EXTRACT FROM KING'S REGULATIONS AND ADMIRALTY INSTRUCTIONS FOR APPREHENSION OF DESERTERS- REWARDS, Ao. 766. Every possible effort is to be made to check Baaartion and straggling, and, by lawful means, to inteat and apprehend deserter* or absentees without laava. Descriptions in the established form are to be fistribnted as may be directed by the Commanders- la- skief, but at home one copy ia invariably to be cent bv the Captain to the Chief Constable of the deserter'* 91 absentee's usual place of residence, should it be known, and alio to any other place or places where he pai be likely to have gone. The procedure to be followed in respect of the arrest and subsequent disposal of deserterB and absentees is governed by the provisions of Section 9 of the Act 10 and 11 Vict. cap. 62; and by Section 50 • I th* Naval Discipline Act. 8. Under the first of those Statutes, any person arrested on suspicion of being a deserter or absentee ( lam Hit Majesty's Navy shall be taken and charged batere a Magistrate, and by him, either— ( a.) Committed to prison pending inquiry as to his identity, and afterwards, Bhould such identity be proved, handed over to Naval custody, or— ( 6.) Committed direct to Naval custody on board any one of His Majesty's ships. In either of the above cases, after the deserter or absentee has been delivered into Naval custody, he may be dealt with under the Naval Discipline Act. i. If arrested on Naval Warrant under Section BO of the Naval Discipline Act, the deserter or absentee may be received direct into Naval custody •• d dealt with under the Naval Discipline Act; but • a deierter or absentee who has not been arreBted aader such warrant shall be received from the Police, af from any other person, unless such deserter or absentee has first been charged before a Magistrate. 8. A deserter or absentee who voluntarily sur- fanders himself to Naval authority may be dealt with • ader the Naval Discipline Act, though no warrant lar his arrest may have been issued and without • fcarging him before a Magistrate. 6. Under the provisions of Section 10 of the Act 10 and 11 Vict. cap. 62, any person who voluntarily con- fesses to being B deserter, or an absentee without leave, from His Majesty's Navy, unless he surrender himself into Naval custody, may either— ( a.) Be taken before a Magistrate, and by him delivered into Naval custody, or— ( 6.) Be arrested on a warrant under Section 50 of the Naval Discipline Act, and delivered direct into Naval custody. In either case, however, the question whether ha be or be not a deserter or absentee must be duly Investigated by Naval authority, and for that pur- pass he may be detained for a reasonable time, when, II hil confession of desertion or absence without leave • hall be found not to be true, then he cannot be famished at all under the Naval Discipline Act, but ha nay either— ( e.) Be received and detained in His Majesty's Navy, or— ( rf.) If not received into His Majesty's Navy, and on conviction of false confession of deser- tion before two Justices of the Peace, he may be adjudged to be punished, if in England, BB a rogue and vagabond, and if in Scotland or Ireland, by commitment to prison, there to be kept to hard labour for any time not exceeding three months. 7. When any deserter, or absentee without leave, yhather delivered into Naval custody by order of a Magistrate, or by a warrant issued under Section 50 ef the Naval Discipline Act, or by voluntary sur- render, shall be brought before the Commanding Ottcer of any one of His Majesty's Ships to be dealt pith summarily, his case is to be thoroughly investi- gated, and a note taken in writing of the proceed- ings; the prisoner is at the same time to be formally asked if he has any statement to make and such state- dent, if made, is to be signed by the prisoner, and 4aly witnessed; and the accuiBcy of any such state- s » « nt is to be carefully tested before the case is finally disposed of. 767. The penalties for inducing men to desert or improperly absent themselves, or for employing or concealing deserters or absentees, are set forth in the Naval Discipline Act. • • • • • 770. Except in cases specified in Art. 772, the Commanding Officer of a Ship may authorise the pay- ment of a reward not exceeding £ 3 to any Constable or other person by whom a deserter may be brought on board, or delivered up to any duly authorised person within two years of the date of his desertion. The amount of the reward Bhould be determined by the attendant circumstances, and, in considering these, the zeal shown, and the trouble taken, by the Constable or other person by whom the arrest of the deserter has been effected, should be duly weighed. The above Regulations for the payment of rewards will not be held to apply in the case of a deserter voluntarily surrendering himBelf at any Police Station, or to any Constable or other recognised authority, unless it can be clearly shown that such deserter had been induced so to surrender himself by the vigilance and exertions of any such Constable, or other person; but exceptional cases of this description are not to be dealt with without reference to the Admiralty at home, or Commanders- in- Chief or Officers in com- mand of Stations abroad, for full inquiry into the circumstances. 2. In cases where persons have been more than two years in a state of desertion, no reward is to be paid without previous reference as above; and it has been notified to the Constabulary generally that when deserters are apprehended in the United Kingdom after such a period of absence, they are not to be removed from their places of confinement until the Admiralty has been communicated with. • • • • • 3. A reward, not exceeding £ 3, may also be paid for the apprehension of any person who, without being guilty of desertion, in the opinion of the Captain of the Ship to which he belongs, either gives reasonable ground for considering that he intends to desert, or commits any one of the following offences, the par- ticulars of whah are to be stated in the notice to the Police :— ( a.) Breaks out of his Ship. ( b.) When on service away from his Ship, quits his place of duty, and remains absent after the time at which he should have returned to the Ship, ( e.) When his Ship is under sailing orders, remains absent without leave until after the Ship has sailed; provided that the fact of the Ship being under sailing orders were generally known. A reward not exceeding £ 1 ( unless there is reason- » ble ground for considering that the man intends to desert, in which case £ 3 may be paid), may be paid for the apprehension of any man who overstays his leave. In giving these rewards, the same consideration as governs the payment of rewards for the apprehension of deserters is to be taken into account, both as regards arrest and voluntary surrender. No reward is to be paid for the apprehension of any Commissioned, Warrant, or Subordinate Officer, without the Sanction of the Admiralty at home, or Commander- in- Chief or Senior Officer present, abroad. 771. In addition to the foregoing rewards, there may be paid to the Constable, or other person bring- ing deserters or stragglers on board, such expenses attending their lodgment, subsistence, and travelling, a* may appear to have been fairly incurred, and to be in accordance with these regulations, viz. :— Railway Fare ( return) of Escort - - ( As an ordinary rule, Railway Fare ( single) of deserter or<, not to exceed Id. straggler j per mile. Other sums expended in the actual carriage of the deserter or straggler, such as for the hire of Cabs, Boats, etc. Subsistence of deserter or Not exceeding Is. while straggler. under detention, or 2s. 6d. a day when travelling. Subsistence of Escort . . At the same rata < t| that allowed for Petty Officers under Art. 1522, according to the time necessarily occupied la eonveying the deserter or straggler to his deatiaa » tion and returning, namely, 2s. 6d. when absent above 9 hours, and not absent during the night]; and 5a. when absent a night, or for every 24 hours of absence, no fractional part of a iaq being allowed in addition to the 21 hours, unless the extra time for which payment is claimed ex- ceed by more than 9 hours, the full time full time for which 5s. will be paid. The only other charges which, except in spatial cases, should be sanctioned, are a fee of 2s. to the Magistrate's Clerk, and a fee of 2a. 6d. to any medical practitioner by whom the deserter or atragglai may have been examined. 2. Should no reward be payable, the Constable or other person bringing deserters or atragglera on boaii should be directed, in addition to the above items, to prefer a claim for euch other expenBea aa ha mag consider himself fairly entitled to, but every saaa of this description is to be forwarded to the Admiraltg for examination and decision. 3. Should tlie Constable, or other person, bringing a deserter or straggler on board object to the Cap- tain's award, the case iB to be submitted to the Com- mander- in- Chief, who, if unable to settle the queatiea, will forward it for the decision of the Admiralty, • • • • • The Governor of the gaol will furnish a statement of the number of days' subsistence provided, fa| which the charge of one shilling per diem ia ta ha added to the other charges against the man's peg if convicted of desertion or absence without leave. This particular charge of Is. per diem is to be shown, with other mulctB, on the Ship's ledger. 3. With a view to simplifying the payment of such claims, Magistrates and Governors of gaals, when requested to send deserters or Btragglers bash to their ships, should be informed that it is desirably that the men Bhould be sent in the custody of tha Constables who actually apprehended them. 6. The foregoing mode of payment does not apply to cases of deserters or stragglers apprehended bp; the Metropolitan ( London) Police. In auch caaea tha following course is to be observed: — No payment is to be made by the Accountant OMeei in respect of the expenses incurred by the Conatabla, or of any reward which may be due to him. The Constable will fill up a form, prepared for tha purpose, which he is to produce, and in which he will include the whole of bis expenses, and certify that they were necessarily incurred by him. He will thsn hand the form to the Accountant Officer of the Skip, who will, with the approval of the Captain, charg* the deserter or straggler with the Bum shown thereon, together with any reward, if due, and note in tha space provided on the form the fact of the charge having been made. The form is then to be returned to the Conatabla. The payment of the expenses incurred, and of tht reward when due, will be arranged between tha Admiralty and the Commissioners of Police. 772. No reward under the authority given to the Commanding Officer by Article 770 is in any case to be paid for the apprehension of deserters or stragglers within the precincts of a port or place where there It a police force employed in any naval establishment, but in order to encourage the local police at any sash port or place to search for and apprehend deserters as stragglers, the Commander- in- Chief, or senior offiess present, at his discretion, and under Buch regulations as he may from time to time lay down, may approve a reward not exceeding £ 1 being paid for each deserter or straggler arrested by a Constable of the local police within a reasonable period. • • • • t NOTE.— If any doubt exists aa to the addreaa al any ship, the Admiralty should be asked by telegragb for information. Payments are made by the Accountant OScer the Ship. LOSDOX: PAJRRID ros HIS MAJESTY'S STITIO » « BT OFFICII BT Z J. KKHHEB * Co., LIHITSD ; 32, NEW BBIDOS STREET, B. C.; 33, KI » 8 WILLII* STBEIT. B.
