N OTICE.— For instructions as to the manner in which reports are required to lie furnished for the com- pilation of the Police Gazette see Gazette No. 1 of this year. The arrest of offenders described in the Police Gazette, or respecting whom crime reports have been forwarded for insertion in the Gazette, should be promptly notified by the member of the Force effecting the arrest. When notifying the arrest of persons charged with theft or suspected of theft, it should be stated whether the pro- perty stolen, or any portion of it, has been recovered. A description of property supposed to be stolen, found in the possession of offenders, for which owners cannot be found, shall be furnished for insertion in the Gazette. All communications concerning this Gazette should be addressed to the Commissioner of Police, Wellington, and the envelope marked " For Gazette." Members of the Force in charge of out- stations will forward them direct. PERSONS WANTED. H black hat; fond of drink. ( See Police Gazette, 1910, piige 341.) Inquiry by the Education Department. AUCKLAND.— 12th July, 1909, on warrant for a breach of the Bankruptcy Act, Frank A. Cooper, age forty- three, height 5 ft. 4 in., acetylene - gas agent, lair complexion, blue eyes, thick- set build ( inclined to be corpulent), full face, very plausible manner; dresses well. He was adjudicated a bankrupt on the 22nd July, 1909, at Auckland, and imme- diately left the Dominion for Sydney, but was seen at Taumarunui a few months ago. AUCKLAND.— 23rd January last, on warrant of commit- ment to Mount Eden Prison for seven days in default of paying £ 2 15s. fine and costs for theft and indecent lan- guage, Thomas Turner, age twenty- six, height 5 ft. 5 in., seaman and labourer, native of England, medium build, fresh complexion, brown hair ( bald on top), brown eyes, flower tattooed on right forearm. He has paid £ 1 10s., leaving a balance now due of £ 1 5s. AUCKLAND.— 1st instant, that he may be compelled to contribute towards the support of his son, an inmate of the Auckland Industrial School, Alexander Simpson, age thirty- four, height 5 ft. 6Jin., storeman and labourer, native of Australia, medium build, fresh complexion, dark- brown hair, blue eyes ; dressed in dark- tweed suit and hard AUCKLAND.— 14th ultimo, on warrant for theft of £ 6 5s., ; the money of George Kennerley, Auckland, Harry Crook, a « e about forty- thiee, h ight about 5 ft. 5 in., cook and I ottle- gatherer, native of England, stout build, brown hair, moustache only ; slovenly appearance ; fond of drink. He was employed by complainant, and collected the above amount from Read and Co., merchants, and appropriated it to his own use. ONEHUNGA.— 30th ultimo, on warrant for theft of a bicycle, value £ 8, the property of Arthur Taylor, farmer, Mangere, Man ( name unknown), age about twenty- one, bi igiit about 5 ft. 7 in., medium build, dark complexion and hair, cleau-;- baved; dressed in navy- blue suit, dark- tan leggings, and tan boots ; had on a horse hair watch- guard, and said he had been milking sixty cows for some people in the Wa kato. He is supposed to be identical with John Henry Heath. ( See Police Gazette, 1911, pages 110 and 129.) The bicycle stolen was a gentlemen's old machine, " Pardy Cycle- works, Onehunga," on the front plate, turned- up handles, a Macintosh tire on front wheel, and a Palmer tire on back wheel, new mud- guard on front wheel, and old one on back wheel, B. S. A. bearings, and Brooks saddle. He left behind him an old Standard free- wheel bicycle of little value, plated rims and wheels turning rusty, 23 in. black- enamelled frame, back rim brake on left side, Dunlop- Bartlett tires on back wheel, Oceanic- Bartlett tire on front wheel, flat handle- bars, green and white grips ; value, about 10s. ONEHUNGA.— 24th ultimo, on warrant for theft of a saddle, value £ 1 15s., the property of Clive Holloway, Selwyn Street, Onehunga, Man ( name unknown), age about twenty- two, height about 5 ft. Gin., clean- shaved, dark com- plexion, rather full face ; dressed in navy- blue coat, riding- pants, leggings, and felt hat. The saddle was sold by offender to Lediard and Kingsford, saddlers, Auckland, for 15s., on the 24th ultimo. ONGARUE.— 5th ultimo, i. n warrant for theft of a black gelding, five years old, about 14 hands high, branded " PA" on near shoulder, old scars on one front leg, the property of Thomas Lovett, value £ 3, and an English saddle, maker McVay, Napier, value £ 4, the property of Jason Hardy, farmer, Fred Inwood, age thirty- five, height 5 ft. 9 in., labourer, native of New Zealand, fair complexion, hair inclined to be ginger, clean- shaved except ginger moustache, hunch- backed, parents reside at Motueka. [* APRIL- 5 ELTHAM.— 28th ultimo, on warrant for failing to provide for the future maintenance of his unborn illegitimate child, Arthur Ward, age twenty- one, height 5 ft. 6 in , car- penter, native of New Zealand, slight build, thin features, clean- shaved or may have slight moustache only, fair hair and complexion, brown eyes; dressed in brown suit and hard black hat. Complainant, Elsie Wiley, Eltham. WANGANUI.— 21st uiiimo, on warrant for theft of £ 13 12s. 2d., the money of J. A. Bowers, manager of the Waverley Dairy Company, John Ford, age twenty- two, height 5 ft. 11 in., labourer and driver, native of New Zealand, slight build, fair complexion, fair hair parted in centre, pro minent blue eyes, clean shaved ; dressed in brown suit, soft collar, and light cap. His parents are supposed to reside in Auckland. Offender was employed as driver by the com- pany, and failed to account for the above amount, whioh lie colleoted. WANGANUI.— 2nd Maroh last, on warrant of commit- ment to Wanganui Prison for seven days in default of paying £ 1 10s. fine and costs for wilful damage to a window, William Welch, age forty- two, height 5 ft. 8 in., labourer, native of England, medium build, fresh complexion, clean- shaved, ginger moustache only, scar on right side of neck and on right forearm, dirty appearance ; dressed in brown- Btriped suit and cap. WANGANUI.— 7th instant, that she may be induced to pay arrears due for the maintenance of her children in St. Joseph's Orphanage, Wellington, Isabella John- son, age about thirty, height about 5 ft. 2 in., servant, very slight build, very dark complexion and hair, Assyrian appearance; wearing dark dress, and had a little boy with her about four years old. She was last heard of at Mr. Wy- bourne's, Waverley, where she was employed, and left there about seven months ago for Wellington en route to Picton. On the 13th ultimo she was in arrears £ 5 10s. WANGANUI.— 5th instant, that he may be induced to pay off £ 12 16s. arrears due for the maintenance of his children in St. Mary's Industrial School, Albert Treves, or Trebes, age thirty- one, height 5 ft. 7 in , labourer, native of New Zealand, medium build, dark complexion and hair, clean- shaved, dark- brown spot between the eyes ; generally wears a greenish- coloured suit and hard black hat. He was em- ployed at Gardner's sawmill, Turangarere, and left there on the 9th February last, with the intention of going towards Napier. His parents reside at Midhurst, Taranaki. MASTERTON.— 8th February last, on warrant for a breach of the Licensing Aot, John McConvill, age about twenty- one, height about 5 ft. 4 in., stable boy and spieler, native of New Zealand ; larrikin appearance. He is supposed to be identical with John McConvill. ( See Police Gazette, 1909, page 114, and 1910, page 179.) Offender was summoned for failing to give his name and address when ordering liquor for a no- license district, but failed to appear at Court, and above warrant was issued. CHRISTCHURCH.— 7th instant, that he may be compelled to pay part of the arrears due (£ 16) for the maintenance of his four children in St. Mary's Home, Nelson, Alfred Heissenbuttel, alias Arthur Smithson, age forty- two, height 5ft. 9Jin., labouter, native of New Zealand, fresh complexion, dark hair, grey eyes. CHRISTCHURCH.— 20th ultimo, on warrant of commit- ment to Lyttelton Prison for seven days in default of paying £ 1 0s. 6d. expenses and costs for medical treatment, Robert Forrest Vallance, age fifty- eight, height 5 ft. 7 § in., sailor, native of Sootland, stout build, fair complexion, grey hair, blue eyes, heavy ginger moustache, ship and " R. V J. McM." on left arm, " R. V." on back of left hand, danc- ing- girl above star on right arm, bracelet half round right wrist ; dressed in pepper- and- salt suit, coat darned on left shoulder and middle of back with white thread. He said that he had been working for a Mr. Morton, Taitapu, Can- terbury. CHRISTCHURCH.— 10th ultimo, on warrant of commit- ment to Lyttelton Prison for two months in default of pay- ing £ 20 for damaging a mirror, Leonard Clark, age thirty- three, heigut 5 ft. 9 in., labourer and actor, native of England, medium build, fresh complexion, light hair, hazel eves; dressed in loose- fitting grey suit and cap. CHRISTCHURCH.— James Black, wanted on warrant for disobeying an order of Court for the maintenance of his illegitimate child: It has bet n ascertained by Constable C. C. King, Palmerston North police, tltat offender has left New Zealand, and has written from Las Palmas. ( See Police Gazette, 1910, page 106.) CHRISTCHURCH.— Between 7th February last and 30th ultimo, on warrant for theft of £ 35, the money of the Bank of New Zealand, Robert Charles Moffatt Tait, age twenty- three, height 5 ft. 9 in., bank clerk, native of Scotland, slight build, pale complexion, reddish hair, clean- shaved ; generally wears navy blue sac suit and straw hat. He has friends residing at Cheviot. He was employed in the bank at Christchurch, and was last seen on the 30th ultimo. Photograph filed in all Inspector's offices. He will probably endeavour to leave the Dominion. RAKAIA.— 6th instant, for escaping from legal custody when en route to Burnham Industrial School, Frank Meagher, age sixteen, height 5 ft. 6 in., native of New Zealand, good build, pale complexion, blue eyes, light- brown hair, broad nose, boil- marks on back of neck ; dressed in grey trousers, blue coat with large tear in the back, dark singlet, and cap, no shirt. He jumped from the train shortly after leaving Rakaia Station, and when last seen was going towards Methven. He will probably steal a bicycle and endeavour to make his way south. Offender was an esoapee from Burnham Industrial School, and was also charged with theft. ( See Police Gazette, 1911, page 149.) GERALDINE.— 27th ultimo, on warrant for obtaining a bicycle, value £ 10, from Angus Jameson Bell by false pre- tences, William Wilkins, age about twenty, height 5 ft. 8 in., stout build, dark hair and eyes, small dark mous- tache cut square, dark complexion, scratches or birth- mark on side of face. He may be identical with Donald Owen, alias Brookes, alias Forrester. ( See Police Gazette, 1911, page 54.) Offender obtained the bicycle by falsely representing that he was employed by Mr. Inglis, solicitor, Geraldine, and promised to return it on the following morn ing. He is said to have been recently employed by Mr. As- pinal, solicitor, Temuka. WAIMATE.— Michael Costello, wanted on warrant for failing to provide his wife with adequate means of support: It has been ascertained by Acting- Detective Abbott, Wel- lington police, that offender is now living in the suburbs of Melbourne, and keeping a small boot- repairing shop there. ( See Police Gazette, 1911, page 60.) TIMARU.— 2l8t ultimo, on warrant for iheft of a gentle- men's black- enamelled bicycle ( recovered), value £ 8, the property of Horace Bandrup, cycle- agent, Norman Ram- say, age twenty- two, height 5 ft. 7in , labourer, native of New Zealand, clean - shaved, dark hair and complexion, medium build; dressed in dark suit, straw hat, and tan boots. Offender hired the bicycle for an hour, and sold it to a second- hand dealer for £ 1 17s. TIMARU.— 27th ultimo, on warrant for obtaining 10s. from Albert E. Macks, second- hand dealer, by false pre- t> nces, Donald Watson, alias Owen, & c., age about thirty- five, height about 5 ft. 7 in., dark hair, very sallow complexion, long features ; dressed in dirty grey suit and cap. Offender obtained the money by falsely representing that he was a solicitor's clerk employed by Mr. Aspinali, Temuka, and formerly by Mr. Knubley, solicitor, Timaru. OAMARU.— 23rd February last, on warrant for obtain- ing £ 2 16s. 4d. from Alexander Copeland by false pretences, Donald Owen, alias Williams, alias Morgan, age thirty- eight, height 5 ft. 6 in., labourer and compositor, native of England, medium build, fresh complexion, brown hair, hazel eyes, scar on bridge of nose and on upper lip, right little finger injured; dressed in dark- tweed suit and cap. ( See Police Gazette, 1909, page 70.) Offender obtained the above amount for two gallons of whisky by falsely representing that he was traveller for G. and T. Young, wine- merchants. DUNEDIN.— 20th ultimo, on warrant of commitment to Dunedin Prison for seven days in default of paying £ 2 10s. fine and costs for a breach of his prohibition order, Frank Hanley, age thirty- six, height 5ft. 7| in., labourer, native of New Zealand, medium build, fresh complexion, dark- brown hair, blue eyes, large nose, lump on back of head. Photograph filed in the Inspector's Office, Invercargil'l. Offender is supposed to be in Bendigo, Victoria. INVERCARGILL.— 21st September last, on warrant of commitment to Invercargill Prison for seven days in default of paying £ 1 10s. fine and costs for a breach of the South- land County By- laws, Alfred Ankestell, age about forty- two, height 5 ft. 10 in., canvasser, native of Victoria, medium build, fresh complexion, bro* n hair and eyes, clean- shaved ; generally wears brown suit and hard black hat. APPREHENSIONS, PERSONS FOUND, ETC. AUCKLAND.— John Ernest Paton, wife- desertion, has been located by Detective Quartermain, and warrant can- celled. ( See Police Gazette, 1904, page 145.) AUCKLAND.— Thomas James Rowles, default of fine, has been located by Detectives McMahon and Quarteimain, aud amount paid. ( See Police Gazette, 1910, page 245.) AUCKLAND.— Alfred Nobes, alias King, alias Mc- Guire, for disobeying orders of Court for maintenance, has paid part of the amount due to Constable Shearman, Ellerslie police, and has given an order on his employer to pay 15s. a week. ( See Police Gazette, 1910, page 533.) TAIHAPE.— George Wooster, deserting wife, bas been located by Constable Hitchcock, Taihape police, and war- rant cancelled. ( See Police Gazette, 1905, page 81.) DENNISTON.— John Robson has been served with a summons by Constable J. Dempsey, Wellington police, on information supplied by Constable W. J. Simpson, Dennis- ton police. ( See Police Gazette, 1911, page 24.) AKAROA. — Joseph McIlroy, default of fine, has paid the amount due to Constable VVorsley, Islington police. ( See Police Gazette, 1911, page 78.) WELLINGTON.— Ernest Stanley Mott, deserter from the s. s. " Corinthic," has been arrested by Constable F. Hall, Wellington police. ( See Police Gazette, 1911, page 148.) WELLINGTON.— Peter Schmidt, alias Harry Thomp- son, deserting from the s. s. " Rimutaka," has been arrested by Constable A. SYDNEY.— David George Tolhurst, deserter from H. JI. S. " Gibraltar," has been arrested. ( See Police Gazette, 1911, page 27.) PROPERTY STOLEN. OTOROHANGA.-- Between 29th January and 27th February last, from a paddock, the property of MARK COWLEY, farmer, a dark- red steer, a red- and- white steer, a red steer with white face, a steer ( oolour unknown), all two years old ; and a light- roan steer, seven months old. They are all branded " 7 C," square notch out of top of off ear, and two square notches out of under- side of near ear ; value, £ 15. Identifiable. NAPIER.— 28th ultimo, from the whare of JAMES MOYNA- HAN, Taradale Road, a single- barelled breech- loading gun, value £ 4 10s.; a Panama hat, size 6J, va. ue £ 1 5s. ; a pair of light lace- up boots, size 8, value £ 1 ; a black morocco- leather pocket- book ; a white- handled razor; and othersmall articles. Suspicion attached to Man ( name unknown), who was seen near the whare, age about twenty, height about 5 ft. 9 in., about 11 st. weight, fair hair and complexion, full face, very narrow across the eyes; dressed in lieht- tweed suit, leather leggings, elastic- side kid boots, soft wide- brimmed hat ; was carrying a brief- bag and some articles wrapped in a green cloth. He stated that he came from Waihi, and was an electrical engineer. TAUMARUNUI.— 6th or 7th ultimo, from the bedroom of J. W. ELLIS, a gold hunting watch, No. 35689, " J. W. Ellis, he tohu Aroha na Manawa," engraved on inside of case, value £ 23 ; and about £ 7 iu gold and notes. ( See Police Gazette, 1911, page 109.) PETONE.— 3rd instant, from the Hutt Road, the property of G. W. LEWERS, piano- tuner, a gentlemen's B. S. A. bicycle, black- enamelled frame, free wheel, rat- trap pedals, upturned handles, black- oelluloid grips, brown- leather bag containing piano- tuner's tools strapped on frame, tools branded " Weegang aud Klein " ; value, £ 14. Identifiable. WELLINGTON — About 1st February last, from the bed- room of HAROLD RICHARDS, No. 79 Abel Smith Street, a gentlemen's gold Waltham hunting- watch, No. 1375482 ; value, £ 10. Identifiable. WELLINGTON SOUTH.— 5th or 6th instant, from the Wel- lington South Museum, the property of the WELLINGTON CITY COUNCIL, seventy- three copper, fifty- two silver, and five gold pieces; a George III Spade guinea; a Queen Anne half- sovereign ; a French 20 franc gold coin, about the size of a sovereign ; an 1887 Jubilee half- sovereign ; a gold Louis coin ; and several smaller gold coins ; a silver five- shilling piece, George III ; a silver four- shilling piece, Queen Victoria ; two King George Lion shillings ; three or four silver four- penuy pieces ; a penny and a halfpenny silver piece ; a two- penny silver piece ; a five- cent Mauritius silver piece, dated 1878; and the balance old English and foreign coins. Identifi- cation doubtful. The coins were stolen from a frame up- stairs in one of the large show- cases. The glass of the show- case was broken, and the frame taken downstairs, and the coins removed. BLACKWATER.— 12th February last, from a wash- house at McVicar's Boardinghouse, the property of JAMES SLEITH, miner, a gentlemen's 9ct. gold ring, set with a sapphire ( see No. 96 in Illustrations) ; value, £ 1 5s. Identifiable. Sus- picion attached to Edward Ritchie, age about thirty- two, height about 6 ft. 1 in., miner, fresh complexion, dark hair, active build, large nose, swaggering gait; fond of drink. He is supposed to be working at a mine near Nelson. He told complainant he saw the ring, but did not take it. MOSGIEL.— 25th ultimo, from tho hut of ALEXANDER McKELVIN, groom, a nearly new silver Rotherham hunting- watch, No. 742; value, £ 5. " identifiable. SOUTH DUNEDIN. — 27th ultimo, from a right- of- way off Edward Street, the property of ALBERT HALL, hairdresser, a gentlemen's old Governor black - enamelled free - wheel bicycle, turned- up handles, rat- trap pedals, front- rim brake broken, new Britannia tire on back wheel, old Dunlop tire on front wheel ; value, £ 3. Identifiable. INVERCARGILL.— Between 19th and 22nd ultimo, from a jewel- case in the bedroom of ETHEL MAUDE SIMMONS, proprietress of the tea- rooms, Dee Street, a marquise ring, set with sixteen diamonds and three rubies, shield of ring slightly bent; value, £ 35. ( See Police Gazette, 1911, page 149.) RANGIORA. — ISAAC GEOFFREY WATKINS'S bicycle, No. 25423, has been found and returned to the owner. ( See Police Gazette, 1911, page 150.) SYDNEY. — RICHARD SKUTHORPE S buck - jumping horse has been recovered. ( See Police Gazette, 1911, page 100.) ( 11/ 464.) DESERTERS FROM HIS MAJESTY'S SERVICE. From H. M. S. " Fantome." SYDNEY.— William Joseph Lonorgan. age twenty- three, height 5ft. 6Jin., A. B., native of Lancashire, England, dark- brown hair, blue eyes, fresh complexion, scar on left shin. Deserted 17th ultimo. A reward of £ 3 is offered for his apprehension. From H. M. S. " Challenger." SYDNEY.— Bernard Fowler, age twenty- six, height 5f-. 6 in., stoker, native of England, dark- brown hair, grey eyes, fresh complexion. He is also charged with theft of between £ 60 and £ 100 in gold, a dress suit, and other clothes, and a silver cigarette- case with " G. R. A. G." and " Hard Case " on it. ( See Police Gazette, 1911, page 100.) INQUIRIES, ETC., FROM OUTSIDE NEW ZEALAND. VICTORIA.— A warrant has been issued for the arrest of Charles Angus Stracey, charged with larceny as a bailee of £ 75 from Conrad Grimme, farmer, on the 16th May, 1910. Description: Age thirty to tbirty- five, height 5ft. 8 in., commis- ion agent, na'ive of Victoria, medium build, very dark complexion, dark beard, whiskers, and moustache ; dresses well, generally in dark suit. He was arrested on the 12th December last, and bailed to appear, but absconded. He will probably start in business as a land agent. Arrest desired, and cost of extradition guaranteed. SYDNEY. — Inquiry requested for Herbert Ernest Lungren, age about thirty- five, height 5 ft. 8in., fair hair and complexion, long fair drooping moustache, slight build, tired appearance ; dresses fairly well, a crack rifle- shot, and was supposed to be qualifying to go to England for the Coronation. He was employed on the tramways, and left on the 29th July last, supposed for New Zealand, and may be employed on the railways or tramways. He is said to be accompanied by a girl, a cousin of his wife. Inquiry by William Robertson, on behalf of his wife and children, who are destitute. ( 11/ 717.) SYDNEY.— Inquiry requested by the Sydney police if any- thing is known of Mary Lane, or Langley, age about twenty- five, who died at Sydney on 12th February last, sup- posed to have come from New Zealand. J., HAMILTON AND AVORY, JJ.).— 11TH JANUARY, 1911.] Ex parte BOWEN. Criminal Law— Criminal Information— Assault. The Court declined to grant a rule for a criminal infor- mation against a superintendent of police, being of opinion —( 1) that the affidavits did not establish any personal con- nection of the superintendent, with assaults alleged to have been committed by police officers under his control, and ( 2) that as there was nothing to show that ordinary pro- ceedings for assault would be an insufficient remedy, there was no prima facie case made out for the granting of a criminal information. MR. LANGDON, K. C. ( Mr. H. H. Schloesser with him), moved on behalf of one Thomas Bowen, president of the Workmen's Institute at Aberaman, for a rule for a criminal information against Anthony Gill, superintendent of the police at Abera- man. The application arose in consequence of the behaviour of the police during the recent colliery riots in South Wales. It was alleged that on the 22nd November last the police made a series of unprovoked assaults on unoffending citizens. The matter was of importance, for the assaults complained of were not merely isolated assaults by individual policemen ; there was clearly concerted action which must have taken place under Mr. Gill's direction. The persons assaulted were following their ordinary peaceful occupations; in one case four men who had b3en away all day were returning into Aberaman about 11 p. m., when they were violently assaulted by some constables, and one of them was very seriously in- jured ; in another case an attack was made on a number of persons who were coming out of the local theatre about 10.30 p. m. ; and in another case some people were in a shop mak- ing ordinary purchases, when a number of police came in and hustled them out into the road and assaulted them. The Metropolitan Police who had been brought into the district appeared not to understand the ways of tbe people. He ap- plied for a oriminal information against the superintendent of the police for counselling and procuring the assaults, and submitted that suoh an information was the proper proce- dure. The police had evidently acted in concert and under 167 MEW Z E A L A N D P O L I C E G A Z E T T E. MAE. 22 Mr. Gill's command, and the case was exactly the converse of cases where proceedings by way of criminal information were taken against persons who had been guilty of riotous conduot before the Riot Act was read. The LORD CHIEF JUSTICE said that, in his opinion, no rule ought to be granted. The ca « e was not one in which the Attorney- General had thought it necessary to take action, nor did it involve matters of grave public importance requir- ing special investigation. It was only an ordinary case of alleged assault by the pol; ce, and the affidavits were wholly insufficient to establish any personal connection of Mr. Gill with the transactions. There was nothing to show that ordinary proceedings for assault would be an insufficient remedy; one constable had been identified, } et no proceed- ings had been taken against him. The practice as to grant- ing criminal informations was well established ; and as there was no prima facie case here for the exeroise of extraordin- ary powers, it would be an abuse of the process of the Court if the rule were granted.
