' KILMAINHAM HOSPITAL. v You are further requested to state your Opinion, whether if the Governors of Kilmainham have, in the above instances, and in other similar cases, where the discharged Militia Soldier lias not been " maimed or wounded on actual service," granted a Pension, an Act of Parliament is necessary to indemnify them ; and also, whether the Pensions so granted contrary to the provisions of the Militia Laws, can be continued to be paid without the authority of Parliament? The Attorney General's Answer: The Solicitor General and I gave an Opinion on a former Case, That an Act of Parliament was necessary to indemnify the Governors and legalize the payment of the Pensions in future, and to which I still adhere. RESOLUTION of the Governors of Kilmainham Hospital, dated the 21st November 1812. THE Board having taken into consideration the above Queries and Opinions, relat ve to the Pension granted by this Establishment to Privates of Militia, not bting maimed or wounded on actual service :— Ordered, That the Benefit of Kilmainham Hospital shall not be granted to any persons claiming the same on account of length of Service in the Militia, or on account of Disability occasioned therein, except to Serjeants, Corporals, or Drum- mers, who having served as such. in the Militia for twenty years, shall be discharged on account of Age or Infirmity, and shall also be recommended by the Command- ing Officer of the Regiment or Battalion to which they belong, and to Non- commissioned Officers, Drummers and Privates of the Militia, who shall be maimed or wounded in actual service.
