Royal Air Forco Repulse 4 THE POLICE GAZETTE. MONDAY, JULY 4, 1921. EXTRACT FROM RING'S REGULATIONS AND ADMIRALTY INSTRUCTIONS FOR APPREHENSION OF DESERTERS - REWARDS, Sic. ( d) If not received into His Majesty's Navy, and on oonviction of faLse confession of desertion before two Justices of the Peace, be may be adjudged to be punished, it in England, as a rogue and a vagabond, and if in Scotland, or Ireland by commitment to prison, there to be kept to hard labour for any time not exceeding three months. t. When any deserter, or absentee without leave, whether lelivered into Naval custody by order of a Magistrate, or by a warrant issued under Section 60 of the Navel Disciphne Act, or by voluntary surrender, shall be brought before the Captain of any one of His Majesty's ships to be dealt with • nmmarily, his case is to be thoroughly investigated with a view to establish his identity, and a note taken in writing of the proceedings; the prisoner is at the same time to be formally asked il he baa any statement to make, and such statement, if made, is to be signed by the prisoner and duly witnessed » and the accuracy of any such statement is to be • arefolly tested before the case is finally disposed of. 803. The penalties for inducing men to desert or to im- ptoperly absent themselves, or for employing or concealing deserters or absentees, are set forth in the Naval Discipline Aot. 8ee 723 ( Aiding Desertion). 804. Every possible effort is to be made to check desertion and absence without leave, and by lawful means to detect and apprehend deserters or absentees. Descriptions on Forms S243 are to be distributed as may be directed by the Commander- in- Chief, but at home one coiy is invariably j to be sent by the Captain to the Chief Constable of the deserter's or absentee's usual place of residence, when it is known, and also to any other place or places where he may be likaly to have gone. 2. The procedure to be followed in respect of the arrest and subsequent Ux *> o « ttl of deserters and absentees is governed by the pr- risions of Section 9 of the Act 10 and 11 Vict., cap. 62, and by Section 60 of the Naval Discipline Act. 3. Under the first of those Statutes, any person arrested on suspicion of being a deserter or absentee from His Majesty's Navy, shall be taken and charged before a Magis- trate, and by him, either— ( à) Conveyed to prison pending enquiry of the Naval l authorities as to his identity and afterwards, j should such identity be pioved, banded over to j Naval oustody; or— ( á) Committed direct to Naval oustody on board any one of His Majesty's ships In either of the above cases, after the deserter or absentee has been delivered into Naval custody, he may be dealt with under the Naval Discipline Aot, 4 11 arrested on Naval Warrant, under Section 60 of the Naval Discipline Act, the deserter or absentee may be received direct into Naval custody, and dealt with under the Naval Discipline Act, but no deserter or absentee who has not been arrested under suoh warrant shall be received trom the Police or from any other person, unless such deserter or absentee has first been charged before a Magis- trate. fl. A deserter or absentee who volontarfly surrenders himself to Naval authority may oe de2lt with under the Naval Disoiplin* Act, though no warrant for his arrest • lay have been issued, and without charging him before a Magistrate. 6. Under the provisions of Section 10 of the Act 10 and 11 Vict., cap. 62, any person who voluntarily confesses to being a deserter, or an absentee without leave, from His Majesty's Navy, unless he surrenders himself into Naval custody, may either— ( a) Be taken before a Magistrate, and by him delivered into Naval custody; or— ( b) Be arrested on a warrant under Section 60 of the Naval Discipline Act, and delivered direct into Naval oustody. In cither case, however, the question whether he be or be • ot a deserter or absentee, must be duly investigated by Naval authority, and for that purpose he may be detained ( or a reasonable time, when, if his confession of desertion or absence without leave shall be found not to be true, then he cannot be punished at all under the Naval Discipline • ot, but he may either— ( c) Be detained and received in His Majeety's Navy j 807 Except in tbe cases specified in Art. 809, the Captain may authorise the payment of a reward not exceeding £ 3 to any Constable or other person by whom a deserter may be brought on board or delivered up to anv duly authorised person within two yean of the date of his desertion. 3. If the Constable, or other person, bringing a deserts* or absentee on board, should object to the Captain's award the case is to b » submitted to the Ommaoder- in- Chial, who, if unable to settle the question will forward it for the decision of the Admiralty. The amount of the reward should be determined by the attendant circumstances, and in considering these, the zeal shown and the trouble taken by the Constable or other person by whom the arrest of the deserter has been efleoted, should be duly weighed The above Regulations for the payment of rewards will not be held to apply in the case of a deserter voluntarily surrendering himself at any Police Station, or to any Con- stable, or other recognised authority, unless it can be dearly shown that such deserter had been induced so to surrender himself by the vigilance and exertions of any such Constable or other person, but exceptional cases of this description are not to be dealt with without reference to the Admiralty at home or Commanders- in- Chief, or Officers in command of Stations abroad, so that a full enquiry < n » o the circum- stances can be made if necessary. 4. The Aoaountant Officer of the ship to whioh the deserter or absentea is brought is to pay to the Police, on Form S. 26, any reward which may be approved, and the statutary fee of 2s. to the Magistrate's Clerk when incurred. 2. in cases where persons have been more than two years in • - tate of desertion. no reward is to paid without previous reference as above; it has been notified to the Constabulary generally that when deserters are apprehended in the United Kingdom alter such a period of absence, they are not to be removeo from their placee of confinement until the Admiralty have been communicated with. 3. A reward, not exceeding £ 3, may also be paid for the apprehension of any person who, without beiDg guilty Of desertion, in the opinion of the Captain of the ship to which he belongs, either gives reasonable ground for con- sidering that he intends to desert, or commits any one of the fouowing offences, the particulars of whioh arc to stated in the notice to tbe Police i— ( a) Breaks oat of his ship ( b) When on service away from his ship, quite his place of duty and continues to be absent after the time at which he should have returned to the ship. ( c) When his ship is under sailing orders, continues to be absent without leave, after the ship has sailed, provided that the fact of the ship being under sailing orders was generally known. A reward not exceeding £ 1 may be paid for the appre- hension of any man who overstays his leave unless there is reasonable ground for considering that the man intends to desert, in whioh case £ 3 may be paid. In giving these rewards, the same considerations that govern the payment of rewards for the apprehension of deserters are to be taken into account, both as to arrest and voluntary surrender. 4. No reward is to be paid tor the apprehension ol any Commissioned, Warrant, or Subordinate Officer, without the sanotion of the Admiralty at home, or of the Commander- in Chief or Senior Officer prekent, abroad. 808. For deserters or absentees escorted by the Police in Great Britain the only paymente which may be sanctioned in addition to the foregoing rewards are the statutary fees of 2s. to the Magistrate's Clerk and 2s. 6< L to any medical prac- titioners by, whom the deserter or absentee may have been examined, • 2. If no reward should be payable, the Constable, or other person bringing deserters or absentees on board, should be directed, in addition to tbe above items, to prefer a claim for such other expenses as he may consider himself fairly entitled to. but every case of this description is to be forwarded to tbe Admiralty fir examination ana decision 6. With a viow to simplifying the payment of such claims. Magistrates and Governors cf Gaols, when requested to send deserters or absentees baok to their ships, should be informed that it is desirable that the men should be sent in the custody o3 the Constables who actually apprehended them. 6. The foregoing mode of payment doee not apply to desortora or absentees apprehended by the London Metropolitas Police. For thesb the following course is to be observed •— No payment is to be made by the Accountant Offioer li> respect ol the exponses incurred by the Constable, or of any reward which may be due to him. The Constable will produce a form prepared for the purpose* and will hand it to the Accountant Offioer of the Ship, who will, with the approval of the Captain, forthwith charge tb> t deserter or absentee with the amount ol any reward, if due, and note in the space provided on the lorm the fact ol the charge having been made The form is then to be returned to the Constable. The payment of the reward, when due. will be arranged betwoon tbe Admiralty and the Commissioner of Police fo » the Metropolis, and any amount chargeable against the deeertor or absentee in reepeot of railway warrant" issued by the Police for the deserter or absentee's own oonveyanc » will bo oommunicated by the Aocountant Gen- ral of the Navy. 809. No reward under the authority given to the CapUba by Article 807 is in any case to be paid for the apprehension of deserters or absentees within the precinote of a place where a Police Force is employed in any Naval establishment, but in order to encourage the local police at any suoh port o » place to search for and apprehend deserters or absentees, the Commander- in- Chief or Senior Officer present, at hl » discretion, and under suob regulations as he may from tlmt> to time lay down, may approve a reward not exceeding £ t being paid for each deserter or absentee arrested by a Con- stable of the local Police within a reasonable period. The reward paid is to be charged on the ship's ledger against tb » wages of the deserter or absentee. Nor*.— If any doubt exists as to the address ot any ships the Admiralty should be aaked by teletrraoh for inlormatioa. Payments are made by the Accountant Offioer of the ship. When any Naval authority has once been oommunicated with as to the disposal of a deserter or absentee, separate arrangements should not be made with a second Naval authority without notifying the former of the steps that are being taken. Neglect of this precaution may result in muofc unnecessary trouble and expense. Every application for a reward under tie foregoing Regu- lations should be made as soon as possible after the arrest, and should be aooompanied by a detailed report of the attendant circumstances ( see Article 807, Clause 1, pare* graph 2) for the information of the Commanding Offioso who authorises the payment of the reward.
