NEW ZEALAND POLICE GAZETTE. PUBLISHED BY AUTHORITY. WELLINGTON, WEDNESDAY, APRIL 19, 1911. VT OTICE.— For instructions as to the manner in which ' reports are required to be furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. AUCKLAND. — 10th December last, on warrant of com- mitment to Auckland Prison for seven days in default of pay- ing £ 2 10s. fine and costs for a breach of his prohibition order, Nicholas Charles Edwards, age forty - five, height 5 ft. 10 in., eleotrician, native of New Zealand, medium build, dark hair, pale complexion, blaok heavy moustaohe, grey eyes, long thin faoe ; smart appearance ; generally wears a dark suit; addicted to drink. AUCKLAND.— 31st December last, on warrant for theft of £ 34 8s. 7d., the money of Sharp Bros., cordial- manufac- turers, Percy Cowdery, age twenty- six, height 5 ft. 10 in., collector and traveller, native of Australia, dark hair, grey eyes, heavy jaws; generally wears sac suit; hesitating manner when speaking ; good boxer and billiard- player. He was formerly with Sharp Bros, in Christchurch. He is sup- posed to have gone to Sydney, where his mother resides. OSender was employed by the above firm, and collected the amounted and appropriated it to his own use. AUCKLAND.— 20th January last, on warrant for failing to provide for the maintenance of his wife and child, Hugh Thorn, age. thirty- four, height 5 ft. 7 in., labourer, native of New Zealand, medium build, fair hair and complexion, small blue eyes, long face, lantern- jaws, bad teeth. On the above date he was in arrears £ 4 lis. ( See Police Gazette, 1910, pages 371 and 424.) AUCKLAND.— 30th ultimo, on warrant for theft of a pair of brown tweed trousers with green stripe running through the material, and a sao coat, value £ 3, the property of Robert Pryde, farmer, Frederick Johnson, alias Shiels, age forty, height 5 ft. 9f in., blacksmith, native of Ireland, stout build, brown hair, blue- grey eyes, nose has been broken, has impediment in speech, clean- shaved except moustaohe ; fond of drink. He will probably be found working at his trade in some up- country distriot. ( See Police Gazette, 1910, page 512, and Photographs of Persons discharged, 1911, page 2.) AUCKLAND.— 16th ultimo, on warrant for theft of 15s., the money of Herbert Paul, Empire Art Studios, Thomas Wilson, age about thirty, height 5 ft. 8 in., canvasser and barman, medium build, fresh complexion, soar on right side of face, blue or grey eyes ( inclined to be weak), may have a short red moustache ; dressed in faded green- check suit, turned- down linen collar, and straw hat; fond of drink. He was employed by complainant as canvasser and collector, and appropriated the money to his own use. Numerous other charges pending. ONEHUNGA.— Man ( name unknown), wanted on warrant for theft of a bicycle, the property of Arthur Taylor. The Old Standard bicycle offender left behind him has been identified as the property of George Morris, and was stolen from him at Newton on the 30th ultimo. ( See Police Gazette, 1911, page 163.) ONEHUNGA.— 24th ultimo, on warrant for theft of a saddle, value £ 1 15s., the property of Clive Holloway, Selwyn 8treet, Onehunga, Man ( name unknown), age about twenty- two, height about 5 ft. 6 in., clean- Bhaved, dark com- plexion, rather full faoe ; dressed in navy- blue coat, riding- pants, leggings, and felt hat. The saddle was sold by offender to Lediard and Kingsford, saddlers, Auckland, for 15s., on the 24th ultimo. Offender is supposed to be identi- cal with John Henry Heath. ( See preoeding paragraph, and Police Gazette, 1911, page 163.) DARGAVILLE. — 24th ultimo, on warrant of commit- ment to Auckland Prison for one month in default of paying £ 5 13s. fine and costs for breach of his prohibition order, William Hagan, age thirty- eight, height 5 ft. 6 in., labourer, medium build, long sandy moustache, flushed faoe; usually wears dark suit; talks in a loud voioe. He was last seen in Whangarei. DARGAVILLE.— 23th ultimo, on warrant of commitment to Auckland Prison for one month in default of paying £ 5 13s. fine and costs for breach of prohibition order, George Clark, age forty- two, height 5 ft. 5 in., tailor, native of Scotland, stout build, fair complexion and hair, sandy moustache ; usually wears dark- tweed suit and cap. 174 N E W Z E A L A N D P O L I C E GAZETTE. [* APRIL- 5 RAURIMU.— 24th March last, on warrant for theft of a horse, saddle, and bridle, the property of Thomas Tylee, settler, value £ 7, Man ( name unknown), age about thirty, height about 6 ft., supposed sailor or engineer, strong build, dark hair and complexion, clean- shaved, eyebrows very high on forehead ; dressed in dark suit, short leggings, elastic- side boots, and light- felt hat. He stated that he was an engineer, and had been employed at Waihi, and that he had cleared out from Wirth's Circus, and also said that he had been a sailor. Offender sought for and obtained work from the com- plainant, who gave him the horse, saddle, and bridle, and a note to deliver to the storekeeper at Kaitieke, which he failed to do, and was last seen riding towards Tokaanu. The horse has been recovered, wandering on the Waimarino Plains, without the saddle and bridle. NEW PLYMOUTH.— 3rd instant, a warrant for forging and uttering a cheque for £ 8 to William Fenwiok MoAllum, proprietor, Cofiee- palace, A. McLeod, age about fifty, height about 5 ft. 5 in., has the appearance of a labourer, medium build, grey hair, grey moustache ; dressed in dark sac suit, and greenish- coloured Alpine hat. He is probably identical with David alias David Alexander McLeod. ( See Police Gazette, 1910, page 35.) On the above date of- fender arranged to stay for ten days at the Cofiee- palace, and was informed the bill would be £ 2. He then gave com- plainant the above cheque on the Bank of New Zealand, Waitara, drawn in favour of A. McLeod, and purporting to be signed by Robert Rolfe, for whom he said he had worked, and had received the cheque as wages. As complainant re- fused to accept the cheque, offender borrowed £ 3 from oom- plainant, and left the cheque as security, and has not been seen since. HAWERA.— 5th August last, on warrant for deserting his wife, Minnie Johanna Hawkins, and leaving her without means of support, Francis Hawkins, age thirty- two, height 5ft. 7 in., labourer and carpenter, native of New Zea- land, sallow complexion, dark- brown hair, dark moustache only; generally wears dark- tweed suit and hard black hat, He may be accompanied by a girl three years old. He was seen in Wellington in January last. ( See Police Gazette, 1910, page 484.) WANGANUI.— 10th instant, that he may be induced to con- tribute towards the support of his four children in the Wel- lington Receiving Home, Arthur Thorburn, age forty five, height 5 ft. 8Jin., labourer, native of New Zealand, fresh complexion, dark brown hair, medium build ; dresses shabbily; fond of drink. The children were committed on the 31st August last, and on the 17th January he was in arrears £ 10. Inquiry by the Education Department. MARTON.— On or about 14th November last, on warrant for carnally knowing Marv Ann Nellv Marsh, a girl under sixteen years of age, Wilfred Marr, age twenty- five, height 5ft. 6in., driver and labourer, native of New Zea- land, medium huild, fair complexion, dark- brown hair, clean- shaved, large blue eyes, hair parted in centre ; dresses neatly in dark striped suit, high- cut vest, turn down collar, and hard black bat or cap ( generally worn on back of head); wears a three- strand silvtr granny chain wiih pendant attached. Photograph filed in the Inspector's Office, Wa- nganui. He was last heard of at Waihi, and, as he is a good footballer, will associate with members of football clubs. PALMERSTON NORTH.— 10th or 11th instant, on warrant for theft of two £ 5 notes on the Bank of New South Wales and two£ l notes, the property of Samuel Anderson, labourer, Charles Underwood, alias Murphy, age twenty- six, height 5 ft. 6 in., seaman, native of England, medium build, light brown hair, grey eyes, fair complexion, clean- shaved except small fair moustache ; fond of drink, and very talka- tive; dressed in greyish- tweed coat and trousers, vest of lighter colour, soft shirt, no collar, and light- coloured tweed cap. He occupied the same bedroom with complainant at Barnes's Boarding'nouse, Shannon. He had no money on the 10th and on the 11th took a railway- ticket for Wellington, and changed a couple of £ 1 notes. ( See Police Gazette, 1911, page 132, where he is wanted as a deserter from H. M. S. " Cambrian.") PAHIATUA.— 6th instant, on warrant for failing to pro- vide for the maintenance of his illegitimate child, Leslie Thomas, age eighteen, height 5 ft. 4 in. or 5in., draper's assistant, native of New Zealand, medium build, dark hair fair complexion, olean- shaved ; usually wears dark suit and straw hat or cap ; boyish appearance. He may bo found working in some of the towns on the Main Trunk Line. Complainant, Alice Ann Toon. CARTERTON.— 9th ultimo, on warrant of commitment to Wellington Prison for one month in default of paying £ 7 16s. 3d. fine and costs for failing to notify the vendor that liquor purchased by him was for a no- license district, John P. Collins, age twenty- seven, height about 5 ft. 3 in., labourer and ex- jockey, native of New Zealand, brown hair, clean- shaved, fair complexion, hazel eyes ; generally wears dark suit and cap. ( See Police Gazette, 1910, page 272, and Photographs of Prisoners discharged, 1910, page 40.) WELLINGTON.— 6th instant, on warrant for deserting from the s. s. " Whakarua," Robert Charles Bugby, age twenty- seven, height 5 ft. 6 in., fireman, native of England, fresh complexion, grey eyes, fair hair, tombstone and heart tattooed on back of left hand. A reward of £ 3 will be paid if he is apprehended before the 25th instant. WELLINGTON.— 1st instant, on warrant for theft of £ 1 0s. 2d., the money of George Nash, dairyman, Frank Williamson, age twenty, height 5 ft. 9 in., farm hand, native of England, brown hair, slim build, dean- shaved ; smart appearance ; dressed in dark suit and grey cap. He is a recent arrival in the Dominion. Other charges pending. Offender was employed by complained to deliver milk and collect accounts. He oollected the above money, and appro- priated it to his own use. CHRISTCHURCH.— 4th instant, on warrant for disobeying an order of Court to pay 10s. a week for the maintenance of his wife, James Beattie, age twenty- five, height 5 ft. 6jin., clerk and plumber, native of New Zealand, fresh complexion, light- brown hair, blue eyes, scar on left side of neck, on right hand, and on thumb ; dressed in navy- blue suit and shabby boots. On the above date he was in arrears £ 16 15s. ( See Photographs of Discharged Prisoners, 1911, page 5.) TIMARU.— 27th ultimo, on warrant for obtaining 10s. from Albert E. Macks, second- hand dealer, by false pre- tences, Donald Watson, alias Owen, alias Brooks, alias Farriston, age about thirty- five, height about 5 ft. 7 in., dark hair, very sallow complexion, long features ; dressed in dirty grey suit and cap. Offender obtained the money by falsely representing that he was a solicitor's olerk employed by Mr. Aspinall, Temuka, and formerly by Mr. Knubley, solicitor, Timaru. ( See Police Gazette, 1910, page 469, and 1911, page 54.) TIMARU. — 8th instant, on warrant for failing to provide for the maintenance of his three children, William Wentworth Ellis, alias Wentworth, age twenty- eight, height 5 ft. 8in. or 9 in., cab driver and labourer, medium build, light- brown hair ( receding well back on fore- head), blue grey eyes, scar on left temple. CROMWELL.— 28th ultimo, on warrant for false pre- tenoes on Charles Cattanach, ho elkeeper, William Julian, age about twenty- five, height about 5 ft. 9 in. or 10 in., saddler, native of New Zealand, slight build, slopin shoulders, inclined to stoop when walking, sharp features, grey or blue eyes, fresh oomplexion, light- brown hair, corners of mouth droop when he is talking, clean- shaved, long fingers; dressed in greenish- tweed suit or light- grey suit and cap ; fond of drink. Offender was boarding with complainant, and represented that he had money invested, and gave him in payment for board a valueless cheque for £ 10. GORE.— 16th February last, on warrant of commitment to Dunedin Prison for seven days in default of paying £ 2 9s. fine and costs for breaking a window, Ernest Tuckey, age twenty- seven, height 5 ft. 8 in., hairdresser, native of New Zealand, slight build, fresh oomplexion, blue eyes, clean- shaved, fair hair ; generally wears brown- striped sac suit, cap to match, tan boots, and fancy socks ; addicted to drink. His parents reside in Dunedin North. INVERCARGILL. — 11th instant, for escaping from legal custody, Joseph Thomas Christie, age seventeen, height 5ft. 7in., industrial- school boy, native of New Zea- land, stout build, blue eyes, black hair, full round face, prominent eyebrows and ears, scar on back of left ear; dressed in dark- tweed suit and cap ; uppers of hoots in bad repair. He was sen- tenced to five years' reformative treatment for breaking and entering, and when being escorted to Invercargill jumped from the train near Woodlands Railway- station, and will probably make for a Beaport. 175 N E W Z E A L A N D P O L I C E G A Z E T T E. ( See Police Gazette, 1910, page 483.) AUCKLAND.— Richard Grimwood, has been served with a summons by Sergeant Harvey, Auckland police. ( See Police Gazette, 1911, page 97.) AUCKLAND.— John Casey, default of fine: Warrant executed by Deteotive Cox and Acting- Detective Sweeney, Auckland police. Offender was serving a sentence for another offence at Auckland. ( See Police Gazette, 1911, page 2.) TE AROHA.— William Meek, default of fine, has been arrested by Constable J. Hammerly, Auckland police, and lodged in Mount Eden Prison. NORMANBY.— Munga Wainonga, alias Maunga, for breaking into the store of Edgar Ormond Chivers, has been arrested by Detective Siddells, Wanganui polioe, and re manded. ( See Police Gazette, 1911, page 109 and 120.) WELLINGTON.— Robert Morrison Douglas Philp, wife- desertion, has returned to Queensland. His arrest is not at present desired. ( See Police Gazette, 1911, page 78.) CHRISTCHURCH.— Rupert William Densen, default of maintenance : Warrant cancelled. ( See Police Gazette, 1911, page 148.) TEMUKA.— William McCauley, theft, has been arrested by Constable J. Smith, Timaru police, and sentenced to fourteen days. ( See Police Gazette, 1911, page 148.) OUTRAM.— Thomas Jerome, default of fine, has paid the amount due to Constable A. Kerse, Clinton police. He has been served with a summons for breach of prohibition order. ( See Police Gazette, 1911, page 120.) LYTTELTON. - Henry G. J. Moore, deserter from H. M. S. " Pioneer," has been arrested by Constable Clarkson, Rakaia police, and remanded. ( See Police Gazette, 1908, pages 441 and 453.) INVERCARGILL.— Charles Legerwood, default of main- tenance, has been arrested by Constable J. O'Grady, Ashbur- ton police, and remanded. ( See Police Gazette, 1911, page 88.) PROPERTY STOLEN. AUCKLAND.— Between the 16th and 20th February last, the property of H. E. PARTRIDGE AND CO., merchants, a case of Willis's aromatic flake- cut tobacco, 2 oz. tins, in twenty cardboard boxes containing 51b. each; value, £ 10 16s. 8d. The case was shipped at Wellington by the s. s. " Wimmera," but no trace of the oase could be obtained on board the steamer when discharging cargo at Auckland. As the case did not pass through the Customs, a look- out should be kept for cardboard - boxes containing similar tobacco and not bearing the Customs stamp. THAMES.— Between 4th and 6th ultimo, from a stable, the property of ALFRED JULIUS MELGREN, butcher, a gentlemen's riding- saddle, newly lined, both knee- pads off; also a single- rein bridle : value, £ 2 10s. Identifiable. FEATHERSTON. — Between the 1st and 3rd instant, from the dwelling of JOHN WHISHAW, drover, two polished moonstones, value £ o each ; a cat's- eye stone, value £ 2 10s.; and a tin containing a quantity of old coins and about £ 3 in silver. CHRISTCHURCH. — 4th December last, from outside the Christchurch Museum, the property of ELSIE LILLEY, laundress, St. Albans, a ladies' Anglo- Special free- wheel bioycle, No. 365, steel rims and mud- guards ( one of the latter broken), upturned handles, no grips, front- rim brake ; value, £ 12. CHRISTCHURCH.— 11th November last, from the trotting- track, Addington, the property of HERBERT HARTLE, clerk, Sydenham, a gentlemen's new Bell free- wheel bicycle, No. 3146, steel rims and pedals, Dunlop reversible handles, front- rim brake ; value, £ 20. Identifiable. TIMARU.— 10th ultimo, from the bedroom of WILLIAM CAMPBELL, labourer, Wakefield's Boardinghouse, a pair of new dark tweed trousers and a vest, very faint- green stripe running through the cloth; value, £ 2 10s. Suspicion attached to H. Sherman, age thirty- five, height 5 ft. 9 in., dark hair, fresh complexion, medium build, clean- shaved ; generally works amongst horses, and was last employed at Glenie's stables, Timaru. He left Timaru on the above date for Christchurch, and may be found wearing the stolen articles. DESERTERS FROM HIS MAJESTY'S SERVICE. From, H. M. S. " Cambrian." SYDNEY.— Charles H. Paull, age twenty- six, height 5ft. 7in., private R. M. L. I., native of England, brown hair, hazel eyes, fresh complexion. Deserted 24th March, 1911. A reward of £ 3 is offered for his apprehension. INQUIRIES, ETC., FROM OUTSIDE NEW ZEALAND. SYDNEY.— A reward of £ 50 is offered for information lead- ing to the arrest of Henry Samuel Munce Hutchin- son, charged on warrant with embezzling the sum of £ 32, the money of the Bank of Australasia. Description : Age about forty- six, height 5 ft. 11 in., medium build, brown moustache ; generally dressed in grey- tweed sac suit and grey soft- felt hat; addicted to drink ; said to be a native of Tasmania; an ex- manager of the Bank of Australasia, Narrabri. The above reward to remain in force for three months from the 15th March, 1911. ( 11/ 800.) SYDNEY.— A warrant has been issued for the arrest of William Henry Davey for bigamy, having married Charlotte Filby at Marriekville, Sydney, on the 18th May, 1910, his wife Gertrude Warne, being then alive. Descrip- tion : Age thirty- five, height 5 ft. 7 in., native of England, medium build, fresh complexion, dark- brown hair, clean- shaved, hazel eyes. Photograph filed in the Commissioner's Office, Wellington. Offender deserted from H. M. S. " Pen- guin" on the 2nd January last, and about the same time his second wife left her residence, and no doubt they will be together. She is about twenty- five years of age, 5 ft. 7 in. high, medium build, dark oomplexion, dark hair and eyes, and has a child about eight months old. ( See New South Wales Police Gazette, 1911, pages 45, 101, and 119.) Arrest desired. ( 11/ 796.) MELBOURNE ( VICTORIA.)— Inquiry requested for Wil- liam O'Connor, that he may be induced to contribute towards the support of his wife and family, age thirty, height 5 ft. 8 in. or 9 in., labourer, slight build, dark complexion, dark hair and moustaohe. He was employed at a flax- mill at Tokomaru, Shannon, and received 9s. a day, and out of his wages sent his wife an occasional 10s. He passed himself off as a single man, and was making preparations to marry a girl and settle in the district. He has recently cleared out, and may seek employment at some other flax- mill. ( 11/ 338.) ENGLAND.— Inquiry requested for George Kay, age about fifty- two, was clerk at St. Pancras Station, London, medium height, dark complexion. He left the Royal Albert Docks, London, in September, 1885, aooompanied by his wife ( who was a Frenchwoman), and his young daughter. On his arrival in New Zealand he wrote from Wellington, and nothing has been heard of him since. Inquiry by his brother, E. Kay, Manchester. ( 11/ 801.) 170 N E W Z E A L A N D P O L I C E G A Z E T T E. f APRIL 19 MISCELLANEOUS INFORMATION. ——.•• O'O'OT" Circular No. 2/ 11.] Police Department. Finger- prints of Deceased Persons. When the body of a deceased person is not identified mem- bers of the Force who are dealing with the matter are directed to take the finger- prints of the corpse on the usual finger- print forms, and forward them together with a full description and a careful note of all distinguishing- marks through the proper official channel to the Commissioner. When obtaining the finger- prints care should be taken that, after the fingers are inked, the form is folded, placed against a small piece of board or other similar substance, and rolled round eaoh finger separately. If this is not done it will be difficult to get a satisfactory " rolled " impression. F. WALDEGRAVE, Commissioner of Police. Wellington, 12th April, 1911. ( P. 11/ 406.) LAW REPORT. (" Times Law Reports," vol. xxvii, page 197.) [ K. B. Div. ( LORD ALVERSTONE, C. J., HAMILTON AND AVOEY, JJ.) 20th January, 1911.] RUSSON V. DUTTON. Local Government— By- law— Validity— Indecent Language— Street or Public Place— Annoyance of Passengers— Public House. A by- law forbidding the use of profane, obsoene, or indecent language in any street or publio place to the annoyance of passengers cannot be held to apply to language alleged to be indecent used in a public house and only heard by persons present therein. THIS was a oase stated by Magistrates for the County of Chester. Mr. R. D. Muir appeared for the appellant, and Mr. Trevor Lloyd appeared for the respondent. It appeared that the appellant, a licensed victualler, had been convicted, under a by- law made by the Cheshire County Council, under section 16 of the Looal Government Act, 1888, of using " indecent " language in a public house. The by- law in question provided that any person who in any street or publio place should make use of any profane, ob- soene, or indecent language to the annoyance of passengers should be liable to a penalty. On the occasion complained of, two police constables went to the appellant's publio house on certain business, and the appellant, being annoyed with them, came forward and used abusive language, saying to them, amongst other things, " You are too bloody keen." For using these words he was prosecuted and convicted. Mr. MUIR contended for the appellant that the words in question were not indecent; that a person inside a public house was not in a street or pablio place ; and that, as the only persons who heard the language uttered were the two constables and the appellant's wife, who was standing near, the words could not be said to have been uttered to the annoyance of " passengers." The by- law was directed against profane, obscene, or indecent words, and the ad- jective " indecent" must be read as referring to words of the same oharacter, if different in degree, as words covered by the other adjectives in the clause. The particular word " bloody " was of medieval origin, and as used to- day had no meaning whatever ; and no one would ever trouble to pass a by- law to suppress it. He referred to Mantle v. Jordan ( 13 The Times L. R., 121; [ 1897] 1 Q. B., 248). Mr. TREVOR LLOYD, for the respondent, contended that any word whioh was not " decent" must be indecent. A public house was a place to which any member of the public had access without payment, and was therefore a public place within this by- law. And the constables who had merely called at the house were passengers within the mean- ing of the by- law. He referred to Langrish v. Archer ( 10 Q. B. D., 44); Cole v. Coulton ( 29 L. J., M. C., 125) ; Ex parte Davis ( 26 L. J., M. C., 178) ; Sewell v. Taylor ( 29 L. J., M. C., 50) ; Brabham v. Wookey ( 18 The Times L. R., 99). The LORD CHIEF JUSTICE said that as to the first point he was not prepared to say that the word oomplained of did not come within the definition of " indecent," but on the other point, that the word was not uttered in a public place to the annoyance of passengers, he thought they must accept the appellant's contention. He' would not express any opinion as to what by- laws a local authority had power to make ; whatever by- laws they made in pursuance of statutory powers must be supported by this Court wherever possible— Kruse v. Johnson ([ 1898] 2 Q. B., 91). But a by- law must be clear and free from ambiguity, and he could not say that a by- law forbidding conduct in a street or other public place to the annoyance of passengers could by any reasonable interpretation be held to apply to language used in a public house to persons who were present therein. It would be most extravagant to hold that a person who had gone into a public house on business was a passenger, and the justices should have held that the by- law did not apply in the oir- oumstances of this case.
