N OTICE.— For instructions as to the manner in which reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Farce in charge of out- stations will forward them direct PERSONS WANTED. AUCKLAND.— 15th March last, that she may be compelled ' to maintain her son, Joseph Nelson, an inmate of an in- dustrial school, Kate Ross, age forty, height about 5 ft. 5 in., charwoman, half- oaste Negress. She was last heard of at Gisborne. Inquiry by the Education De- partment. AUCKLAND.— 20th May last, on warrant for being an absconding debtor under the Bankruptcy Act, John Tipper, age about thirty- five, height about 5ft. 8in., engineer and motor expert, supposed native of America, well built, fresh oomplexion, dark curly hair, blue eyes, dark- brown moustache, good appearance; generally dressed in dark- brown suit and black hard hat. Photograph filed in the Inspector's office, Auckland. Offender is known to have reoeived £ 360 immediately before his disappearance, and he may be heard of at Wellington or Christchurch. WAIPIBO BAY.— 31st March last, that a - witness sum- mons may be served on him, George James Grey, age about thirty- seven, height 5 ft. 7 in., labourer, native of Eng- land, medium build, dark complexion, dark- brown hair and moustache, blue eyes, tattooed on both arms ; fond of drink ; generally dressed in grey or light- brown suit and felt hat. On or about 8th ultimo he was employed as a carter on the Auckland Wharf. He may be found assooiating with Maoris. ( See Police Gazette, 1911, page 273.) NAPIER.— 14th ultimo, on warrant of commitment to Napier Prison for fourteen days in default of paying £ 3 19s. costs for theft, Ned, alias Charles, alias Edward Francis Hedley, age about twenty- five, height 5 ft. 5 in., labourer and groom, native of New Zealand, clean- shaved, very fair sandy- coloured hair ; dressed in brownish- coloured suit and wide- rimmed browu- felt hat; has the appearance of a jockey or horse- trainer. WANOANUI. — 4th instant, on warrant for assaulting Joseph Charles Vincent, carrier, Waitotara, so as to cause him actual bodily harm, John Gunn, alias Dunn, age twenty- two, height 5 ft. 5 in., labourer and racecourse guesser, native of New Zealand, strong build, fresh complexion, fair hair, round face, clean- shaved, boyish appearanoe ; dressed in brownish- coloured suit and cap. PALMERSTON NORTH.— Robert Smith, alias Anderson, alias Dalziell, wanted on warrant for false pretenoes on John Hurley : It has been ascertained that offender is not identical with Robert Barker, whose apprehension is notified in Police Gazette, 1911, pages 286 and 302. B., native of England, stout build, fair com plexion, dark- brown hair. WELLINGTON.— 4th instant, on warrant for deserting the s. s. " Tongariro," John Bright, age thirty- six, height 5 ft. 6Jin., seaman, native of England, dark complexion, brown hair, grey eyes, two daggers, heart, crown, " R. N.," cross, anchor, and three stars on right forearm, sailor with flag, two flags, and anchor on left forearm, flag on right hand. JULY 12 PICTON.— 29th April last, that a notice of fine and costs (£ 4 10s. 6d.) for wilful damage may be served on him, James Reddick, age thirty- five, height 6 ft. 2 in., butcher, native of New Zealand, medium build, fair complexion, dark hair, heavy dark moustache ; generally dressed in dark- blue suit and black hard hat. He is well known as the owner of the racehorse Ireni, and may seek employment at Puke Puke or Napier Freezing- works. BLENHEIM.— 6th instant, on warrant for obscene lan- guage, James Sands, age about twenty - seven, height 5 ft. 8J in., cook, native of Denmark, well built, broad shoulders, very fair complexion and hair, large promineut nose, very slight fair moustache only, pleasant appearance, female buet, sailor and woman, and heart and arrow tat- tooed on arms, ring tattooed on one finger; well dressed in light- coloured suit and hard hat. He failed to answer to a summons, and may be beard of at Wellington, where he will probably seek employment on a ship. A charge of false pretences is also pending against him. WESTPORT.— 26th ultimo, on warrant for absconding from bail, Stanley Ross, age thirty- one, height 5 ft. 11 in., spieler, native of New Zealand, aotive build, fair complexion, brown hair, hazel eyes, brown moustache only; generally dressed in light- brown suit and hard hat. He was awaiting trial for indecently assaulting Jean Meikle, and was ad- mitted to bail on the recognizance of Mr. J, R. Lundon, solicitor, Auckland, for £ 100, but failed to appear at the Supreme Court when called upon to answer to the indiot- ment. KUMARA.— 7th May last, on warrant of commitment to Hokitika Police Gaol for one month in default of paying £ 5 3s. fine and costs for wilful damage, Timothy O'Grady, age twenty- seven, height 5 ft. 6 in. or 7 in., labourer, native of Ireland, medium build, dark complexion ana hair, clean- shaved ; fond of drink ; generally dressed in old dark- coloured coat and trousers ( no vest), black- silk neckerchief, and grey cap. CHRISTCHURCH.— 18th ultimo, on warrant for theft of £ 2 from Donald George McKinley, baker, Riccarton, Sidney Humphries, age seventeen, height 5 ft. 4 in., labourer, native of New Zealand, medium build, fair complexion and hair; dressed in brown knicker suit and cap. CHRISTCHDBCH.— E. Davis wanted on warrant for theft of William Dobb's bicycle : It has been ascertained by Acting- Detectives Osborn and Snow, Christchurch police, that offender is identical with Frank Peterson, or Petersen, alias Parker, alias Fitzjohn, alias Fritz- john, referred to in Police Gazette, 1910, page 358, and Photographs of Prisoners Discharged, 1910, page 42. DUNEDIN.— 29th May last, on warrant of commitment to Dunedin Prison for forty- eight hours in default of pay- ing 13s. fine and costs for drunkenness, Julius McQuaid, age fifty- one, height 5 ft. 7Jin., cab- driver, native of Vic- toria, medium build, fresh complexion, fair hair, blue eyes; generally dressed in dark- tweed suit and black hard hat. GISBORNE. — William Henry Mann, failing to com- ply with the conditions of his release upon probation, has reported himself to the Waipiro Bay police, and his arrest is no longer desired. Identifiable. PROPERTY RECOYERED. HAMILTON - LUCY BELL'S mare has been recovered by Constable McDonnell, Aratapu police, on information sup- plied by Constable Bern, Kirikinroa police. ( See Police Gazette, 1910, page 95.) WOODVILLE.- W. B. WATSON'S bicycles have been re- covered. They were abandoned at the Commercial Hotel. ( See Police Gazette, 1911, page 303.) CHRISTCHURCH.— DAVID WAGHORN'S overcoat has been recovered, and Erwin Steele, alias Edward James Steele, alias Edwin Jovee, charged with the offence by Acting- Deteotive Osborn, Christchurch police. ( See Police Gazette, 1911, page 303.) SOUTHBRIDGE. — ALBERT JAMES MCLAUGHLIN'S bioyole has been recovered by Constable Clarkson, Rakaia police, and returned to the owner. It was abandoned near Chertsey. ( See Police Gazette, 1911, page 287.) WYNDHAM.- JAMES McDONALD'S bicycle has been re covered, and returned to the owner. The suspect, Joseph Thomas Christie, left it at the Milton Railway • station. ( See Police Gazette, 1911, page 215.) INQUIRIES, ETC., FROM OUTSIDE NEW ZEALAND. SYDNEY.— William Henry Davey, wanted on war- rant for bigamy : Offender's arrest is not at present desired, but, if looated, he is to be kept under surveillanoe and an immediate communication sent to the Commissioner's Office, Wellington. ( See Police Gazette, 1911, page 175.) ( 11/ 796.) SYDNEY.— A warrant has been issued at the Central Police Court for the apprehension of Joseph James Gambetta for leaving his illegitimate child, William Frederick Mullins, without means of support at Sutherland since 10th January last. Description: Age twenty- four, height 5 ft. 4 in. or 5in., stout build, fair complexion, brown hair, blue eyes; generally dressed in greenish suit and black hard hat; a labourer. He is supposed to have come to New Zealand, where his relatives reside. If located, he is to be kept under surveillance and an immediate communication sent to the Commissioner's Office, Wellington, before further action is taken. ( 11/ 1192.) SYDNEY.— A warrant has been issued by the Water Police Bench for the arrest of George Michael, charged with wife- desertion. He is forty- three years of age, 5 ft. 5J in. high, native of Assyria, rather stout build, dark complexion, Jewish appearance, dark hair turning grey, dark- brown moustache; dresses well; a watchmaker and jeweller : generally canvasses country districts. Complainant, Ethel Michael, 403 Sussex Street, Sydney. Offender, who is identi- cal with Jarburji Harji, alias George Michael, referred to in New Zealand Police Gazette, 1899, pages 97 and 121, con- ducted a business at 206 High Street, Christchurch, until about June, 1910. He was last heard of at Brisbane, Queensland, but spoke of coming to Rotorua, for health reasons. If located, an immediate communication is to be sent to the Commissioner's Office, Wellington, before fur- ther action is taken. ( See New South Wales Police Gazette, 1910, page 409.) WELLINGTON.— Henry Cakebread, age twenty- seven, height 5 ft. 5 in., stoker, native of England, dark- brown hair, hazel eyes, pallid complexion, scars on both legs, heart on right forearm, indistinct marks on left forearm. Absent from 10th instant. Henry E. J. Moore, age twenty- five, height 5 ft. 5Jin., seaman, native of New Zealand, dark complexion, brown hair and eyes. Absent from 9th instant. A reward not exoeeding £ 3 will be paid for the apprehension of each. MISSING. TIMARU.— Since 29th ultimo, Joseph Patrick Cor- coran, age forty- nine, height 5 ft. 10 in., farmer, native of Ireland, fairly stout build, light- brown hair turning grey, blue eyes, closely trimmed and pointed light- brown beard, fairly heavy light- brown moustache; dressed in navy- blue suit and drab- coloured soft- felt hat. He is prohibited under the Licensing Acts, and it is feared he will dispose of his property and desert his wife. Inquiry by his wife, Annie Josephine Corooran, Cave, South Canterbury. RIVERTON.— Since 19th May last, William Thompson, age iseventeen, height 5 ft. 6 in., labourer, native of New Zealand, medium build, dark complexion, brown hair, dark eyes, round shoulders, one left finger crooked, soar on chin ; dressed in dark suit and cap. Criminal Laiu— Bigamy— Evidence— Identification. On the trial of the appellant for bigamy the evidence by the prosecution to prove the first marriage consisted of the marriage certificate, the fact that he cohabited as her husband with the woman he was alleged to have married, and the fact that he spoke of her as his wife. Held, That there was sufficient identification of the appellant with the man who was married to the woman named in the certificate. This was an appeal against conviction on law. Mr. Hoare appeared for the appellant; and Mr. T. P. Perks appeared for the Crown. The appellant was tried at Leeds Assizes before Mr. Justice Horridge on 18th March last on a charge of bigamy, and, being found guilty, was sentenced to twelve months' hard labour. MR. HOARE submitted that the case ought never to have been left to the jury, as there was no evidence that the appellant had been married on the first occasion. The evi- dence against the appellant was a marriage certificate de- scribing him, the fact that he had cohabited with the woman whom he was alleged to have married, and that he spoke of her as his wife. But a marriage certificate was no evidence as to the identity of the person described in it, and cohabitation was no evidence that the parties oohabiting had gone through the marriage service at a particular church on a particular date. He referred to Rex v. Simpson ( 15 Cox Crim. Cas., 323) and Rex v. Lindsay ( 66 J. P., 505), and submitted that to prove bigamy the strictest evidence must be produced, which was not done here. Further, the case was not properly left to the jury. The prosecution were not called upon. MR. JUSTICE COLERIDGE in delivering judgment said that it was essential to prove the real marriage of the appellant with his real wife. The register had been produced proving that she had married a man of the prisoner's name, but that by itself was not enough to prove that the appellant was the man so married. Then there was evidence that the appel- lant had acknowledged the woman as his wife, but that again by itself would not be enough. It was urged that the certificate and acknowledgment coupled with cohabitation were no evidence of identification of the appellant with the man named in the certificate, but the Court could not go so far as that. They thought that though the acknowledg- ment was not evidence of the marriage having taken place on the particular day, it, in conjunction with the cohabita- tion and other facts, was evidence of the identification of the appellant with the man who was married on that day to the woman named in the certificate. J., BRAY AND BANKES, JJ.)— 1ST MAY, 1911.] MORAN AND ANOTHER V. JONES. Criminal Law— Rogue and Vagabond — " Found" upon Premises for Unlawful Purpose— Vagrancy Act, 1824 ( 5 Geo. IV, c. 83), s. 4. S. 4 of the Vagrancy Act, 1824, provides ( inter alia) that every porson " found in or upon any dwellinghouse . . . . for any unlawful purpose " shall be deemed a rogue and vagabond. Held, That to constitute the offence created by those words the accused must be discovered upon the premises doing the acts or things which of themselves constitute the unlawful purpose, but that actual apprehension upon the premises is not necessary. This was an appeal by way of special case from a decision of the Justices of Southampton. Sir F. Low, K. C., and Mr. Valetta appeared for the ap- pellants ; and Mr. S. H. Emanuel appeared for the re- spondent. It appeared that a man named Englander, who was travel- ling to America by way of Southampton, stayed for a night on the way at the Terminus Hotel at Southampton Docks The appellant Moran and the other appellant, one Devine, came into the hotel office at the same time as Englander and said they also might require a room for the night. Moran then gave his name as Gordon. During the evening the appellants had a number of drinks with Englander, and a chambermaid saw them in his room Tbey did not sleep at the hotel, but went to another hotel in Southampton, where they asked to be called at 5.30 a. m., saying they were going to America. They did not go to America, but were traced to Bournemouth and were there arrested, having in their possession a number of dollar bills which were alleged to be the property of Englander. They were prosecuted under 5 Geo. IV, c. 83, section 4, for having been found on premises for an unlawful purpose, and were convicted. SIR F. Low now contended that there was no evidence of any unlawful purpose, and also that the appellants were not " found" anywhere until their arrest at Bournemouth, where they were doing nothing wrong. He referred to R. v. Howarth ( 1 Moo. C. C. 207) ; Griffiths v. Taylor ( 2 C. P. D., 194); Clark v. The Queen ( 14 Q. B. D., 92) ; and Horley v. Rogers ( 29 L. J., M. C.. 140). MR. EMANUEL, for the respondent, referred to Kirkin v. Jenkins ( 32 L. J., M. C., 140), and submitted that the words in the Act " being found on premises " simply meant " being proved to have been on " the premises for the purpose of committing a felony. SIR F. Low, in reply, submitted that that construction would take all meaning out of the word " found," and if it were right a man on his own premises with an unlawful pur- pose would be a rogue and vagabond within the Act. The Act was obviously intended to prevent persons skulking about the premises of other persons. The word " found" in the Act must mean " found and apprehended " on the premises. At the conclusion of the argument, which took place on the 7th April, the Court reserved judgment. The LORD CHIEF JUSTICE, in the course of his judgment, which was delivered to- day, after stating the facts, said there was no evidence of the circumstances under which either of the defendants became possessed of the money except that it was not handed over by Englander in respect of gaming or other debts. They were not charged under section 4 of the Act of George IV until the 21st December. In his opinion the words " found in or upon any dwelling- house, warehouse, coach- house, stable, or outhouse, or in any enclosed yard, garden, or area for any unlawful purpose " ought not to be construed too strictly, and if a charge had been made against the defendants under that seotion on the night of the 11th, or on the next day, the fact that they were not arrested until late the following afternoon would not, in his judgment, prevent the Magistrates from convict- ing. On the other hand, there was not, in his opinion, any evidence that they were supposed on the 11th to have been in or upon the dwellinghouse for any unlawful purpose. It was to be noted that section 6 of the same Act gave any person a right; to apprehend a person so found offending without warrant, and to take him before a Justice of the Peace ; and his Lordship's present view was that there must be a charge brought against the accused of an offence under the section in respect of which he is tauen before the Justice, and the Act did not contemplate such a charge being pre ferred after a considerable interval of time, and particularly after he had been arrested upon another charge, and was not originally arrested on suspicion of an offence under the section. This view was supported by the decision in the case of Rex v. Howarth ( supra). For these reasons he thought the appeal must be allowed, and the conviotion quashed. MR. JUSTICE BRAY, on reading the judgment of Mr. Justice Bankes, said he desired to adopt it. The answer to the question whether the Justices have come to a correct decision in point of law depends, said his Lordship, on what is the true construction to be put upon the words of the section under which the appellants were charged and which defines the offence as " being found in or upon any dwellinghouse, warehouse, coach- house, stable, or outhouse, or in any enclosed yard, garden, or area for any unlawful purpose." In order to be found upon premises a person must be upon those premises, and the offence, there- fore, consists in being upon premises for an unlawful pur- pose and being found there. It is not, in my opinion, suffi- cient for a person to be upon the premises for an unlawful purpose unless he is also found there. What constitutes a finding within the meaning of the section ? The simplest case would be a case of apprehension upon the premises. Actual apprehension upon the premises is, however, in my opinion, not necessary to constitute the offence. I think that there may be many cases in which a person is found upon^ the premises within the meaning of the section although he is not apprehended until after he has quitted the premises. To constitute the offence a person must, in my opinion, be discovered upon the premises doing the acts or things which of themselves constitute the unlaw 326 N E W Z E A L A N D P O L I C E G A Z E T T E. It may be that evidence is admissible of what a person did before he entered the premises or after he left them to explain the nature of the acts or things which be was discovered doing upon the premises themselves ; such evidence must, however, in my opinion, be strictly confined to this purpose. In my opinion there was no evidence before the Justices upon which they could properly come to the conclusion that these acts by themselves or as explained by the previous or subsequent conduct of the appellants ( so far as it was admis- sible in evidence) constituted an unlawful purpose, aud for these reasons I come to the conclusion that the appellants were not found upon the hotel for an unlawful purpose and that the case must, therefore, be remitted to the Justices with a direction to that effect. The appeal was accordingly allowed, with costs, aud the conviction was quashed, the Lord Chief Justice saying it was unnecessary that the case should be remitted to the Justices.
