• • • c ON THE LOCAL TAXATION OF THE CITY OF DUBLIN. 307 as aforesaid justices of the peace and gaol delivery, shall die, or be for any reasonable cause legally removed from his or their place or places respectively, that then and so often, it shall and may be lawful for the mayor and the rest of the common council ot the said city for the time being, or the major part of them from time to time for ever, to elect and choose one or more of such aldermen of the said city in the place or places of such justice or justices so dead or removed: Provided nevertheless, that as well the recorder and aldermen, justices of the peace and gaol delivery above in these presents appointed and named, and each of them, as all and every other alderman and recorder for the time being, and to be from time to time hereafter elected and chosen justices of the peace and gaol delivery of each of them, before they or any of them be permitted to execute said offices of justices of the peace and gaol delivery, shall take their corporal oaths well and faithfully to execute the office of justice of the peace and gaol delivery within said city, the suburbs and franchises of the same, and the county of the said city, before the mayor of the said city for the time being, to which mayor for the time being, We do, for us, our heirs and successors, give power to administer said oath; and that the mayor for the time being, should take the said oath before our chief governor or governors of our said kingdom for the time being, or before the chief baron of our said exchequer of our kingdom of Ireland for the time being, or before the preceding mayor or any of our justices of the peace in the said county of the city of Dublin, to whom respectively we give power to administer said oath: And further, of our special grace, certain knowledge, and mere motion, we will, and by these presents, for us, our heirs and successors, do grant to the said mayor, sheriffs, commons and citizens of the city of Dublin and their successors, that the mayor, aldermen, and rest of the common council of the said city for the time being, or the major part of them from time to time for ever hereafter, shall have the management, rule and government of the house of correction in the said city, the suburbs and franchises thereof, and of the county of the said city for the time being, and of all delinquents or persons whomsoever, from time to time confined, committed or to be committed to the said house, according to the laws and statutes of our said kingdom of Ireland; and that the said mayor, aldermen, and the rest of the common council of the said city, or the major part of them for the time being, can and may from time to time, as often as to them shall seem necessary, nominate, elect, appoint and constitute a discreet and fit man to the office or place of master or governor, which master or governor shall have ( under the said mayor, aldermen and rest of the common council) the keeping, ruling and government of all and singular delinquents or other persons whomsoever, from time to time committed or to be committed to the said house of correction, to have, hold and enjoy the said office of master or governor of said house as aforesaid, during the pleasure of the said mayor, aldermen and the rest of the common council of the said city, or the major part of them for the time being; and for us, our heirs and successors, we do nominate and appoint Garrett Farrell to be the modern master of the house of correction of the city and county of the city of Dublin; and that every master for the time being, shall take the oath of well and faithfully executing the office of master of the house of correction and the other oath aforesaid, before the mayor of the said city for the time being, to whom we give power to administer said oaths; and further, We ordain, that the modern mayor, before he shall exercise his office of mayor, shall come before chief governor of our kingdom of Ireland, or before our chief baron of our kingdom of Ireland for the time being, and take his corporal oath of well and faithfully executing that office in and by all things to that office appertaining and the other afore- said oaths, to whom respectively We give power to administer said oaths; and that the said modern sheriffs and each of them, before they shall exercise their said offices, shall respec- tively take their corporal oaths well and faithfully to execute said offices in and by all things concerning the same, and the other oaths aforesaid, before the mayor of said city, to whom by these presents, We give power to administer said oaths: And further, for us, our heirs and successors, We will and ordain, that the mayor for the time being, shall hereafter have the assize of bread, and the service and assize of weights and measures within the said city and the franchises thereof; and further, for us, our heirs and successors, We do give and grant to the said mayor, sheriffs, commons and citizens of the said city, and their successors, that the serjeants at mace and other inferior officers and ministers of said city, shall be therein hereafter elected in the same manner and by the same persons as they were at any. time heretofore elected or continued; provided such officers and every of them, do take the oath of well and truly executing their offices respectively, and the afore- said oath of fealty before the mayor of the said city for the time being, to whom, for the time being, We give power to administer said oath: And further, for us, our heirs, and successors, We have given, granted and confirmed, and by these presents, for us, our heirs and successors, do give, grant and confirm to the said mayor, sheriffs, commons and citizens of the city of Dublin, and their successors, that they may for ever have, hold and keep within the city of Dublin, the liberties and suburbs thereof, a common market on Wednesday and Saturday in every week; and that the market commonly called Ormond Market, in Oxmantown, shall remain and continue for ever in the place called Ormond Market, saving and reserving unto John Davys, knight, his executors and administrators, his interest in the said market and in the profits thereof, in as ample manner and form as the said Sir John Davys at any time heretofore had used or enjoyed the same, any thing in these presents to the contrary notwithstanding, without impeachment or hindrance of us, our heirs or successors; and also, that the said mayor, sheriffs, commons and citizens of the city of Dublin, and their successors, shall in said city and the liberties thereof, have a view of frankpledge and all things thereto belonging; and We give, grant and confirm 549- t0
