- I . " J R I IIK PUBLISHED BY AUTHORITY. NEW SERIES. TUESDAY, NOVEMBER 3, 1891. VOL. VIII., No. 819. REGULATIONS. 1. All announcements for insertion in the POLICE GAZETTE, and all communications upon them should le addressed to THE EDITOR OF THE POLICE GAZETTE, NEW SCOTLAND YARD, LONDON, S. W. 2. Particulars concerning persons whose apprehension is sought will he inserted in one issue of the POLICE GAZETTE, if they are sufficient to enable action to be taken upon them by another force. 3. Particulars as to stolen property will be likewise inserted in me issue, if sufficient to enable the article in question to be thereby identified. 4. Pa all cases where a reward is offered the name and address of some person responsible for the payment must be given, and the exact conditions be clearly stated. 6. Portraits of persons whose apprehension is sought for serious offences, and engravings of stolen property, will be prominently inserted, with detailed particulars, at a cost of lbs. per portrait, and of Is. Gd. per photograph or sketch of a stolen article, including the expense of engraving on wood. • 6. Every announcement, if for the apprehension of a person, must be guaranteed by thesignature of an officer of not less rank than Superintendent; and, if the name of such person be required to be inserted, and no warrant is in force against him, the requisition must be signed by the chief officer of police, or his immediate deputy, of the county, city, or borough, as the case may be. 7.0 Innouneements concerning stolen property must be guaranteed by an officer of not less rank than Inspector, or analogous thereto. 8. Announcements of all persons to be apprehended or of stolen property bear a number, and art alphabetically arranged by counties. 9. The force which causes part iculars concerning delinquents or stolen property to be inserted in the POLICE GAZETTE, must, on their apprehension or recovery, at ones transmit to the Editor notice of the fact, referring to the number of the announcement for insertion in the next issue. 10. In all cases, the officer signing the request for insertion of any announcement, will be wholly responsible for any proceedings whicfi may result from such publication. 11. Announcements for the Friday issue should be forwarded so as to be received not later than noon on Wednesday, and for the Tuesday edition not later than Saturday morning. They must be clearly written on one side of the paper only, be in the usual form, and accompanied by a covering letter. 12. All payments must be in advance, either at the office, New Scotland Yard, by cheque, crossed " Drummond Sf Co.," Post Office Order payable at Charing Cross, Postal Order, or in Stamps. 13. Advertisements are accepted for the POLICE GAZETTE through Mr. James Willing, 125, Strand, London, the sole Agent, who will furnish the rates on application. 14. Every possible effort is to be made to check deser- tion and straggling, and, by lawful means, to detect and apprehend deserters or absentees without leave. Descriptions in the established form are to be distributed as may be directed by the Commandors- in- Chicf, but at home one copy is invari- ably to be sent by the Captain to the Chief Constable of the deserter's or absentee's usual place of residence, if it is known, and also to any other place or places where he is likely to have gone. 2. The prooedure to be followed in respect of the arrest and subsequent disposal of deserters and absentees is governed by the provisions of Section 9 of the Act 10 and 11 Vict., cap. 62 ; and by Section 50 of the Naval Discipline Act. 3. Under tho first of those Statutes, any person arrested op suspicion of being a deserter or absentee from Her Ma jesty's Navv, shall be taken, and charged before a Magistrate, and by him, either— ( a) Committed to prison pending enquiry as to his identity, and afterwards, should such identity be proved, handed over to Naval custody, or— ( 4) Committed direct to Naval custody on board any one of Her Majesty's Ships. In either of the above eases, after the deserter or absentee has been delivered into Naval custody, he may be dealt with under the Naval Discipline Act. 4. If arrested on Naval Warrant under Section 50 of the Naval Discipline Act, the deserter or absentee may be received direct into Naval custody, and dealt with under the Naval Discipline Act, but no deserter or absentee who has not been arrested under such warrant shall be received from the Police, or from any other person, unless such deserter or absentee has first been charged before a Magistrate. 5. A deserter or absentee who voluntarily surrenders himself lo Naval authority may be dealt with under the Naval Discipline Act, though no warrant for his arrest may have been issued, and without charging him before a Magistrate. 6. Under the provisions of Section 10 of the Act 10 and 11 Vict., cap. 62, any person who voluntarily confesses to being a deserter, or an absentee without leave, from Her Majesty's Navy, may, unless he surrenders himself into Naval custody, either— ( a.) Be taken before a Magistrate, and by him be de- livered into Naval custody, or— ( i.) Be arrested on a warrant under Section 30 of the Naval Discipline Act, and delivered direct into Naval custody. In either case, however, the question whether he is, or is not, a deserter or absentee, must be duly investigated by Naval authority, and for that purpose he may be detained for a rea- sonable time, when, if his confession of desertion or absence without leave shall be found not to be true, then he cannot bo punished at all under tho Naval Discipline Act, but he may either— ( a.) Be received and detained in Her Majesty's Navy, or— ( 6.) If not received into Her Majesty's Navy, he may, on conviction thereof before two Justices of the Peace, be adjudged to be punished, if in England, as a rogue and vagabond, and if in Scotland or Ireland, by commitment to prison, there to be kept to hard labour for any time not exceeding three months. 7. When any deserter, or absentee without leave, whether delivered into Naval custody by order of a Magistrate, or by a Warrant issued under Section 50 of the Naval Discipline Act, or by voluntary surrender, shall be brought before the Com- manding Officer of any one of Her Majesty's Ships to be dealt with summarily, his case is to be thoroughly investigated, and a n6te taken in writing of the proceedings ; the prisoner is at the same time to be formally asked if he has any statement to make, and such statement, if made, is to be signed by the prisoner, and duly witnessed ; and the accuracy of any such statement is to be carefully tested before the case is finally disposed of. 724a. The penalties for inducing men to desert or im- properly absent themselves, or for employing or concealing deserters or absentees, are set forth in the Naval Discipline Act. 727. In case of desertion a reward not exceeding 31., may, at the discretion of the Captain of the Ship, or in his absence I tho Commanding Officer, be paid to tho Constable or other person ( except as provided for in Article 729) by whom a J deserter is brought on board the Ship to which ho belongs, or i delivered up to any Naval Officer or other person duly | authorised to receive him, whether any reward has been offered or not; provided he is apprehonded within two years I from the date of his desertion. The amount of reward payable in each case, where no re- ward has been offered, should be determined by the attendant ; circumstances, and in considering these, the zeal shown, and the trouble taken, by the Constable, or other person, by whom tho j arrest of the deserter has been effected, should be duly weighed. The above Regulations for the payment of rewards will not bo held to apply in the case of a deserter voluntarily surrendering himself at any Police Station, or to any Constable I or other recognised authority, unless it can be clearly shown that such deserter had been induced so to surrendor himself by i the vigilance and exertions of any such Constable, or other ; person; but exceptional cases of this description are not to bo i dealt with without reference to the Admiralty at home, or Commanders- in- Chief or Officers in command of Stations abroad, for full inquiry into the circumstances. 2. In cases where persons have been more than two years in a state of desertion, no reward is to be paid without previous reference as abovo; and it has been notified to the Constabulary generally that when deserters are apprehended in the United Kingdom after such iv period of absence, they are not to be removed from their places of confinement until the Admiralty has been communicated with. # * * # # 3. A reward, not exceeding SI., may also be paid for the apprehension of any person who, without, in the opinion of the Captain of the Ship to which he belongs, being guilty of desertion, commits any one of the following offences, the par- ticulars of which are to be stated in the offer of reward :— ( a.) Breaks out of his Ship. ( A.) When on service away from his Ship, quits his place of duty, and remains absent after the time at which he ought to have returned to the Ship, ( c.) When the Ship is under sailing orders, remains absent without leave until after the ship lias sailed ; pro- vided that iho fact of the Ship being under sailing orders was generally known. A reward, not exceeding 11., may be paid for the appre- hension of any man who overstays his leave. In giving these rewards, the same considerations as govern the payment of rewards for the apprehension of deserters are to be taken into account, both as regards arrest and voluntary surrender. 4. No reward is to be paid for the apprehension of any Commissioned, Warrant, or Subordinate Officer, without the sanction of the Admiralty at home, or Commander- in- Chief or Senior Officer present, abroad. 728. In addition to the foregoing rewards, there may be paid to the Constable, or other person bringingDeserters or Stragglers on board, such expenses attending their lodgment, subsistence, and travelling, as may appear to have been fairly incurred, and to be in accordance with these regulations; viz. i— Railway Fare ( return) of. Escoit - - f As an ordinary rule, Railway Fare ( single)" of Deserter or < not to exceed Id. Straggler- - - * - - - - I per mile. Other sums expended in the actual carriage of the Deserter or Straggler, such as for the hire of Cabs, Boats, & c. Subsistence of Deserter or Not exceeding Is. while under Straggler. detention, or 2s. 6d. a- day when travelling. Subsistence of Escort - At the same rate as that allowed for Petty Officers under Article 1396, according to tho time necessarily occupied in conveying ihe Deser- ter or Straggler to his destination and returning; namely, 2s. tirf. wnen absent above 9 hours, and not absent dur- ing the night; and 5?. w hen absent a night, or for every 24 hours of absence, no fractional part of a day being allowed in addition to the 24 hours, unless tbo extra time for which payment is claimed exceeds, by more than 9 hours, tho full time for which 5s. would bo paid. The only other charges which, except in special cases, should be sanctioned, aro a fee of 2s. to the Magistrate's Clerk, and a fee of 2s. 6d. to any medical practitioner by whom the ' Deserter or Straggler may have been examined. 2. No further claim for loss of time or for subsistence made by any Constable or other person apprehending a Deserter or Straggler is to be entertained, in cases where a Howard is payable. 3. When no reward is payablo, tho Constable, or other person bringing Deserters or Stragglers on board, should be directed, in a Idition to the above items, to prefer a claim for such other expenses as he may consider himself fairly entitled to, but every case of this description is to be forwarded to the Admiralty for examination and decision. - 4. Should the Constable, or other person bringing a Deserter or Straggler an board, object to the Captain's award, the case is to be submitted to the Commander- in- Chief, who, if unable to settle the question, will forward it for the decision of the Admiralty. ***** The Governor of the gaol will furnish a statement of the number of days' subsistence issued, for which the charge of one shilling per diem is to be raised. * # * * * 6. With a view to simplifying the payment of such claims, Magistrates and Governors of gaols, when requested to send Deserters or Stragglers back to their Ships, should bo informed that it is desirable that the men should be sent in the custody of the Constables who actually apprehended them. 7. The foregoing mode of payment does not apply to cases of Deserters or Stragglers apprehended by tho Metropolitan ( London) Police, when the following course is to be observed:— No payment is to bo made by tho Accountant Officer in respect of the expenses incurred by the Constable, or of any reward which may be due to him. The Constable will fill up a form, prepared for the purpose, which he is to produce, and in which he will include the whole of his expenses, and certify that they wero necessarily incurred by him. He will then hand the form to the Accountant Officer of the Ship, who will, with the approval of the Captain, charge the Deserter or Straggler with the sum shown thereon, to- gether with any reward, if due, and note in tho spaco provided on the form tho fact of the charge having been made. The form is then to be returned to the Constable. The payment of tho expenses incurred, and of the reward when due, will be arranged between the Admiralty and the Commissioner of Police. 729. No reward, cxcept as provided in the following para- graph, is in any case to be piid to a person belonging to the Fleet, nor to any other person, for the apprehension of Deserters or Stragglers within tho precincts of a port or place where there is a Police Force employed in any Naval Establishment 2. Whenever the Police of Ships, or other persons in the Fleet, are sent on shore for the express purpose of collecting Deserters or Stragglers, they are to bo paid the amount of extra pay provided for by Article 1372, provided. the Captain is satisfied with tho manner in which the duties have been per- formed, and that no unnecessary delay took place in their per- formance ; and in order to cncourage the Local Police at the Iloine Ports in searching for and apprehending Deserters and Stragglers, a reward, not exceeding £ 1 for each person appre- hended, within the limit of two years, may, at the discre- tion of, and under such regulations as may from time to time be laid down by the Commanders- in- Chief at the Ports, bo paid to any Constable of Local Police who arrests a Deserter or Straggler. 3.
