J., COLERIDGE, AND HAMILTON, JJ.)— 13TH FEBRUARY, 1911.] REX V. CHARLES GOODSPEED. Criminal Law — Verdict — Conviction as Accessory before Fact to a Burglary and of receiving— Inconsistency. The appellant was convicted of being accessory before the fact to a burglary and of reoeiving the stolen goods. Held, following Reg. v. Hughes ( Bell's Crown Cases, 242), that there was no inconsistency in the verdict. THIS was an appeal against conviction and sentence. Mr. A. S. Carr appeared for the appellant ; and Mr. H. T. Wright appeared for the Crown. The appellant was convicted at the Central Criminal Court on the 16th January last of beiDg accessory before the fact to a burglary and of receiving the stolen goods. A report of the proceedings in the Court below appeared in The Times of the 17th January. 226 N E W Z E A L A N D P O L I C E G A Z E T T E. [" APRIL 26 Mr. CARR, in opening the appeal, said it arose out of the burglary whioh was committed at St. George's Cathedral, Southwark. The only evidence against the appellant was his own statement, that he had promised to go with other men who committed the burglary, but that in the end he had not gone, and a statement by a police officer that after the burglary he had offered the stolen goods for sale. He was convicted of being an accessory, and also of being a receiver in respect of the same theft. He was not indicted as an accessory, but as a principal, and the verdict could not stand. ( R. v. Coggins, 12 Cox C. C.. 517.) Mr. WRIGHT, interposing, said that the case was covered by R. v. Hughes ( Bell's Crown Cases, 242). MR. JUSTICE COLERIDGE said the appellant had been charged with burglary and with receiving, and had been found guilty of being an accessory before the fact and of receiving. The case of R. v. Hughes ( supra) showed that a verdict in such a form could stand ; by statute an accessory could be charged as a principal. There was ample evidence to sustain the charge of being an accessory. As to his having been a receiver the evidence was more doubtful, but it was unnecessary to go into that. The appeal must be dismissed.
