XT OTICE.— For instructions as to the manner in which 1-' reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. • WHANGAREI.— 4th April last, on warrant of commitment to Mount Eden Prison for seven days in default of paving £ 1 8s. 6d fine and costs for furious driving, Charles Barker, aga twentv- seven, height 5 ft. 7J in., miner, native of New Zealand, medium build, fresh complexion, fair hair, blue eyes ; generally dressed in light- coloured suit and hard hat. AUCKLAND.— 19th ultimo, on warrant for theft of three registered let ers, the property of the Postmaster- General, and of the total value of £ 5, from the post- office at Runci- man, Stewart Good, age twentv- one, height 5 ft. 5 in., labourer, native of Australia or New Zealand, fair curly hair, clean- shaved, finger- nails bitten, full- rigged ship on one arm and " Stewart " and sailor girl on other arm. Of- fender was a guest of the Postmistress, and assisted her to make up the mail by which the stolen letters should have been forwarded to Auckland. AUCKLAND — 1st April last, on warrant of commitment to Mount Eden Prison for forty- eight hours in default of paying 13s. fine and costs for threatening behaviour, Jesse Beadle, age twenty- one, height 5 ft. 9 in., sailor and trimmer, native of England, slim build, fresh complexion, dark hair, hazel eyes, clean- shaved, anchor on right arm, rose ar. d ship on left arm. Offender left by the s s. " Kai- koura " for London on 3rd May last, and will probably re- turn by the same steamer, which is due to arrive at Dun- edin about 23rd December next. AUCKLAND.— 1st March last, that he may be served with a summons for a breach of bis prohibition order, Henry McMahon, age thirty- five, height 5 ft. Tin., sailor, native of New Zealand, strong build, dark complexion and hair, brown eyes, dark- brown moustache ; generally dressed in dark suit and hat. QUEEN STREET WHARF ( AUCKLAND). — 26th ultimo, on warrant for deserting the s.. s " Paparoa," William W. Scarff, age twenty- four, height 5 ft. 3 in., general servant, native of England, auburn hair and moustache, blue eyes, one front tooth missing, bandy- legged ; dressed in dark- brown suit and tweed oap. QUEEN STREET WHARF ( AUCKLAND). — 26th ultimo, on warrant for deserting the s. s. " Paparoa,'' G. Lister, age twenty- five, height 5 ft. 8 in., trimmer, native of England, fair curly hair, clean- shaved, swinging gait; dressed in dark suit and bard hat. PAPAKURA. - T. Bentley, wanted on warrant for false pretpnces : It has been ascertained that offender is identical wi'h William B. Willoughby, alias Tom Whiteley, alias Charles William Riley, alias Eli, referred to in Police Gazette, 1909, page 25. ( See Police Gazette, 1911, page 285.) PAPAKURA.— 26th ultimo, so that she mav be compelled to support her son, Amy Martyn, or Cottle, age thirty- five, height 5 ft. 3 in., cook, supposed native of New Zealand, dark complexion, hair, and eyes. She was la* t heard of at Auck- land, about two years ago. Inquiry by the Secretary of Education, Wellington. THAMES.— 10th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegitimate child, Harry Rouse, age about twenty- three, height about 5 ft. 6 in., labourer, native of New Zealand, medium build, brown hair, grey eyes, clean- shaved; dressed in dark suit and white boater hat. [ JUNE 2L OPOTIKI.— 19th September, 1910, that he may be served with a summons for failing to provide for the maintenance of his illegitimate child, Donald Pye, age forty, height 5ft. 11 in., labourer, native of New Zealand, slight build, fresh complexion, fair hair, blue eyes, sharp features, fair moustache only ; fond of drink. Offender is said to have been seen recently at Onehunga. Complainant, Ivy Gardiner. STRATFORD.— 13th ultimo, that he may be served with a summons for deserting bis wife, Cora Evelyn Jeffrey, Lewis Stephen Jeffrey, age twenty- two, height 5 ft. 8 in., labourer, native of New Zealand, slight build, fair com- plexion and hair, scar on left ear, left ring- finger crooked ; dressed in light- coloured striped - tweed suit, and cap. Offender is said to have oome to Wellington, and may seek employment on a steamer. PALMERSTON NORTH.— 27th ultimo, on warrant for fail- ing to provide his wife, Annie Haddon Curtis, with adequate maintenance, William George Curtis, age thirty- seven, height 5 ft. 5in. or 6in., sheep- farmer and drover, native of New Zealand, medium build, dark complexion and hair ( bald), olean- shaved. Photograph filed in the Inspector's Offioe, Wanganui. Offender was last heard of at Dannevirke, where his brother- in- law, Frank McKenzie, resides. WELLINGTON.— R. Smith, wanted on warrant for false pretenoes on Frederick Dobson: It has been ascertained that offender is not identical with Robert Barker, whose apprehension is notified in Police Gazette, 1911, page 286, and also in this issue of Gazette. ( See Police Ga- zette, 1911, page 214.) WELLINGTON.— 13th March last, on warrant of com- mitment to Auckland Prison for fourteen days in default of paying £ 9 12s. arrears on a maintenauce order for the support of Lyndia Holt, Jessie Holt, age thirty, height * 5 ft. 5 in., prostitute, native of America, stout build, dark- ifreckled complexion, dark- brown hair, brown eyes, small tose. ( See Police Gazette, 1908, page 489.) Offender was last Beard of at Auokland. BLENHEIM.— 3rd May last, on two warrants of commit- ment to Picton Police Gaol for seven days on each in default of paying £ 1 10s. and £ 2 14s. 9d. respectively for ( 1) breach his prohibition order and ( 2) breach of the peace, Michael alias John Buckley, alias McWilliams, age twenty- five, height 5 ft. 7Jin., labourer, native of New Zealand, medium build, fair complexion, brown hair, blue eyes, large nose ; slouohing gait; dressed in dark- tweed suit and soft hat. ( See Police Gazette, 1911, page 260.) Offender is sup- posed to have gone to Southbridge, Canterbury, where his relatives reside. BLENHEIM. — Charles Colin Wilkins, wanted on warrant for false pretenoes : It has been ascertained by the Tasmanian police that offender wrote from some New Zealand address to his parents, asking for financial assist- ance to enable him to return to their home. The letter was received on 9th ultimo, and the request contained therein was refused by his father, who is possessed of considerable means. ( See Police Gazette, 1911, page 232.) ( F. P. B. 254/ 11.) WESTPORT.— 14th ultimo, on warrant for failing to pro- vide his wife, Alioe Ann Fletcher, with adequate maintenance, William Joseph Fletcher, age thirty- two, height 5 ft. 8 in. or 9 in., miner and labourer, native of New South Wales, medium build, sallow complexion, dark- brown hair, clean- shaved, growth near one ear; dressed in navy- blue suit and black hard hat. REEFTON.— 11th May last, that a distress warrant may be executed on him in default of paying 17s. ' fine and costs for being found on licensed premises during prohibited hours, Peter McCormick, age about twenty- seven, height 6 ft., miner, supposed native of New Zealand, strong build, dark complexion and hair, brown eyes, clean- shaved, stoop- ing shoulders, slovenly gait; dressed in dark clothes and cap. CHRISTCHURCH.— John William Higgins, wanted on provisional warrant for deserting his wife : It has been ascertained by Detective Gibson, Christchurch police, that offender has assumed the name Walker, and may have gone to Auckland. CHRIBTCHURCH.— 27th ultimo, on warrant for failing to oomply with a maintenance order for the support of his wife and children, James Kenneth Julian, age thirty- four, height 5 ft. 10 in., ex railway- guard, native of New Zealand, inclined to stout build, olive complexion, dark curly hair, hazel eyes, supposed clean- shaved; fond of drink ; dressed in navy- blue suit. Offender is supposed to have gone to Otira. Arrears to 20th ultimo, £ 64. CHRISTCHURCH.— 4th April last, on warrant for failing to provide his wife and five children with adequate means of maintenance, John Stanley, age fifty- one, height 5 ft. 3 in., tailor, native of New Zealand, stout build, pale complexion, fair hair, blue eyes : dressed in dungaree trousers, old grey- check tweed coat, Crimean shirt, and black hat. Offender was last heard of at Westport on 1st ultimo. Complainant, Margaret Stanley, 319 Tuam Street ( See Police Gazette, 1911, pages 185 and 274.) RANGIORA.-— 2nd May last, on warrant for failing to provide his wife and child with adequate maintenance, Andrew Ross Anderson, age about forty- three, height 6ft. 1 in., farmer, native of New Zealand, medium build, sallow complexion, heavy fair moustache only, slightly stooping gait; dressed in brown- tweed suit. Offender sold his farm at Sefton about the end of April last, and is supposed to have gone to Sydney. Complainant, Catherine Anderson, care Mrs. Cassells, South Dunedin. APPREHENSIONS, PERSONS FOUND, ETC. AUCKLAND.— Robert Barker, issuing a valueless cheque to Maurice O'Connor, has been arrested by Sergeant R. Lanigan, Newton police. ( See Police Gazette, 1911, pages 213, 231, and 268.) AUCKLAND. — John Kingsley Wall, deserting s. s. " Otaki," has been arrested by Detectives Kemp and Ham- mond, Wellington polioe. ( See Police Gazette, J1911, page 45.) NEWTON.— R. J. P. Ogsden, false pretences, has been arrested by Detective- Sergeant James Mcllveney and De- tective James Powell, Newton and Auckland police. His correct name is Charles Fancis Jordan. ( See Police Gazette, 1911, page 285.) HAMILTON.— Robert Barker, false pretences on Allen McDonald, has been arrested by Sergeant R. Lanigan, New- ton police. ( See Police Gazette, 1911, pages 213, 231, and 286.) TAUPO.— Wharematangi, incest, has been arrested at Ruatoki by Constable T. J. Cummings, Whakatane police. ( See Police Gazette, 1911, page 261.) TE KARAKA.— Edward Bowler, drunk in a railway- carriage, has been served with a summons by Constable T. Moriarty, Gisborne police. ( See Police Gazette, 1911, page 241.) OTAKI.— Thomas Clark, failing to comply with a main- tenance order, has been arrested by Constable J. McLeod, Coalgate police. ( See Police Gazette, 1911, page 262.) WELLINGTON.— James Glendinning Aitken Logan, deserting s. s. " Turakina," has been arrested by Sergeant Ryan and Acting- Detective Carney, Lyttelton police, on in- formation supplied by Constable Nuttall, Westport police. ( See Police Gazette, 1911, page 38.) DENNISTON.— David Drummond, alias Dan Daley, disorderly behaviour while drunk, has paid the fine and oosts to Constable Maurice Ryan, Reefton police. He was located on information supplied by Constable Simpson, Dennieton police. ( See Police Gazette, 1911, page 286.) CHRISTCHURCH.— Allen James Dix, theft from William Garrard, is under sentence in Wellington Prison ( see Police Gazette, 1911, page 291), and will be brought before the Court on this charge at Christohurch on 5th instant. He was located by Detective Rawle, Wellington police. ( See Police Gazette, 1911, page 254.) CHRISTCHCRCH. — Patrick McGinn, drunkenness, has paid the fine and costs to Sergeant David Jackson, Christ- ohuroh police. SOUTHBRIDGE.— James Miller, breach of the peaoe, has paid the fine and costs to Constable Goulding, Culverden polioe. ( See Police Gazette, 1911, page 214.) PROPERTY STOLEN. AUCKLAND.— Between 23rd May last and 12th ultimo, from a passage in the premises of Johnson and Sons, Vulcan Lane, the property of ISAAC JAMES ELLISON, manager, a gentlemen's 22 in. frame red- and- gold- lined blaok- enam- elied Coventry bicycle, " Made in England " in gold letters on front, back- wheel rim- brake and mud- guard, plated rims, carrier on back ; value, £ 8. Identifiable. AUCKLAND.— 30th May last, from a paddock at Kingsland, the property of HARRY CHRISTIAN HANSEN, contractor, the thoroughbred Regal- Outcast bay gelding Rocket, 5 years old, 15J hands high, white star on face, four white hocks, dark mane and tail, wire- mark on off front hock, clipped trace- high ( unfinished near rump), and wearing a rug with " Wingate & Co., Ironmongers, Auckland," branded thereon ; value, £ 200. Identifiable. NEWTON.— 10th ultimo, from a Grey Lynn tram- car, the property of BERTHIA SMITH, Percival Parade, Ponsonby, a black- leather purse, containing a cheque for £ 10 drawn on the Bank of New Zealand, Auokland, by Peter A. Smith in favour of Mrs. Peter Smith ; a bar- pattern greenstone brooch, with fern- leaf in centre, and gold- mounted at each end; a set of diamond- and- shield- shaped sleeve- links; two sovereigns; and 8s. 6d. in silver coin : total value, £ 14 13s. 6d. Identifiable, except gold and silver coin. PARNELL.— 13th ultimo, the dwelling of PROFESSOR SYDNEY LAMB, Cleveland Road, was broken into, and the following articles stolen therefrom : An oval- shaped gold locket, with " E. N." engraved on inside; a fetter- and- reef- knot- and- two- oval- pattern gold muff- chain ( see Illustration No. 28) ; and a small reef- knot- pattern muff- chain: total value, £ 1 15s. Identifiable. Suspicion is attached to a Man ( name unknown), who was seen leaving the premises. Description: Age about thirty- five, height about 6ft., slim build, reddish face, and dirty appearance. TOKOMARU BAY. — 24th ultimo, the shop of PETER BROTHERSTONE, Waima, was broken into, and tbe following stolen therefrom : £ 35 in £ 1 bank- notes, a £ 5 bank- note, and an order on the Tokomaru Farmers' Com- pany ( Limited) for £ 1 4s. 6d. drawn by G. Ryland and H. Fairley in favour of Mrs. Keeper ; total value, £ 41 4s. 6d. Order only identifiable. GISBORNE.— 23rd ultimo, the office of the . WESTPORT COAL COMPANY, Childer's Road, wan broken into, and a demand draft for £ 100 on the Bank of New Zealand, signed " Westport Coal Company, per W. F. lies," stolen there- from. Identifiable. GISBORNE.— About March last, from a paddock near Childer's Road, the property of CLARA MILLER, a bay carriage- mare, 6 years old, 15 hands high, branded " T D " on shoulder, white hind hocks ; value, £ 16. Identifiable. WAITARA.— Between 23rd and 25th ultimo, from the launch of WILLIAM SAMPSON, settler, a 1- horse- power two- cycle Auto- Marine oil- engine, " I. H. R." on cylinder, weight about J cwt. ; value, £ 25. Identifiable. It is suspected that some Person on the s. s. " Claymore," which left Waitara for One- hunga via Kawhia and Raglan on 24th ultimo, may have taken the stolen article. MANAIA.— 24th ultimo, from a coat hanging in the dress- ing- room at the domain, the property of JOHN CLARE- BUNT, horse- trainer, Hawera, a silver hunting keyless en gine- turned Ascott watch, No. 41193; a 9ct. gold double- fetter- and- two- ovals- pattern ohain ; and an old silver watch- case, with " J. Parkin" engraved thereon: total value, £ 18 2s, 6d. Identifiable. WOODVILLE.— 26th ultimo, from the shop of W. B. WATSON, cycle- dealer, a gentlemen's second- hand black- enamelled 24 in. frame Raleigh bicyole, upturned handles, New Departure coaster hub, rubber pedals ; and a gentle- men's second- hand black- enamelled 24 in. wood- frame Rambler bioycle, upturned handles, red rims, large tire on back wheel : total value, £ 12 10s. Identifiable. Suspicion is attached to two Men ( names unknown). First: Age about twenty- four, height about 5ft. 8in., thin features, clean- shaved, respectable appearance; dressed in dark- grey suit. Seoond : Age about twenty- four, height about 5ft. 6in., clean- shaved, respeotable appearance; dressed in grey- tweed suit and oap. Suspects were seen riding the bicycles in the direction of Ngawapurua. PALMERSTON NORTH.— 23rd ultimo, from a bedroom at the shop of ROBERT AND JOSEPH BARNAS, fishmongers, a black- and- gold- enamelled metal cash- box containing a Post- office money- order issued at Feilding, No. 5599, for £ 8 16s. ; a cheque for £ 3 18s. 9d., drawn on the Bank of New Zealand, Pahiatua, by J. Toon, and dated June, 1911; a cheque for £ 3 7s. 9d., No. 560039, drawn on the Bank of New Zea- land, Palmerston North, by Thomas Henry Whitehead, and dated 19th June, 1911; a postal note for 10s. 6Jd. ; a Bank of New Zealand £ 5 note ; and £ 31 5s. 6d. in notes and gold and silver coin: total value, £ 52 13s. Cheques and money- order only identifiable. Suspicion is attached to William Townsend Ball, age forty- eight, height 5 in. 9in., fish- hawker, native of England, stout build, florid complexion, brown beard and moustaohe turning grey, large protruding blue eyes; dressed in rough grey suit and black hard hat. PALMERSTON NORTH.— 10th ultimo, from outside the Clarendon Hotel, the property of GEORGE BROCK, 102 Ferguson Street, a gentlemen's blaok- enamelled Rudge- Whitworth bicycle, No. 538335, outrigger reversible handles, leather grips, celluloid mud- guards ; value, £ 10. Identifi- able. FOXTON.— 10th ultimo, from a bedroom in the Family Hotel, the property of A. F. COLEMAN, 76 Cuba Street, Palmerston North, a gentlemen's open- face Swiss watoh, No. 24367, owner's name on baok; value, 15s. Identifi- able. CHRISTCHURCH. — 29th ultimo, the dwelling of DAVID WAGHORN, carpenter, Cashmere, was broken into, and a gentlemen's dark- tweed fly- front overcoat, with false pookets, initials " D. W." worked in lining of one sleeve, and Graham, Wilson and Smellie tape- hanger; and £ 1 12s. 6d. in money— total value, £ 3 12s. 6d.— stolen therefrom. Overcoat only identifiable. Suspicion is attached to a Man ( name unknown), who was seen leaving the house with the stolen overcoat in his possession, age about twenty- four, height about 5 ft. 8 in. or 9in., thin build, fair complexion, smart appearance; dressed in dark- brown suit, straw hat, and tan boots. Sus- pect is believed to be identioal with Erwin Steele, alias Edward James Steele, alias Edwin Joyce ( see Police Gazette, 1911, page 282), who was seen wearing a similar overcoat at Christchurch. CHRISTCHURCH.— 18th May last, from a coaoh travelling between Murchison and Inangahua Junotion, the property of MELITA FLANAGAN, Burdekin Hotel, Sydney, a brown- leather Gladstone bag, containing girls' dresses and other olothing, boots, a prayer- book ( indorsed " Melita Flanagan "), an autograph- book, a writing- desk, and a metal watch with steel- chain wristlet ; total value, £ 25. No further descrip- tion available. Identifiable. CHRISTCHURCH.— 19th May last, from Cashel Street, the property of JOHN NICHOLAS FOWKE, dicker, 27 Walpolo Street, Sydenham, a gentlemen's black - enamelled Bell bicycle, No. 272, bolt through handle- bars, steel rims, rubber pedals; value, £ 2 10s. Identifiable. CHRISTCHURCH.— 14th ultimo, from the Zetland stables, Cashel Street, the property of LEONARD AUGUSTUS STRONG, mercer, 43 Aylmer Street, Spreydon, a gentle- men's 22 in. frame black- enamelled B. S. Identifiable. Suspioion is at- tached to Frank Peterson, or Petersen, alias Parker, alias Fitzjohn, alias Fritzjohn, age twenty- two, height 5 ft. 8Jin., fresh complexion, auburn hair, short- sighted, hazel eyes ( wears glasses), mole on right upper arm, pimpled forehead, peculiar shifty expression. INVERCARGILL.— 21st April last, from near the Public Hall, Kennington, the property of ALFRED TUFFERY, labourer, a gentlemen's 24 in. frame black- enamelled Royal Khaki bicycle, No. 2793 or 2794, Brooks saddle, rat- trap pedals, black- celluloid mud- guards ; value, £ 15. INVERCARGILL.— About 23rd ultimo, the business premises of the NEW ZEALAND HARDWARE COMPANY, Dee Street, were broken into, and the following articles stolen therefrom: A set of black opera- glasses ; two sets of pearl opera glasses ; a set of lorgnette pearl opera- glasses ; a set of field- glasses in large tan- leather case ; a black handle brass- mounted magnifying glass ; five old- Englisb- pattern after- noon teaspoons ; a child's fork and spoon, stamped " L. & W., U. The plaintiff in an action for libel subpoenaed a police officer to produce a report to his Department containing information as to the alleged committal of a crime. The Department claimed privilege. Held, That the document was privileged, and the Court would not order its production. ACTION for libel. A question was raised whether a police officer could be examined as to the contents of a document said to be in the hands of the Government, which was in- formation regarding the alleged committal of a crime. The Commissioner of Police filed " an affidavit stating that the Department claimed that the document was privileged from production, on the ground that it was a matter of State which should not be disclosed. J.:— I am of opinion that the Court cannot order the Govern- ment to produce the dooument in their possession. One of the functions of the State is the dealing with crime, and the Police Department is intrusted with the maintenance of law and order and the detection of crime. If this Depart- ment receives a document from any one about a orime being committed, in my opinion tho Department is not bound to produce that document if the head of the Department says it ought not, in the interests of the State, to be produced. An affidavit has been filed making that allegation, and in my opinion it would be oyerruling the usual procedure in many cases that can be cited were I to order that the Government should produce the dooument. If the docu- ment cannot be produced it is clear that secondary evidence of its contents cannot be given : See Odgcrs on Libel ( p. 329). It may be that an injury is done to an individual by preventing him from suing a person who may have been an informer, but the interests of the State are greater than those of individuals ; and it would be, in my opinion, a dangerous thing to say that all information received by the Government regarding crimes oan be made public if a party chooses to sue another, and that the Government oan bo compelled to produce the information they have reoeived. J.)— 31ST MARCH, 1911.] ERICKSON V. CATTANACH. Licensing— Offences— Sale of Liguor by Unlicensed Person— " Sale "—" Quest"— Whether exempted — The Licensing Act, 1908, Sections 19S, 268. The appellant, an unlicensed person, in conjunction with other members of a football club, purchased liquor amounting to £ 8 in value for consumption at a concert. A oharge was made for admission to others than guests. Liquor was supplied at the concert to A, who, in lieu of payment for admission, lent his piano; but there was no evidence that the appellant actually handed the liquor to A. Held,— 1. That there was a sale to A within the meaning of the Licensing Act, 1908 ; 2. That there was a sale by the appellant; and 3. That the transaction was not permissible, as being within seotion 268 of the said Act. APPEAL from a conviction by L. G. Reid, Esq., S. M., at Masterton, for an offence under section 195 of the Licensing Act, 1908. The facts appear from the judgment of Stout, C. J. Pownall for the appellant. Ostler for the respondent. Cur. adv. vult. STOUT, C. J. :— This is an appeal on a point of law from a conviction under section 195 of the Licensing Act, 1908. The facts as stated show that the appellant, along with other mem- bers of a football club, bought alcoholic liquor amounting to £ 8 worth for consumption at a concert. The admission to the concert or entertainment was: to footballers other than guests, 8s. and 7s. 6d. ; to non- members of the club, 5s. The oharge made against the appellant was that he sold liquor to one Percy Richard Kent. It was found by the Magistrate that Percy Richard Kent did not pay 5s. whioh other non- members were paying, but in lieu of such pay- ment he lent his piano. The questions raised are therefore— 1. Was there a sale ? 2. Was there a sale by Erickson? 3. Did the transaction come under section 268 as a permissible transaction? 1. Was there a sale ? I am of opinion that there was a sale. Under the old English Alehouse Act ( 9 Geo. IV, c. 61) the section preventing sales had the words " bartering, ex- changing, or for valuable consideration otherwise disposing of the liquor," & o. In the Euglish Licensing Act of 1872, however, the words " bartering or exchanging " were not inserted. The words, however, in section 3 of the English Licensing Act of 1872 are similar to the terms of our Act, and section 62 of the English Act is similar to our sec- tion 206, and under these two English seotions it has been held that they include the words " bartering or exchanging " : See Paterson's Licensing Acts ( 17th ed. pp. 324 et seq.). In my opinion this was a sale, for good consideration was given by Kent for admission to this concert ; and the Magis- trate has found that any persons who were non- members and who did not pay 5s., or give, as here, an equivalent for the 5s., were not admitted, but were excluded from the entertainment. I am therefore of opinion that it was a sale within the meaning of our Lioensing Aot. See also the decision of the Supreme Court in Mackenzie v. Whitting- ham ( 23 N. Z. L. R. 857, at p. 863), where His Honour Mr. Justice Denniston held that the word " sale" did not require to be a sale within the meaning of the Sale of Goods Act, 1895. In my opinion this was a sale in the strict sense of the term. It was an equivalent given for something else. 2. Was there a sale by Erickson ? Eriokson was one of the proprietors of the liquor : See Graff v. Evans ( 8 Q. B. D. 378). The liquor belonged to the club, and he was a mem- ber of the club though unregistered, and as such he joined with the others in the sale of liquor to various people, and to Kent amongst the number. It is true that he did not actually hand the liquor to Kent, but the officers of tho association did hand the liquor to Kent, and the liquor was there for his use as well as for the use of others. In my opinion this was a sale by Erickson, he being one of the pro- prietors. 3. Did the transaction oome under seotion 268 of the Aot as a permissible transaction ? That section states that " meetings of an association, sooiety, or club bona fide formed for outdoor games and exeroises may supply the 306 N E W Z E A L A N D P O L I C E GAZETTE. [ JUNE 2L members and their guests at the expense of the association, sooiety, or club with refreshments, including liquor." This was not, however, supplying a guest. It was the supplying of a person who bought his right of admission. This being so, the protection afforded by section 268 as an amendment of seotion 267 does not apply, and consequently the law lias been violated. The Magistrate has considered the violation of the law not to be one of the ordinary violations of the Licensing Act by an illicit sale, and has modified the penalty accordingly. I have not to deal with that. The question is whether in point of law the Magistrate's decision was wrong. I am of opinion that his decision was correct in point of law, and that consequently the appeal must be dismissed, with £ 5 5s. costs. Appeal dismissed. Solicitor for the appellant: C. A. Practice — Appeal on B'act from Justices— Admission of Fresh Evidence— Betting with an Infant— Onus of Proof of Bona Fides— The Gaming Act 1908, Section 67. On an appeal on fact from Justices, or a Magistrate sitting as a Justice, the Court is not confined to the evidenoe " given in the Court below, but may hear fresh evidence and fresh witnesses. Where a person is charged with the offence of betting with an infant under section 67 of the Gaming Act, 1908, the statute places upon him the onus of proving ho believed the infant was twenty- one years of age; and in determining the apparent age of the infant the Court will look at the personal appearance of the infant and at what took place on the occasion of the bet. APPEAL from a conviction by S. E. McCarthy, Esq., S. M., a Napier, of an offence under seetion 67 of the Gaming Act 1908, The facts appear from the judgment of Stout, C. J. Dolan for the appellant. E. R. Williams for the respondent. Cur. adv. vult. STOUT, G. J. :— This is an appeal from the Stipendiary Magistrate sitting in the Justices of the Peace Court, and the case really turns on a question of procedure and of fact. The first question as to procedure is whether on an appeal on fact from Justices fresh evidence and fresh witnesses may be called. I stated in the case of Brown v. Bowden ( 2 Gaz. L. R. 374) that I was of opinion that fresh evidence should not bo allowed to be introduced in such appeal cases. It, how- ever, has been the practice to introduce fresh evidence, and there is nothing in the statute prohibiting it: See Poole v. Cooper ( 3 Gaz. L. R. 198.) In this respeot the statute differs from appeals on fact from the Magistrate's Court in its civil jurisdiction. The Supreme Court in dealing with appeals on questions of fact from the Justices' Court, is really carrying out the jurisdiction that is performed in England by Quarter Sessions ; and it has been laid down that in such appeals the Quarter Sessions are not con- fined to the evidence of the witnesses who appeared in the Court below: See Stone's Justices' Manual ( 43rd ed. p. 954). As I have said, it has been the habit to introduce such evidence, and so long as the law remains unaltered I cannot rule that such evidence is improperly introduced. If this is so, then the whole question really turns on one point— namely, whether the appellant proved that he had reasonable ground for believing, and that he did believe, that a certain John Gilbert McDermott, was twenty- one years of age. The onus of proving this affirmatively is cast upou the appellant, who was the accused. The Magistrate held that he had not done so. The question is whether there was evidence on the rehearing sufficient to satisfy the Court that the appellant has done what the statute requires him to do— to prove that he had reasonable ground for believing, and did believe, that McDermott was of full age. It is unnecessary to deal with the question of McDermott's age, beoause the evidence of his mother is sufficient, along with the birth- certifioate, to prove that he was only twenty on the 1st of November, 1910, he being born on the 1st of November, 1890. Even if Mrs. McDer- mott had not given her evidence, I do not know that there was not prima facie evidence that he was only of the age stated. There was his own evidence and the oertifioate of birth produced from the Registrar of Births, and that by our statute is made prima facie evidence. In my opinion, it is prima facie evidenoe of the facts stated in the certificate itself, and the main fact stated in the certi- ficate itself is the date of the birth. However, it is unnecessary to consider that question, as there was the conclusive testimony of the mother. There are two fac- tors that have to be considered in determining the apparent age of McDermott. There is his personal ap- pearance. This is always a most difficult question to determine. Looking at him, I should say that there are many lads in this Dominion who are only eighteen years of age and who look very much as MoDermott looked— that is, he did not look older than many lads whom I know of eighteen years of age. There are some, however, who may be twenty- one and over who do not look older than he looks. The Magistrate apparently, looking at him came to the conclusion that he did not look twenty- one years of age, and I cannot say that he is wrong. If, however, the case rested on that alone I should have great difficulty in coming to a decision on the matter, but I have also to look at what took place on the occasion in question; and the evidence ia, I think, clear, from what, it is admitted, was said in the Court below, from the constable's statement in this Court, and from the action of the appellant, that the appellant was not convinced that the lad was twenty- one years of age. This is what is said to have occurred : The lad MoDermott asked the appellant the price of a horse called " Entente." The appellant replied, " Two to one." McDermott told him to give him a ticket for 10s. The appellant did so. Imme- diately thereafter a constable rushed up and said, " You are betting with an infant." The appellant then shouted out, " No bet." The constable repeated three or four times that it was a bet. The appellant said it was no bet, and handed the money baok to McDermott. This, in my opinion, was an admission that it was apparent that the lad MoDermott was not twenty- one years of age. The explanation he gave for his action was that he had heard that a bookmaker had been caught betting with a boy in the outside enclosure, and that therefore he was determined to be very particular with whom he bet. In my opinion he would not have re- called the bet if he had been convinced in his own mind that the lad was over age. He would have said, " This lad is over age." The constable, when he charged the lad with being under age, did not know his age. He assumed that he was under age; and there was no evidence before the appellant at the time when the constable said he was betting with an infant, but the appearance of McDermott, and yet he at once acquiesced in the constable's statement. I think this was cogent evidence, and, the Magistrate having acted on it, I cannot say he was wrong. This is really the whole case ; and I am of opinion that the appellant has not discharged the onus which, is cast upon him by subsection 4 of sec- tion 67 of the Gaming Act, 1908, and that the conviction must therefore stand. I understand that there has been no charge against the appellant before of this kind of offence. He had, however, been convicted of street betting. This penalty— namely, £ 75 or a month's imprisonment— may have been unusually severe. There have been two cases decided in New Zealand— namely, Searl v. McArdle ( 15 N. Z. L. R. 613) and Taylor v. Marsack ( 17 N. Z. L. R. 153; 1 Gaz. L. R. 130)— in which it has been held that the Supreme Court has no power to mitigate the penalty imposed. It must either affirm or quash the conviction. The appellant may, however, apply to the beneficence of the Crown, and no doubt on proper representations some part of the penalty may be remitted if the facts now before the Court are correct. The conviction must be affirmed, with £ 5 5s. costs, and the costs of the witnesses called on behalf of the respondent. Convictioti affirmed. [ JUNE 2L A football olub held a smoko concert in lioensed pre- mises, having previously obtained the permission of the police to oontinue the entertainment after 10 p. m. on condition that no liquor was consumed after that hour. The appellant, the licensee of the hotel, remained in the room till shortly before 10 p. m., when he was obliged to leave in order to attend to customers in the bar owing to the sudden illness of his barman. Before he left he in- formed the vice- president of the club that no liquor was to be consumed after 10 p. m., and the vice- president undertook to seo that these instructions were carried out. The Magistrate found that liquor had been con- sumed after 10 p. m., and convioted the appellant of an offence under section 190 of the Licensing Act, 1908, of allowing liquor, although purchased before, to be con- sumed on the licensed premises after closing- hours. Held, That the conviction must bo quashed, there being no evidence of knowledge or connivanoe on the part of the appellant. Bailey v. Pratt followed ( 20 N. Z. L. R. 758). COOPER, J.:— The appellant, the lioensee of the New- Zealander Hotel, Wellington, was convicted by the Stipendiary Magistrate, Wellington, on the 17th of August, 1910, upon an informa- tion laid by the respondent charging the appellant with allowing liquor purchased before the hour of closing of the hotel to be consumed on the licensed premises after the hour of closing. The faots stated by the Magistrate are that on the 8th of August the Ramblers Football Club held a smoke concert in the dining- room of the hotel; that prior to that date the representatives of the olub inquired from the Inspector of Police, Wellington, whether the club would be allowed to continue its concert after 10 p. m., and that they were in- formed by the Inspector that so long as the meeting was orderly no proceedings would be taken against any of those present after the hour of 10 p. m. for being on licensed premises without lawful excuse, but that no liquor must be consumed after 10 p. m. ; that the concert commenced at 7.30 p. m., and the proceedings were of an orderly character, and a number of those present were total abstainers ; that the appellant ( the licensee of the hotel) remained for some time in the dining- room where the smoke concert was being held, and intended to remain there until 10 o'clock and after for the purpose of preventing any liquor being con- sumed after that hour ; that 10 gallons of beer and two bottles of whisky were taken into the dining- room before the concert commenced, but no liquor was taken in there afterwards ; that during the evening the appellant was called from the dining- room in consequence of the fact that his barman had taken ill, and had been compelled to leave the hotel and go home, and that it was necessary for some person to go into the bar, and the appellant was the only person available ; that before leaving the room the appellant informed Harry Waters, one of the representatives and the vice- president of the clnb, and a promoter of the concert, of his reason for having to leave the room, and also informed Waters that no liquor must be consumed after the hour of 10 o'clock ; that Waters undertook and promised to see that no liquor was served after that hour ; that the appellant had no servant available, after his bar- man became ill, to station in the dining- room ; that it is the custom for police officers in Wellington to visit the bars of the various hotels in Wellington shortly after 10 o'clook, and it is necessary that immediately after 10 o'clock the bar should be cleaned up and the glasses and bottles removed, and that this work takes half an hour or so to perform, and the appellant on the occasion in question remained in the bar for the purpose of doing suoh work; that at 10.35, just aa the appellant was completing his work- in the bar, Sergeant Kelly and a constable knocked at the door of the hotel, and were at. once admitted; that after inspecting the bar they went into tho dining- room and saw on the table several glass jugs containing beer, and also a number of glassos containing aerated waters and some con- taining beer, and that in some cases there was only a small quantity of beer in tho glasses ; that the police remained a very short time in the room, probably a minute ; that there was no direct evidence of any actual consumption of liquor after 10 o'clock, but Waters stated that the jugs were filled with beer about 9.55 o'olock, and he was not prepared to say that no beer was consumed after 10 o'clock. The Magistrate states that he " held that defendant had left Waters in charge of tho dining- room, and as Waters was unable to say that no beer was consumed between 10 o'clook and 10.35 o'olock, the matters hereinbefore stated afforded no ground of answer or defence to the said information," and he convicted the appellant. The question for the opinion of the Court is whether the Magistrate's determination was erroneous in point of law. Two questions have been argued. The first is whether there was any evidence upon which the Magistrate oould properly infer that liquor had been consumed in the dining- room after 10 o'clock. In my opinion there was. The fact that beer had in fact been poured into the glasses by some of the party just before 10, and that at 10.35 there was some beer remaining in some of the glasses, is evidence that between 9.55 and 10.35 beer had been consumed, and the Magistrate could properly infer from that fact that some beer had been consumed by some of the footballers after 10 o'clock. It is not necessary in order to prove the con- sumption of liquor within the prohibited hours that there should be direct evidence of such consumption. It is suffi- cient if there is presumptive evidence; and here the fact that the vice- president of the club would not state that the beer bad not been oonsumed after 10 o'clock, coupled with the fact that he had permitted it to be poured into the glasses five minutes before 10, and the conditions of the glasses as observed by the police about half an hour after- wards, the smoke concert being then still in progress, is, in my opinion, amply sufficient evidence to establish a prima facie case of consumption within the prohibited hours. The other question is whether the appellant " allowed " the con- sumption of beer after 10 o'clock. The Magistrate has held that, upon the facts found by him, Waters was plaoed by the appellant in charge of the room, and that therefore, as there was evidence from which a consumption of liquor after 10 o'clock could properly be presumed, the appellant " allowed" this consumption. Mr. Ostler has admitted that the facts proved by the Magistrate do not justify any inference that Waters was constituted by the appellant his agent or servant during the appellant's absence from the room, and in my opinion this admission is right. Waters, as vice- president of the clnb and one of the promoters of the concert, may fairly be said to have been in charge of the concert, but the concert was allowed by the express per- mission of the police to be continued after 10 o'clock, sub- ject, it is true, to a condition made with the promoters of the concert that no liquor should be consumed after that hour. The faots do not justify the inference that the appel- lant left Waters as his ( the appellant's) representative in charge of the room, but merely show that the appellant, who was obliged to leave the room, emphasized to Waters the condition on which the police had, at the request not of the appellant but of the representative of the club, allowed the concert to continue. I agree, therefore, with Mr. Ostler that an inference that Waters was representing the appellant cannot properly be drawn, and that Waters was not the agent or servant of the appellant. The only ground urged by Mr. Ostler in support of the conviction is that the Magis- trate must be held to have found that the appellant connived at the consumption of liquor after 10 o'clock by purposely abstaining from returning to the room in order to give the footballers an opportunity to consume beer after 10 o'clock. In my opinion the case as stated shows that the Magistrate did not draw such an inference, and, even if he had done so, the facts found by him could not, in my opinion, support such a conclusion. The Magistrate has found as facts that the appellant had no intention of leaving the room, but that the sudden illness of his barman made it absolutely necessary for the appellant to do so, and he has found as a further fact that the appellant had no person in his employ to take the barman's place or to attend in the dining- room. He has also found as a fact that the appellant, before leaving the dining- room had expressly told Waters that liquor must not be oonsumed after 10 o'clock. Some liquor remained in the room after the appellant left. The hour at which he left is stated to have been " during the evening" and it was evidently some time before 10 o'clook, for he had to take the barman's place, and, according to the Magistrate, he was neoessarily absent until 10.35. 308 N E W Z E A L A N D P O L I C E G A Z E T T E. JULY 12 Now, in Bailey v. Pratt ( 20 N. Z. L. R. 758) Mr. Justice Den- niston, after exhaustively examining the English cases from 1875 to 1899, held that, in order to justify the conviction of a licensed hotelkeeper for " allowing " matters to take place in his lioeused premises which were prohibited during the hours within which the licensed premises were directed to be closed, knowledge or connivance must be proved, and that mere negligence or carelessness will not support the charge, unless such negligence or carelessness is of such a character as to be in itself evidence. Section 190 of the Licensing Act, 1908, under which the present appellant has been convicted, is, so far as regards this charge against him, in the same terms as section 155 of the Act of 1881, which was under consideration in Bailey v. Pratt ( 20 N. Z. L. R. 75S). I have | carefully examined the cases on which His Honour has i based his judgment, and I quite agree with the principle he i has deduced from them, and I shall follow his judgment. Is 1 there, then, any evidence upon which the conviction in the present case can be supported upon the ground that the appellant had been guilty of such negligence or carelessness as amounts to evidence of connivance ? I do not think there is. The appellant was obliged to leave the room ; the Magistrate has found as a fact that he was justifiably absent up to the time when the police visited the hotel, and that he had no intention of allowing a breach of the law to be committed ; and the proved facts show that he did not know that a breach of the law was likely to be committed. The only circumstance from which negligence or carelessness might be inferred is that he did not insist on the liquor being removed from the dining- room. Ho forbade, some time before 10 o'clock, its consumption after 10 o'clock ; and the Magistrate has found that the appellant intended to prevent such consumption by his own personal attendance throughout the concert, but tbat he was prevented from re- maining in the room by circumstances beyond his oontrol. These facts so found by the Magistrate negative any inference that the appellant left the room and abstained from return- ing for the purpose of allowing a broaoh of the law to be committed. Therefore, in my opinion, the mere fact that the appellant did not remove the liquor is not evidence from which any inference can be drawn that he remained out of the room for the purpose of conniving at a breach of the law. I do not think it necessary to refer to the later English cases cited by Mr. Bell, beyond stating that they do not at all narrow the principle which, in my opinion, Mr. Justice Denniston has correctly stated to be the result of the deci- sions of the English Courts up to the year 1899. Mr. Ostler has urged that if this appeal is allowed it will be difficult to enforce the law. I do not agree with this. A simple remedy is that the police shall insist on all entertainments, if held in a licensed house, ceasing at the hour at which the house is directed to be closed.
