Having had a blow upon bis leg, he got some person to take him on his cart; he went to Longford and stopped there some time at the quarter sessions, 29 May l838. for the case to be tried. The Nolans were acquitted ot the charge, and the per- sons making the attack, of the name of Hennissey, were found guilty. 12478. Mr. O'Connell.] Were they Catholics?— They were Catholics, and voted with their landlord, and they beat the others because they would not do so. 12479. They were convicted and sentenced to imprisonment ?— Yes. 12480. And suffered the imprisonment?— Yes. 12481. They were not arrested?—' No. 12482. An innocent man was arrested ?— Yes. Edward M'Gaver, called in; and further Examined. 12483. Mr. Lefroy.'] YOU stated to the Committee that 42 Roman- catholic Rev> K M'Gaver. families were turned off the property of Lady Ross, were they turned off at the ' same time ?— I think they took two days to eject them all. 1 June 1838. 12484. In two days they were all turned off?— Yes, one or two days ; I think two days. 12485. You stated, in answer to question 12145, that benefits were conferred upon a particular Protestant tenant who was put in ?—" Yes, I did. 12486. Read the answer you gave to that question [ the Witness did so] ; was the tenant to whom you alluded in that answer a Protestant or a Roman- catholic ?— The tenant who got possession of the land ? 12487. Yes, and who got those benefits?— He was a Protestant, of course. 12488. What was his name?— Mr. Montford. 12489. Who was the magistrate to whom you alluded?— I do not know that I ought to state; if the Chairman asks me I will tell. 12490. Chairman.'] Yes, you must answer the question?— The Rev. Mr. Moffatt. 12491. Mr. Lefroy.] Is he dead or alive ?— He is alive. 12492. Was Mr. Robinson, the agent, aware of the matter you state in that answer ?— I cannot say. 12493. You state, in answer to question 12149, that you were informed Mr. Robinson had said to one of the tenants dispossessed, " Not one of your profes- sion will get a sod of land from my Lady Ross" ?— Yes. 12494. Do you believe that ?— Yes. 12495. You think you have more ground for believing than for disbelieving it ?— I do. 12496. Will you state your ground for believing it r— The very persons who applied to him came over to me with that complaint; I was quite certain they had no benefit to derive from leading me astray ; they gave it to me in the way of complaint; they did not wish to bring me into error; how could they pro- mote themselves by so doing ? I therefore considered, when they spoke to me in that way, they were determined to tell the truth, and nothing but the truth. 12497. Do you believe that Mr. Robinson acted upon that principle ?— I have given my authority for believing it, and I do believe it. 12498. Attend to the question, if you please; do you believe that Mr. Robin- son acted upon that principle ?— I do ; I believe he acted upon that principle in this instance. 643. K e . 12499- And \
