Under the first of those Statutes, any person arretted on suspicion of being a deserter or abeentee Iron His Majesty's Navy, ahall be taken and charged before a Magistrate, and by him, either— ( « ). Conveyed to priaon pending enquiry of the naval authorities as to his identity, and afterwards, should such identity be proved, handed over to Naval custody; or— ( b.) Committed direct to Naval custody on board any one of Hit Majesty's ships. In either of the above cases, after the de- aerter or absentee has been delivered into Naval custody, he may be dealt with under the Naval Diacipline Aot. 4. If arrosted on Naval Warrant under Section 31 af the Naval Diacipline Aot, the deaerter or ab- sentee may be reoeived direct into Naval custody, and isalt with under the Naval Discipline Aot, but no deserter or absentee who has not been arrested under snah warrant shall bs reoeived from the Polioe or trsa any other person, oalesa auch deaerter or ab- ssates has firit been charged before a Magistrate. 6. A daierter or absentee who voluntarily aur- rsaderi himself to Naval anthority may be dealt with aider the Naval DisoipliM Aet, though ae warrant Jar hia arreat may have been issued, and without abarging him before a Magistrate. I. Under the provisions sf Section 10 et the Ast U sad 11 Viot. cap. 69, any parson whe voluntarily • snfetses to being a denerter, er an absentee without Wave, from His Majesty's Navy, nnleas he surrender feiaaslf into Naval custody, may either— ( n). Be taken before a Magistrate, and by hia delivered into Naval anatody; er— ( b.) Be arrested on a warrant under Section SO of the Naval Discipline Aot, and delivered direct into Naval custody. 1B either ease, however, the question whether he be er be not a deserter or abeentee, mutt be duly in- vestigated by Naval authority, and for that purpoae he may be detained for a reasonable time, when, if hi « confession of desertion er abtenoe without leave shall be found not to be true, then he oannot be pnaithed at all under the Naval Ditcipline Act, but he aay either— ( e.) Be detained and received in Hit Majesty's Navy; or— ( oi.) If not reoeived into Hia Majesty's Navy, and on oonviction of false confession of deser- tion before two Justices of the Peaoe, he may be adjudged te be punished if in Eng land, as a rogue and a vagabond, and if in Scotland or Ireland by commitment to prison, there to be kept te hard labour for any time not exceeding three months. T. When any deserter, or absentee without leave, whether delivered into Naval enstody by order of a Magiitrate, or by a warrant iasued under Section 60 af the N^ val Diacipline Aet, or by voluntary sur- render, shell be brought before the Captain of any ane of His Majesty'a ships to be dealt with summarily, its ease is to be thoroughly investigated with a view te establish hia identity, and a note taken in writing ti the proceedings; the prisoner is at the same time te be formally asked if he has any statement to make % ad such statement, if made, is to be signed by the prisoner and duly witnessed; and the accuracy rf any such statement it to be carefully tested before the case it finally disposed of. 706. Except in the cases specified in Art. 707, the Captain may authorise the payment of a reward not exceeding £ 3 to any Constable or other person by whom a deserter may be brought on board or de- livered up to any duly authorised person within two yean of the date of hia desertion. The amount of the award should be determined by the attendant oircumstances, and in considering these, the aeal ahown, and the trouble taken by the Conatable or other person by whom the arreat of the deaerter has been effected, abould be duly weighed. The above Regulations for the payment of rewards will not be held to apply in the case of a deserter voluntarily turrendering himself at any Police Station, or to any Constable or other recognised authority unless it can be clearly shown that such deserter had been induced so to surrender himself by the vigilance and exertions of any such Constable or other person, but exoeptional oases of this descrip- tion are not to be dealt with without reference to the Admiralty at home or Commandert- in- Chief, or Officers in command of Stations abroad, to that a full enquiry into the circumstanoes can be made if necessary. I. In cases where persons have been more than two years in a state of desertion, no reward is to be paid without previous reference as above; it has been notified to the Constabulary generally that when de- serters are apprehended in the United Kingdom after such a period of absence, they are not to be removed from their places of confinement until the Admiralty has been communicated with. I. A reward, not exceeding £ 3, may also be paid for the apprehension of any person who without being guilty of desertion, in the opinion of the Cap- tain of the ship to which he belongs, either gives reasonable ground for considering that he intends ta desert, or commits any on* of the following offences, the particulars of which are to be stated in the notice te the Police ® — (•). Breaks out of his skip. ( b). When on service away front his ship, quit* his plaoe of duty and continues to be absent after ths time at whioh he should havs re- turned to ths ship. (*.) When his ship is ander sailing orders, con- tinues to be absent without leavs, after ths ahip has sailed; provided that ths fact of ths ship being under sailing orders was generally known. A reward not exceeding £ 1 naay be paid for the apprehension of any man who overstays his leave • nless there is reasonable ground for considering that the man intends to desert, in which case £ 3 may be paid. In giving these rewards, the same consideration! that govern the payment of rewards for the ap- prehension of deserters are to be taken into account, both as to arrest and voluntary surrender. 4. No reward is to be paid for the apprehension of any Commissioned, Warrant, or Subordinate Officer, without the aanction of the Admiralty at home, or of the Commander- in- Chief or Senior Officer present, abroad. ***** 706. In addition to the foregoing rewardn, ths Constable or other person bringing deserters or ab- aentees on board may be paid auch expenses attend- ing their lodgment, subsistenoe and travelling, as may appear to have been fairly incurred and to be in accordance with the following regulations, viz. if— ( a). Railway Fare ( return) of ^ I Escort -------- ( b.) Railway Fare ( single) of deserter or absentee - - - As an ordinary rule not tn exceed Id. per mile. ( « .) Other aums expended in the actual conveyance of the deserter or absentee, such as for tLe hire of cabB, boats, & c. [ d.) Subsistence of deserter or Not exceeding Is. a absentee. | day while under detention, or 2s. 6d. a day when travelling. (*.) Subsistence of Escort . . At the same rat* as thmt allowed for Petty Offioers under Art. 1406, according to the time necetsarily occupied in conveying the deserter or abaentee to bis desti- nation and returning. (/.) Except in apecial cases the only other charges which should be sanctioned are the statutory fees of 2s. to the Magistrate's Clerk, and ti. 6d te any Medical Practitioner by whom the deaerter or absentee may have been examined. * * * * * %. If no reward should be payable, the Constable, or other person bringing deserters or absentees on board, should be directed, in addition to the above items, to prefer a claim for such other expenses as he may consider himself fairly entitled to, but every case of this description is to be forwarded to the Admiralty for examination and decision. 5. If the Constable, or other person, bringing n deserter or absentee on board, should object to the Captain's award, the case is to be submitted to the Commander- in- Chief, who if unable to settle the question will forward it for the decision of the Admiralty. ***** The Governor of the gaol will furnish a statement of the number of days' subsistence provided, for which the sum of one shilling per diem is to be added to the other charges against the mm'i pay if oon- victed of desertion or absence without leave. This particular charge of Is. per diem is to be shown, with other mulcts, on the ship's ledger. ***** 6. With a view of simplifying the payment of such claims, Magistrates and Governors of gaols when requested to send deserters or absentees back to their ships, should be informed that it is desirable that the men should be sent in the custody of the Constables who actually apprehended them. 6. The foregoing mode of payment does not apply to cases of deserters or absentees apprehended by the London Metropolitan Polioe. In suck cases the following course is to be observed :— No psyment is to be made by the Accountant Oficer in respect of the expenses incurred by the Constable, sr of any reward which may be due te him. The Constable will produce a form, prepared fer the purpose, in which he will include the whole sf his expenses, and certify that they were neoensarily incurred by him. He will then hand the form te the Accountant Oficer of the ship, who will, with the approval of the Captain, charge the deserter or absentee with the sum shown thereon, together with any reward, if due, and note in the apace provided on the form, the fact of ths sharge having been made. The form ia then to be returned to the Conatable. The payment of the expenses incurred, and of the reward, when due, will be arranged between the Ad- miralty and the Commiasioners of Police. 797. No reward under the authority given to the Captain by Article 705 is in any cate to be paid for the apprehension of deserters or absentees within the precincts of a place where a Polioe Foros in em- ployed in any Naval establishment, but in order to encourage the local police at any auch port or plaoe to search for and apprehend deserters and absentees, the Commander- in- Chief or Senior Officer present, at his discretion, and under such regulations as he may from time to time lay down, may approve a reward not exceeding £ 1 being paid for each deserter or ab- sentee arrested by a Constable of the local Polioe within a reasonable period. The reward paid is to be charged on the ship's ledger against the wages of the deserter or absentee. * * * * • Norn.— If any doubt exists as to the address of any ship, the Admiralty shonld be asked by telegraph for information. Payments are made by the Accountant Oficer of the ship. When any Naval authority bat once been com- municated with as to the disposal of a deserter or absentee, separate arrangements should not be made with a second Naval authority without notifying the former of the steps that are being taken.
