NEW I ZEALAND POLICE GAZETTE. PUBLISHED BY AUTHORITY. WELLINGTON, WEDNESDAY, JUNE 7, 1911. NOTICE.— For instructions as to the manner in which reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. AUCKLAND.— Within the space of six months last past, on warrant for failing to provide his wife, Winifred Miles, with adequate means of support, Albert Linden Miles, age twenty eight, height 5 ft. 8 in., clerk, native of Australia, slight build, pale to sallow complexion, blaok hair, heavy dark eyebrows, blue eyes, one gold tooth. He was formerly employed by the International Window- cleaning Company, Grey Lynn. moustache only, large mark on side of face, quick gait; dressed in dark- grey tweed suit and cap. TE KUITI.— 25th January last, on warrant for failing to provide for the maintenance of his illegitimate child, William Green, age thirty, height 5 ft. 6 in., coach- driver, native of New Zealand, medium build, dark com- plexion, hair, and moustache, brown eyes; generally dressed in dark suit and soft hat. He was last heard of at Fairlie, Canterbury, but is supposed to have gone to Australia. Complainant, Patricia Eileen Hallmond. TE KUITI.— 22nd February last, on two warrants of commitment to Mount Eden Prison for forty- eight hours and one month respectively in default of paying £ 4 6s. fine and costs for drunkenness in a railway carriage, and ob- scene language, W. Foster, alias Riley, age thirty- five, height 5 ft. 7 in., labourer, native of Australia, medium build, fair complexion and hair, blue eyes, long nose; untidy appearance ; dressed in dungaree trousers, light- grey coat, and slouch hat. WAIPIRO BAY.— 5th ultimo, on three warrants of com- i mitment to Tolaga Bay Police Gaol for twenty days, seven days, and three days respectively for theft, assault, and refusing to quit licensed premises, Maurice Roach ( ficti- tious), age twenty- eight, height 5 ft. 8 in. or 9 in., labourer, fairly stout build, fair complexion, light- brown hair, clean- shaved, scar on upper lip ; dressed in grey suit, and cap. FREEMAN'S BAY.— 27th ultimo, on warrant for forging and uttering a cheque for £ 3 to Elizabeth Collins, College Road, J. McGill ( probably fictitious), age about thirty, height about 5 ft. 9 in., labourer, native of New Zealand, medium build, fresh complexion, red hair, clean- shaved ; dressed in greenish- brown tweed suit, and much faded white- straw hat. Offender obtained a blank cheque on the National Bank of New Zealand ( Limited), Auckland, filled it in for £ 3, and forged the signature " Winstone, Limited." WAIHI.— 22nd ultimo, that he may be compelled to support his wife, Agnes Donnelly, Edward Patrick Donnelly, age thirty- five, height 5 ft. 8 in., labourer, native of New South Wales, fair complexion, blue eyes, dark hair, clean- shaved ; generally dressed in navy- blue suit and hard black hat. He has a brother at Opotiki. TE AWAMUTU. — 19th ultimo, that a summons may be served on him for a breach of his prohibition order, George alias Scotty Livingstone, age about thirty- five, height about 5 ft. 6 in., painter and signwriter, native of Scotland, medium build, pale oomplexion, dark hair, small fair GISBORNE.— 6th March last, that he may be served with a summons for obtaining liquor on licensed premises by falsely representing himself as being of the age of twenty- one years, Walter Edward Davies, age about twenty, height 5 ft. 6 in., horse- breaker, native of New Zealand, ruddy complexion, fair hair, grey eyes; generally dressed in riding pants and leggings, dark coat and vest, Baden- Powell hat, and American cow- boy spurs. HASTINGS. - 19th ultimo, on warrant for failing to pro- vide for the future maintenance of hi3 unborn illegitimate child, Robert Cochrane Sachs, age about twenty- three, height 5 ft. 10 in., cycle agent, native of England, fairly stout build, fair complexion and hair, one front tooth gold- filled ; seldom wears a hat; generally dressed in a light suit. He left Wellington by the New Plymouth train on 22nd ultimo, and may endeavour to leave the Dominion. Com- plainant, Hilda Mcintosh. INGLEWOOD.— 24th April last, on warrant for deserting his wife, Harriet Eva Greenway, and children, Darcy Bray Greenway, age thirty- six, height 5 ft. 8 in., farmer, native of New Zealand, medium build, brown hair, clean- shaved except moustache, white scar on top of head; dressed in dark- blue suit. He may be accompanied by Ada Bishop, who was formerly in his employ, age twenty- two, height 5 ft. 5 in., dark complexion, and it is supposed they have gone to Australia. WELLINGTON.— 25th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegiti- mate child, Daniel Stanborough, or Stanbury, age twenty- four, height 5 fc. 7 in., labourer and storeman, native of New South Wales, pale complexion, fair hair inolined to be curly, blue eyes, clean- shaved, soar over one eye ; gene- rally dressed in blue suit and hard black hat. He may en- deavour to leave for Sydney. WELLINGTON.— 26th ultimo, on warrant for theft of a kit- bag and wearing- apparel ( recovered), total value £ 15, the property of George Hallam Parkinson, traveller, David Lander, age twenty- seven, height 5 ft. 10J in., flour- miller, native of New Zealand, well built, fresh complexion, rather full face, brown hair, clean- shaved ; dressed in dark clothes, soft shirt, and cap ; fond of drink. Offender had been em- ployed at flour- mills in South Canterbury, and spoke of joining his brother, a carpenter, at Dannevirke. WELLINGTON.— 1st instant, on warrant for deserting the s. s. " Delphic," William Powers, age fifty, height 5 ft. 8 in., engineer's storekeeper, native of Ireland, fair complexion and hair, blue eyes, tombstone on right arm. WELLINGTON.— 29th ultimo, on warrant for deserting the s. s. " Delphic," John Smith, age thirty- five, height 5 ft. 4 in., A. B., native of the Isle of Man, thick- set build, fresh complexion, dark hair, hazel eyes. MOUNT COOK.— 8th ultimo, on warrant of commitment to Wellington Prison for seven days in default of paying £ 2 10s. fine and costs for a breach of the Licensing Act, Jasper Arnold Moran, age twenty- eight, height 5 ft. 3 in., driver, native of New Zealand, medium build, dark com- plexion, brown hair, grey eyes, scar on right cheek, " A." and three dots on left forearm ; dressed in grey- striped suit, and cap. CHRISTCHURCH.— Between 8th and 10th February, 1908, on warrant for theft of an American extractor revolver ( recovered) and other articles, the property of William Garrard, total value about £ 31, Allan James Dix, age twenty- nine, height 5 ft. 6£ in., seaman, native of England, fresh complexion, brown hair, grey eyes, crucifixion and Virgin on breast, crucifixion, A. He was last seen at Amberley, about the middle of May, and said he was going to Waikare. ANNAT.— 20th ultimo, on warrant for obtaining £ 25 from Annie Maria Walsh, draper, Darfield, by false pretences, Harold Jones, age thirty, height 5 ft. 7 in., labourer and carrier, native of New Zealand, swarthy complexion, dark hair turning grey, grey eyes, three fingers of left hand missing. LUMSDEN.— About 11th ultimo, on warrant for theft as a co owner of £ 36 Is. 6d., money of Joseph Jordan, Edward Wollard, and George Harley, contractors, Five Rivers, Robert McDonald, age about fifty- two, height 6 ft. 2 in., labourer and contractor, native of New Zealand, light- brown hair and moustache turning grey, shaggy eye- brows, broad shoulders ; fond of drink ; dressed in dark suit, light- coloured soft shirt, and dark tie. WELLINGTON.— ERNEST ALFRED ANDERSON'S watch has been recovered by Detective Cox and Acting- Detective Sweeney, Auckland police, and traced to the possession of Joseph Thomas Christie. CHRISTCHURCH.— WILLIAM GARRARD'S American ex- tractor revolver has been recovered by Detectives Ward and Gibson, Christchurch police, on information supplied by Constable Scott, Chatham Islands police, and a warrant has been issued for the apprehension of Allan James Dix for committing the offence. ASHBURTON.— JOHN TEMPLETON OLSEN'S five- pointed gold star ( Orange emblem) has been recovered by Detective Cox and Acting - Detective Sweeney, Auckland police, and traced to the possession of Joseph Thomas Christie. (" Times Law Reports," Vol. xxvii, page 330.) [ K. B. Div. ( LORD ALVERSTONE, C. J., RIDLEY AND CHAN- NELL, JJ.) 21ST MARCH, 1911.] THE KING V SOUTH SHIELDS LICENSING JUSTICES ( Ex parte MORRISON.) Licensing Acts— Forfeiture of License— Conviction for selling Liquor without License— Two Convictions at same Time on same Set of Facts—" Second Offence "— Licensing Act, 1872 ( 35 and 36 Vict., c. 94), s. 3. The appellant, who held an off- license for the sale of beer, was summoned under section 3 of the Licensing Act, 1872, for two offences— viz., for having sold beer where ho was not authorized to sell it, and also for having, at the same time and place, exposed beer for sale. The two sum- monses were heard together, and, as the evidence on each was the same, the appellant's counsel consented to their being dealt with simultaneously. The appellant was oon- victed and fined on each summons. At the next general licensing sessions the appellant applied/ for a renewal of his license, which, however, the Justices refused on the ground that the license had, under section 3 of the Act of 1872, been forfeited, inasmuch as the appellant had been convicted twice for offences against the section. 256 N E W Z E A L A N D P O L I C E GAZETTE. [" APRIL 26 Held, That the Justices were wrong in so holding, inas- much as a second offence within the section means an offence committed after a previous conviction. IN this case a rule had been obtained calling upon the Justices of South Shields to show cause why a mandamus should not issue to compel them to hold an adjourned meetiDg to bear and determine an application by one Morrison for renewal of an off- license to sell beer. Mr. Inskip appeared to show cause ; and Mr. Scott Pox, K. C., and Mr. C. E. Jones appeared in support of the rule. MR. INSKIP, in opening the case, said the question was whether one of two convictions which took place at one and the same time in consequence of one and the same set of facts could be considered a subsequent conviction to the other. The appellant had heid an off- license for the sale of beer, and at the General Licensing Sessions on the 8th February last he applied for a renewal of it. No notice of objection had been served on him, so the appellant need not have attended the meeting. He did, however, attend, and the police informed the Justices that he had been convicted twice in respect of offences under the licensing law, and that therefore his license had been forfeited, and there was nothing to renew. The Justices thereupon refused a renewal, holding that as the license had been forfeited by operation of law the appellant should have applied for a new license if he had wished to make any application at all. The facts on which their refusal was based were as fol- lows. The appellant was in the habit of hawking beer. On the 16th November, 1910, he was summoned under sec- tion 3 of the Licensing Act, 1872, for two offences, for having on the 4th November sold beer at three places where he was not authorized to sell it, and also for having at tho same time and at the same places exposed beer for sale. The two summonses were beard together at Newcastle, and as the evidence on each was the same the appellant's counsel con- sented to their being dealt with simultaneously. The appel- lant was convicted on both charges and was fined £ 5 and costs on each. The appellant did not appeal against either conviction. Counsel then contended that, reading the plain language of section 3, one must say that there had been two convictions, one of them subsequent to the other. Two separate informations had been served on the appellant, and so his attention had been called to the fact that he was being charged with distinct offenoes. Neither information referred to the offence with which it dealt as arising after a previous conviction, but there was no statutory requirement that it should do so. MR. SCOTT Fox, in support of the rule, submitted that the words in the section " the second offence " must mean an offence committed after a previous conviction on a similar charge. In this case he would not deny that there had been two distinct offences in fact, but neither of them was a second offence within the meaning of the section. On general principles a second offence was not in law a second offence unless there had already been a previous conviction ( Maxwell on Interpretation of Statutes, 1905 Edition, p. 225 ; Coke's Institutes, Part II, p. 468, § 5). And the particular provisions of this Act showed that that was the true construc- tion, for by section 56 when a tenant of premises was con- victed of an offence such as those now in question notice had to be sent to the owner of the premises ; and the object of that, no doubt, was that the owner might have an opportunity of getting rid of an undesirable tenant before he was convicted a second time. The LORD CHIEF JUSTICE said that the rule must be made absolute. They would express no opinion on the point as to whether there could properly be a conviction for selling and also one for exposing for sale on the same facts. The remarks of Lord Blackburn in Weymss v. Hopkins ( L. R. 10 Q. B., at 381) would have some bearing on the point, but they wished to guard themselves from expressing any view now. The question in this case was whether the Justices were right iu treating the appellant's license as void, when they bad before them two convictions with nothing to show that either was a second conviction and knew that both convic- tions had been obtained at the same time. Section 3 of the Act of 1872 had been repealed but was substantially re- enacted by section 65 of the Licensing Act, 1910, and they had to consider what was the true meaning of the words " in the case of a second offence " there contained. In his view it would be impossible to work the subsections of the Bection unless the words " second offence " and " subsequent offence " were construed to mean offences committed after a previous conviction. It was true that a conviction was not mentioned, but it seemed to him that the statute aimed at repressing repeated and persistent breaches of the law, and could not logically be construed in any other way. Therefore, apart altogether from the weighty authority which had been quoted, he had no hesitation in saying that in this particular statute a second offence meant an offence committed after a previous conviotion. Subsection 3 of section 65 of the Act of 1910 provided that on conviction for a second offence the license should be forfeited, and by the automatic operation of law the second conviction had the serious effeot of depriving a license- holder of his means of living. The for- feiture subsection ought therefore to be oonstrued strictly. It was argued for the Justices that as they had had two convictions before them and one must necessarily have pre- ceded the other, they had hai cognizance of a " second" offence and were not bound to inquire further; but the Justices ought to have first construed the section in its true sense.
