302 APPENDIX TO REPORT OF SELECT COMMITTEE, & c. any of the free burgesses in these presents named, or any of the free burgesses of the said city of Dublin hereafter to be elected, shall die, or be removed from their said offices ( which free burgesses and every of them respectively for misconduct, We will, shall be removable at the will of the mayor, aldermen and the rest of the common councilmen of the said city, the major part of them for that the time being,) that then the mayor, aldermen and the rest of the common councilmen of the said city of Dublin, being assembled in any convenient place within the said city, and may accordingly to the sound discretion of them or the major part of them so assembled, elect or choose one or as many as shall be wanting of the said number of forty- eight free burgesses, out of the better more discreet citizens or commons of the said city, in the place or places of such free burgess or burgesses so dead, or whose office shall be vacant, or may be removed from the same from time, as often as the case shall so happen, and that he or they so elected and chosen may have and exer- cise that office to which they shall be so elected and chosen, during his and their natural lives, if so long they shall well conduct themselves in that office; first taking respectively the corporal oath well and faithfully to execute said office, and the other corporal oath aforesaid, before the mayor of our said city of Dublin, and so as often as the case shall so happen, to which mayor, by these presents, for us, our heirs and successors, We do give and grant power and authority to give and administer said oaths; and if it shall happen that the chamberlain of the said city of Dublin shall die, or vacate his said office, or be removed from the same, ( which chamberlain for misconduct in that said office, We will, shall be removable at the will of the mayor and the rest of the common council of the said city for the time being, or the major part of them,) then, We will and grant, that the mayor, aldermen, and the rest of the common council of the said city of Dublin, or the major part of them, being for this purpose likewise assembled in our said city of Dublin, can and may elect and choose another of the aldermen, free burgesses, citizens or commons of the said city, in the place of such chamberlain so happening to die or be removed, from time to time, as often as the case shall so happen, and the person so elected and sworn shall have and exercise that office during the pleasure of the common council of the city, for taking the corporal oath well and faithfully to execute said office, and the other corporal oath aforesaid, before the mayor of the said city, and so often as the case shall so happen, to which mayor for the time being, for us, our heirs and successors, We do by these pre- sents, give and grant power and authority to give and administer said oaths: And further, We will, and by these presents, for us, our heirs and successors, do grant and confirm to the said mayor, sheriffs, commons and citizens of the said city of Dublin, and their succes- sors, that they and their successors for ever may have in the said city of Dublin, one honest and discreet man, well learned in the laws, as well of our kingdom of England as of our kingdom of Ireland, to be appointed and nominated in manner hereinafter expressed, who shall be and be called the recorder of said city ; and we have appointed, constituted, nomi- nated and made, and by these presents for us, our heirs and successors, do appoint, nomi- nate, constitute and make our beloved John Barnewall, esquire, to be the present recorder of the said city of Dublin, who, before he shall proceed to execute said office, shall take his corporal oath well and faithfully to execute said office of recorder of said city, in and by all things concerning the same, and the other corporal oath aforesaid, on the Holy Evan- gelists, before the mayor of the said city of Dublin, and after such oaths and so made, he, the said John Barnewall, shall be and continue recorder of the said city for and during his natural life, unless he shall vacate his office by reason of any provision in these presents declared, and unless in the mean time for misconduct or any other unreasonable cause he be removed therefrom by the mayor and aldermen and the rest of the common council of the said city for the time being, or the major part of them, to which mayor, aldermen and the rest of the common council of the said city, for the time being, and the major part of them, in such case and cases and for the said cause, We do give and grant by these presents, full power and authority totally to remove and expel from the office of recorder of that city, as well the said John Barnewall as any other recorder of the said city for the time being, here- after to be nominated or appointed by virtue of these presents, or according to the tenor thereof: And further, for us, our heirs and successors, We do grant and confirm to the 6aid mayor, sheriffs, commons and citizens of the said city of Dublin, and their successors, that whensoever, and as often as the place or office of recorder of the said city of Dublin shall become vacant by death, removal or otherwise howsoever, that then and so often it shall and may be lawful for the said mayor and the rest of the common council of the said city of Dublin for the time being, or the major part of them, to direct, elect another dis- creet man, learned in the law of England and Ireland, to be recorder of said city; which learned man so elected, and from time to time to be elected to that office, in form aforesaid, take the said several oaths, to be taken by the said John Barnewall, upon the Holy Evan- gelists of God, before the mayor of the said city for the time being, and that after the said oaths are so taken, every such learned man so elected and chosen, or to be elected or cho- sen to that office, shall be recorder of said city, and continue such for and during his natural life respectively, unless in the mean time for misconduct in that office, or any other reason- able cause, he be removed therefrom, or the said office in any other manner become vacant: And further, we do, by these presents, for us, our heirs and successors, give and grant to the said mayor of the said city, for the time being, full power and authority to give and administer such oaths, as well to the said John Barnewall as to all and every recorder of said city for the time being, now and hereafter in manner aforesaid, respectively nomi- nated and elected from time to time: And further, We will and by these presents, for us, our heirs and successors, do grant and confirm to the said mayor, sheriffs, commons and citizens
