account, both as regards arrest and voluntary surrender. 4. No reward is to be paid for the apprehension of any Commissioned, Warrant, or Subordinate Officer, without the sanction of the Admiralty at home, or Commander- in- Chief or Senior Officer present, abroad. 771. In addition to the foregoing rewards, there may be paid to the Constable, or other person bringing deserters or stragglers on board, such expenses attending their lodgment, subsistence, and travelling, as may appear to have been fairly incurred, and to be in accordance with these regulations, viz. :— Railway Fare ( return) of Escort - - ( As an ordinary rule, Railway Fare ( single) of deserter or J not to exceed 1 d. straggler I per mile. Other sums expended in the actual carriage of the deserter or straggler, such as for the hire of Cabs, Boats, etc. Subsistence of deserter or Not exceeding 1 s. while under straggler. detention, or 2s. 6d. a day when travelling. Subsistence of Escort - - At the same rate as that allowed for Petty Officers under Article 1396, according to the time necessarily occupied in conveying the deserter or straggler to his destination and returning, namely, 2s. 6d. when absent above 9 hours, and not absent during the night; and 5s. when absent a night, or for every 24 hours of absence, no fractional part of a day being allowed in addition to the 24 hours, unless the extra time for which payment is claimed exceeds by more than 9 hours, the full time for which 5s. would be paid. The only other charges which, except in special cases, should be sanctioned, are a fee of 2s. to the Magistrate's Clerk, and a fee of 2s. 6d. to any medical practitioner by whom the deserter or straggler may have been examined. 2. In cases where a reward is payable no claim for loss of time or for subsistence made by any Constable or other person in connection with the apprehension of a deserter or straggler is to be entertained, but this should not prejudice claims for such expenses as are incurred in escorting the man back to a Ship after committal as allowed in the preceding clause. 3. When no reward is payable, the Constable or other person bringing deserters or stragglers on board should be directed, in addition to the above items, to prefer a claim for such other expenses as he may consider himself fairly entitled to, but every case of this description is to be forwarded to the Admiralty for examination and decision. 4. Should the Constable, or other person, bringing a deserter or straggler on board object to the Captain's award, the case is to be submitted to the Commander- in- Chief, who, if unable to settle the question, will forward it for the decision of the Admiralty. ***** The Governor of the gaol will furnish a statement of the number of days' subsistence issued, for which the charge of one shilling per diem is to be raised. ***** 6. With a view to simplifying the payment of such claims, Magistrates and Governors of gaols, when requested to send deserters or stragglers back to their ships, should be informed that it is desirable that the men should be sent in the cus- tody of the Constables who actually apprehended them. 7. The foregoing mode of payment does not apply to cases of deserters or stragglers apprehended by the Metropolitan ( London) Police, when the following course is to be observed :— No payment is to be made by the Accountant Officer in respect of the expenses incurred by the Constable, or of any reward which may be due to him. The Constable will fill up a form, prepared for the purpose, which he is to produce, and in which he will include the whole of his expenses, and certify that they were necessarily incurred by him. He will then hand the form to the Accountant Officer of the Ship, who will, with the approval of the Captain, charge the deserter or straggler with the sum shown thereon, together with any reward, if due, and note in the space provided on the form the fact of the charge having been made. The form is then to be returned to the Constable. The payment of the expenses incurred, and of the reward when due, will be arranged between the Admiralty and the Commissioner of Police. 772. No reward on the scale laid down in Article 770 is in any case to be paid for the apprehension of deserters or stragglers within the precincts of a port or place where there is a police force employed in any naval establishment, but in order to encourage the local police at any such port or place to search for and apprehend deserters and stragglers, the Commander- in- Chief, or senior officer present, at his dis- cretion, and under such regulations as he may from time to time lay down, may approve a reward not exceeding £ 1 being paid for each deserter or straggler arrested by a Constable of the local police within a reasonable period. 3. These expenses are to be paid by the Accountant Officer of the Ship.
