S E L E C T C O M M I T T E E ON F I C T I T I O U S VOTES, IRELAND. 381 7 r the land and he swore it was not worth more than 11. an acre; I am not quite John Julian Esa sure of the quantity of land he swore to, or the precise rent, but I think it was seven acres, at the rent of an Irish 1/. an acre. On his cross- examination n July 1838. Mr. O'Moore swore he did not know Durrovan himself, nor did he know the particular portion of the lands of Foolah which constituted his farm; he merelv swore to his general knowledge of the entire townland of Foolah, and of that portion of it deposed to by Durrovan as constituting his farm, inasmuch as it joined Mr. O'Moore's estate; he swore positively to that, and from his tes- timony Durrovan could not have such an interest as a solvent tenant would give 40s. a year for above that rent. 14742. And yet that man was registered?— Yes, he was. 14743. Mr. O' Connell.] Was not it thus : he swore distinctly he did not know Durrovan at all ?— He did; he swore. 14744. He swore distinctly he did not know where Durrovan's house was He did. 14745. He swore he positively did not know which was Durrovan's land?— Further than that it was bounded by his estates. 14746. That is, the district of Foolah bounded his estate, but the particular part of those lands occupied by Durrovan he could not point out ?— He swore he held the fee of one half of the townland, and Durrovan was tenant in another part. 14747. Of course he could not specify improvements Durrovan had made?—• — No. 14748. Nor the expenditure he had made upon the land?— No. 14749. Or the crops it produced to him ?— No ; but he swore, from his gene- ral knowledge of the land, that positively the particular portion of which Dur- rovan spoke on his direct examination was not worth more than 11, an acre. 14750. There was contradictory evidence 011 the other side?— There was contradictory evidence. 14751. He came to contradict evidence on the other side?— There was not contradictory evidence on the other side. 14752. He came to contradict Durrovan?— Yes, I thought you meant there was evidence in reply. ! 4753- Mr. Litton.] There was no evidence on the side of the applicant? — No.' 14754. Mr. O' Connell.] Mr. Gibson did not consider that evidence sufficient to reject the claim ?— No. 14755. Do you know how many acres there were?— J think seven acres. 14756. Do you pledge yourself upon that?— No; Mr. O'Moore swore that the tenant had not such an interest that a solvent tenant wrould give 10/. for. 14757. Mr. O'Moore was on the bench ?— Yes. 14758. He was not there intended to be brought as a witness ?— No. 14759. His attention was not called to it before ?— No. 14760. Is he one of the Conservatives ?— Yes, he is. 14761. And a subscriber to the Conservative fund?— I believe he is; I do not know. 14762. Did you attend a meeting at Doolay's Hotel, Parsonstown, 23d Sep- tember last?—! do not recollect that I did. 14763. Or at Ridley's Hotel?— No, I never attended one there, except at the election ; I never attended any meeting at any place as a member of any poli- tical party. 14764. Or of the persons who subscribed to the election fund or the registry fund ?— I subscribe to the election fund. 14765. Have you any objection to state how much you subscribe ?—£. 5. 14766. Of course your politics are Conservative ?— I can scarcely answer that question; I believe they are what are considered Conservative. 14767. Are they Orange ?— Positively not. I am what I think the greater part of the gentry of King's County are; not that I mean to class myself amongst them ; I am but their agent. During the administration of Lord Grey, they were his politics. Lord Oxmantown and Colonel Barnard were the Mem bers at that time, and they had the support of the whole county. 14768. Was Durrovan called Donnovan?— No. 14769. Mr. Costello was present ?— Yes, he was. 3 c 3 1477°- lie \
