256 APPENDIX TO REPORT OF SELECT COMMITTEE, & c. habitants of the quays is the only remaining source, effectually to further and complete this work, and keep the same in repair, together with the proper cleansing of the river within the limits between Carlisle and Barrack bridges, the great advantage to arise therefrom, being chiefly enjoyed by the resident inhabitants of those quays. Note.— The 29 sect, of 43 Geo. 3. c. 127.— All persons who before the passing of Act, were bound to repair said walls, exonerated therefrom in consideration of annual payment of 2 s. per foot on their holdings. Ballast Office, Dublin," 1 William Bigger, May 5, 1823. J Ballast Master Port of Dublin. My Lords and Gentlemen, Dublin Castle, 18 Feb. 1802. A Representation having been laid before the Lord Lieutenant by the late term grand jury, by direction of the court of King's Bench, of the ruinous and dangerous state of the Quay walls from Carlisle- bridge to the Barrack bridge, on each side of the river Anna Liffey, excepting that part of the wall at Aston's quay, built under your direction; and having also stated the necessity of building new walls upon a general plan; and it ap- pearing to his Excellency, from the fidelity and zeal with which you have conducted the works already committed to your care, and with which the works now proposed are con- nected, that the same could best be carried into execution under your direction, he desired that a bill should be prepared for extending your powers in respect to the walls of the river Liffey. And I have now the honour to send you herewith, by his Excellency's command, a draught of a bill for the purpose before- mentioned, and he requests you will immediately take it into your consideration; and that you will favour me with your observation and opinion thereupon, for his Excellency's information, as soon as may be convenient. In compliance with the desire of his Excellency the Lord Lieutenant, communicated by your letter of the 18th February, the corporation for preserving and improving the port of Dublin have, with all due diligence, taken into their consideration the draught of a bill proposed by his Excellency to be submitted to Parliament, for rebuilding the walls of the river Anna Liffey; and have made such alterations therein, as to them seem requisite for the effectual and secure attainment of that object. If 110 other competent body can be found to undertake the superintendence of this work, which they ardently wish could be the case, the corporation, whose wish it is to further an object of such great public utility, will not decline to comply with his Excellency's desire, by taking the labour of it on themselves, notwithstanding that other heavy works, immediately connected with the purposes of their incorporation, press on them for execution. The corporation beg leave to suggest, that a rate of about three shillings and six- pence per foot might be laid on the inhabitants of the quays, the remainder of the expense to be provided for by presentment ( so far as that may be deemed prudent), or by such other aid as may be applicable to the purpose. But I am directed to request, that you, Sir, will represent to his Excellency, the opinion of the corporation, that although the tax of five shillings and sixpence per foot and upwards, will be requisite for the purposes of the Act, yet that on a comparison of the propor- tionate advantages to be obtained by the inhabitants of the quays, and by the public at large, respectively, from the works to be executed, the sum proposed to be laid on the inhabitants, is considerably beyond what, in point of fairness, should be laid on them, and also beyond what can with ease, and without much ill temper, be collected. The amended draught of a bill accompanies this letter, to which the corporation have taken the liberty of adding some clauses for the objects of their own incorporation, which they hope will not, and do not wish should, interfere with the passing of it.
