It is necessary to state, that the profession in innumerable instances is accustomed to look over lists which have been recently named, and when the solicitors on both sides have been of opinion that the persons named in such lists as Special Jurors would attend, they have of their own accord proposed to and taken such lists. The Prothonotaries are acquainted only with the fact of striking the forty- eight, and of afterwards reducing the number of persons to be summoned on such list to twenty- four, but whether such persons are summoned or accordingly attend, the Prothonotaries have not in their power to state as the same is not within their province.
