4 IRELAND: RETURNS RELATING TO Query.— lf the Governors have ordered the payment of a portion of the Parlia- mentary Grant, under the name of Pension, to persons not qualified to receive it can the Commissioners of Accounts allow such payment in the Accounts of the Hospital; and if not, who will be held responsible tor the de- ficiency r Mr. TownsencCs Answer to the foregoing Query: Answer:— I do not see how it is possible for the Commissioners of Accounts to allow such payments, but 1 am of opinion that the Lord Lieutenant may in his discretion order such allowances; and if any payments have been made in error, hi? Grace should, be applied to for that purpose, otherwise 1 much fear that such loss must fall on the person making the payment. The Attorney and Solicitor General's Answer to the foregoing Query: We concur in the Answer given by Mr. Townsend to this Query. Query.— Are Militia men, whom the Law entitles to the Pension, to receive the same rates granted to the Line; or if not, in what proportion are they to be paid ? • Mr. Townsend's Answer to the foregoing Query: Answer:— The same, as I conceive. ( Signed) William Plunkett, Audr and Regr. 17 March 1813. Royal Hospital Kilmainham. THE Attorney and Solicitor General having already given their Opinion, that the Governors of Kilmainham Hospital have not the power of granting Pensions to Soldiers discharged from the Militia, except to Non- commissioned Officers and Drummers, who having served as such for twenty years, shall be discharged on account of Age or Infirmity ; and except to Non- commissioned Officers, Drummers and Privates, who shall be " maimed or wounded" 011 actual service:— Your Opinion is requested, whether, under the provisions of the 49th Geo. III. chap. 120. relative to the admission of Militia Soldiers being maimed or wounded, to the benefit of Kilmainham, the Governors were legally empowered to admit any and which of the undernamed persons: Thomas Mansfield, of the Kerry Militia, admitted on the 28th June 1809; being worn out. Joshua Bidwell, Donegal, 28th June 1809; discharged on account of general debility. Peter Donelly, Leitrim, 29th November 1809; discharged on account of paralysis of the right thigh. o o Charles Duffy, Donegal, 29th November 1 809 ; deafness. William Spring, Limerick County, 27th June 1810; being asthmatic. The Attorney General's Opinion : I am of Opinion that the Cases above described do not fall within the provision of the 49th of the King, chap. 120. To entitle Non- commissioned Officers, Drum- mers or Privates to Kilmainham, they must, in my Opinion, be disabled by some external injury or accident happening on actual scrvicc. You
