Vf OTICE.— For instructions as to the manner in which reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct PERSONS WANTED. AUCKLAND.— Between 1st March last and 17th ultimo, on warrant for theft of a ladies' dre'sing- case ( recovered), value £ 5 5s., the property of Kate Theresa Heenan, 6 Carle- ton Gore Road, Mrs. Harris ( probably fictitious), age about twenty- three, height 5 ft. 3 in., domestic, native of New Zealand, dark- sallow complexion, brown hair and eyes, several upper front teeth missing; slovenlv appearance ; dressed in white- spotted grey skirt and cream blouse ; wears a quantity of cheap jewellery. Offender is supposed to be identical with Mrs Stanaway, wife of Charles Victor Raymond Stanaway, a quarter caste Maori. STRATFORD.— 7th instant, on warrant for failing to pro- vide for the adequate maintenance of his wife and child, George Wiarie, age twenty six, height about 5 ft. 8 in., woolclasser, native of New Zealand, a half- caste Maori, light- copper complexion, black hair parted in centre, dark eyes, fingers of boih lianda slightly contracted ; flash appear- ance. He is supposed to have gone to Tokaanu. NAPIER — 21st ultimo, on warrant of commitment to Napier Pri on for forty- eight hours in default of paying £ l 5s. fine and costs for drunkenness, Frank Thornton, aae thirty, height. 5 ft. 11 in., labourer, native of New South Wales, medium build, sallow complexion, dark hair, grey eyes, scar on nose, burn- mark on right forearm. He is supposed to have come to Wellington. OTIRA.— 18th July last, on warrant of commitment to Hokiiika Police Gaol for fourteen days in default of paying £ 2 6s. fine and costs for playing " two- up," Charles O'Loughlin, age about twenty five, height 5 ft. 5 in. or 6 in., labourer, native of New Zealand, medium build, dark complexion and hair, top of left little finger missi-' g; gene- rally dressed in blue suit and straw hat or cap. Offender is an ex comedian and acrobat, but may seek employment as a labourer at Lake Coleridge. He has a brother at Christ- church. CHRISTCHORCH.— George Grey, alias G. Findlay, wanted on warrant for false pretences: It has heen ascertained that offender is not identical with Tom Sellwood. alias G. Findlay. His correct name is George Finlay. MASTERTON.— Louis Grant, false] pretences, has been arrested by Deteotives Hollis and Powell, Auckland police, on information supplied by Detective Mitchell, Gisborne police. He is identical with Louis Charles Grant, re- ferred to in Police Gazette, 1907, page 372. ( See Police Gazette, 1911, page 368 ) MASTERTON.— Louis Grant, forgery and uttering, has been arrested by Detectives Hollis and Powell, Auckland police, on information supplied by Detective Mitchell, Gis- borne police. He is identical with Louis Charles Grant referred to in Police Gazette, 1907, page 372. ( See Police Gazette, 1911, page 410, and preceding paragraph, this issue.) WELLINGTON.— John Langley, theft, has been arrested by Constable Fitzsimmons, Wakefield police, on information supplied by Constable P. Doyle, Wellington police. ( See Police Gazette, 1911, page 400.) GERALDINE.— John Long, absconding from licensed service, has been discharged from the Christchurch Re- ceiving Home. His arrest is no longer desired. WELLINGTON.— 14th July last, from a paddock at Karori, the property of JOHN SMITH, painter, Miramar, a light- bay gelding, broken to saddle and harness, aged, about 15 hands high, branded " 8" on near shoulder; value, £ 7. Identifiable. CHHISTCHURCH.— 15th July laBt, from a right- of- way near Hereford Street, the property of M. MANNiX, State Coal Depot, a gentlemen's free-' wheel New Hudson bicycle, Nos. 15226 and 57709, front and back brakes, steel rims, pedals, and mud- guards, Dunlop tires; value. £ 15. Identi- fiable. PROPERTY RECOVERED. • AUCKLAND.— MILNE AND CHOYCE'S property has been reoovered, and Joseph Ehrman, alias Herman, and Arthur Glover have been charged with the offence. ( See Police Gazette, 1911. page 254.) AUCKLAND.— L. D. NATHAN AND CO.' S forty- two pairs of shoes have been recovered, and Joseph Ehrman, alias Herman, has been convicted for the offence. ( See Police Ga zette, 1911, page 323.) FRANKTON JUNCTION.— WILLIAM THOMAS BARRY'S mare has been recovered : not stolen. ( See Police Gazette, 1911, page 193.) DENNISTON.— COLIN CAMPBELL'S coat hasbeen re- covered. ( See Police Gazette, 1910, page 442.) MISSING. TARADALE. — Since 1st July last, Leslie John Allen, age Bixty- eight, height 5 ft. 11 in., piano- tuner, native of England, slight build, dark complexion, grey hair and beard, long nose, stooping gait; an old- age pensioner; shabbily dressed. He was last heard of at Greenme& dows. Fears are entertained for his safety. Inquiry is at the instance of the Napier polioe. INQUIRIES, ETC., FROM OUTSIDE NEW ZEALAND. » HOBART ( TASMANIA). — Mrs. Margaret Gray reports that between the 21 » t and 25th ultimo ttie following articles were stolen from her residence, Fitzroy Place, HOBart: A ladies' long gold muff- ohain, with an American gold coin, re- sembling a sovereign, attached thereto; a ladies' small 9 ct. gold hunting keyless Elgin watch, No. 10436920; a ladies' 18 ct. gold engagement ring, set with five diamonds; a ladies' 18 ct. gold engagement- ring, set with three diamonds ; a ladies' gold ring, set with rubies ; a ladies' gold ring, set with five pearls; a laiies' gold half- hoop- pattern ring, set with sap- phires and diamonds ; a large turquoise- matrix necklet, with one large and two small turquoise gems suspended there- from ; a pair of gold and turquoise- matrix ear- riugs ; a pair of gold ear- rings, set with pearls and an amethyst ; a heavy gold curb- pattern bangle ( no fastening) ; a gold bangle, with Japanese coins attached thereto; a small gold brooch, set with a centre diamond and turquoise cluster ( one turquoise missing), " M " engraved on ba k thereof, and a small safety- chain attached thereto ; two children's silver bangles. The Commissioner of Police, Hobart. requests that inquiry be made to ascertain whether any of this jewellery has been disposed of in New Zealand. Should any of the stolen articles be recovered in this Dominion, an immediate communica tion is to be sent to the Commissioner's Office, Wellington. ( 11/ 1863.) HOBART ( TASMANIA).— Mrs. A. I. Forbes and Miss M. Forbes report that on 22nd ultimo the following articles were stolen from their bedrooms at the Tramway Hotel, Macquarie Street, Hobarc: A gold muff- chain, with large and small links ; a gold double- case keyless watch, with " N. G. F., from Mother," and date engraved on back case thereof; a gold brooch, with musio- notes denoting " Dearest " ; a black watch- guard, with several trinkets including a small pistol attached thereto ; a gold dagger- and- erescent pearl- set brooch ( some pearls missing), with " N. P. to E. M." engraved thereon ; a gold rope- edged brooch, set with rubies; a very heavy 9ct. gold curb- pattern bangle, with lock attached thereto ; a gentlemen's gold and filigree work ring; a plain gold cross, with a short neck- chain attached thereto ; a gold wishbone- pattern brooch ; a pair of gold- rimmed speotacles ; and a bunch of keys: total value, £ 30. Identifiable. The Commissioner of Police, Hobart, requests that inquiry be made to ascertain whether any of these articles have been disposed of in New Zealand. ( 11/ 1863.) 431 N E W Z E A L A ND P O L I C E G A Z E T T E. [ OCT. 18 MISCELLANEOUS INFORMATION. Resignation. No. 1196.— Constable Holliday, Alfred. 6th September, 1911. LAW REPORT. » ( Before W G. Kenriek, Esq., Stipendiary Magistrate, Havvera.— 22nd July, 1911) POLICE V. FRANK CORRIGAN. Loitering in a Street for the Purpose of Betting — The Gaming Amendment Act. 1910, s. 2 ( 1). The defendaut is charged under section 2 ( 1) of the Gaming Amendment Act, 1910, that he did on the 18th day of May, 1911, frequent or loiter in a street— namely, the main road between Hawera and Normanby, and adjacont to the Hawera Racecourse— for the purpose of betting. Il is proved defendant was on the racecourse on 17th May, during a race - meeting, and that he was warned off by Detective Walden, and that he came on the course from time to time, but leaving it whenever the detective saw him, and standing on the road. It is further proved and admitted by the defendant when giving evidence that he had been a bookmaker for a considerable time, and that he did on the 18th May, the day on which he is charged, frequent aud loiter on the main road near the racecourse- gates, but defendant denies that he did so for the purpose of betting. It is also proved and the defendant admits that he gave £ 2 to a man named Bond, who came from the course on to the road to receive the money from de- fendant, and that Bond returned to the course on receiving the same. It is also proved that several persona spoke to the defendant, some coming from the course to do so. Defendant, when giving evidence, said he had met Bond prior to the races on the 18th, and asked him to come out from the course now and again to see if he ( the defendant) desired to put anything on the machine ( the totalisator), and that Bond did so, when he gave him the £ 2 to put on a horse for him, and later on he gave a cab- driver £ 3 to put on the machine on the same horse. He also said : " I did have a bet on a horse with a man named Coffey. I gave him £ 1 to put on the totalisator, and he brought me the dividend." It is proved the defendat t did not go on the course on the 18th, but remained on the road about the two entrance- gates during the races. Mr. Spence, for the defendant, contended that section 2 ( 1) of the Gaming Amendment Aot, 1910, is only intended to prevent betting or laying odds in a street by a bookmaker, and does not apply to a person sending in money from the road for in vestment on the totalisator, which he contended was only an offence under section 53 of the Gaming Act, 1908, but not against section 2 ( 1) of the Amending Act. Section 2 ( 1,) of the Amending Act, 1910, says every person who frequents, loiters, or is in any street for the purpose of betting is guilty of an offence, and is liable on conviction to a fine of not less than £ 20 and not exceeding £ 100. The evidence does not prove defendant laid odds with any persons or kept a book, but it has proved defendant was loitering about on the public street near the entrance- gates of the course during the race- meeting on the 18tb, and that de- fendant gave money to persons coming from the course, and that defendaut received money, a dividend, on the street. It is not necessary- under section 2 ( 1) to prove a bet was actually made. Section 2, s. s. ( 2) provides for such oases. All I have to be satisfied with is that the evidence proves defendant was loitering on the street for the purpose of betting, and I think it is immaterial whether he was there for the purpose of betting on the machine or any other form of betting. The words of that section is not limited to any particular class of person or any particular class of betting. The term " betting" and " bet'' are fully defined in sec- tion 3 of the Amending Act, 1910. It has been further con- tended that the evidence proves an offence under seotion 53 of the 1908 Act, and therefore he cannot be convicted under section 2 of the 1910 Aot. Seotion 53 makes it an offence to employ a person as agent to put money on the totalisator for another, and it is possible the evidence has proved the defendant has committed such an offence ; but he ia not charged with this ; but if the evidence has also proved an offenoe under section 2 ( 1) of the 1910 4ct, which, in my opinion it, has done, the faot of the offence having been proved under another Act does not of itself prevent a con- viction under the Act he is now charged. I have been asked to read words into the section which are not there; I think I am not justified in doing so. Mr. Justice Chap- man, in the case of Hutton v. Hutton ( 13 Gaz. L. R. 201), says the Courts cannot allow an Act intended to remedy a known evil to fail of its object through an over- refined construction if it is sufficiently expressed to carry out that object. Again, in the recent case of Denning v. Swet- nam ( 1 K. B. [ 1909] 774) the Judge says, " The Street Bet- ting Act is a very salutary statute, and it is undesirable that the Court should be astute to discover means by which that statute may be evaded." I am quite satisfied on the evidence before me defendant was on the street for the purpose of betting. The statute provides a heavy penalty. I think a fine of £ 30 will meet the present case. I'rescribing Close Season for Oysters at Nelson. ISLINGTON, Governor. ORDER IN COUNCIL. At the Government House, at Wellington, this fifth day of September, 1911. Present : His EXCELLENCY THE GOVERNOR IN COUNCIL. Wr HERE AS it is provided by the fifth section of the Fisheries Act, 1908 ( hereinafter called " the said Act"), that the Governor may from time to time, by Order in Council, make regulations, which shall have force and effect either throughout New Zealand or only in such waters or places as are specified in the regulations, for, inter alia, prescribing a cloi> e season for oysters over any terra not exceeding three years, and, before the expira- tion of such term, further extending the same : And whereas it is desirable to prescribe a close season for oysters, over a term of two years, in the waters and places hereinafter described : Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, anJ acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations. REGULATIONS. 1. A CLOSE season for oysters, for a term of two years from the date of the publication of this Order in Council in the New Zealand Gazette, is hereby prescribed within the area described in the Schedule hereto. During such close season it shall not be lawful to take oysters within the said area. 2. Any person committing a breach of the foregoing regulation shall be liable to a fine of not less than £ 1 nor ' nore than £ 20. SCHEDULE.
