304 APPENDIX TO REPORT OF SELECT COMMITTEE, & c. hereafter, within said city, a clerk and prothonotary of said court, to write, do, enter and enrol, all and singular pleas, complaints, writs, returns of writs, captions, bails, bills, pleadings, answers, pleas, replications, rejoinders, issues, warrants of attorney, verdicts, jndgments, and copies of the same, and other records, processes and businesses of said court, and the writs, rolls and records of the same; and thereout the said clerk shall, at all times hereafter, have and receive for his labour, industry and attendance in the exercise and execution of the premises, all and singular such fees, rewards and profits as such clerk or officer in our city of Dublin hath, at any time heretofore, for or in respect of such busi- ness, office or service taken or received, and not otherwise: And also, of our special grace, certain knowledge and mere motion, for us, our heirs and successors, We do order and direct, that there shall be for ever, hereafter, a town clerk for the said city and clerk of the crown and peace for the city and county of the city of Dublin aforesaid, and a clerk of the staple of said city, and that the said prothonotary, town clerk, clerk of the crown and peace and clerk of the staple for the time being, can and may exercise said offices, in as ample manner and form, and have and procure such, so many of the same and the like privileges, rights, pre- eminences, wages, rewards, fees, profits, emoluments and advantages as any prothonotary, town clerk, clerk of the crown and peace, and clerk of the peace in our said city of Dublin have at any time heretofore exercised, and for or in respect, or by reason of said offices, have or might have had, received, enjoyed or exercised: And further, of us, our heirs and successors, We do order and direct, that the prothonotary and town clerk of the said city of Dublin for the time being, shall be now and at all times clerk of the peace and crown of us, in our said city and county of the city of Dublin, and shall have and perceive the same, so many, and such and the like fees, regards, profits and advan- tages as any other clerk of the peace and crown of us, in any county in our said kingdom of Ireland, and be also clerk of the staple, and have the same wages, fees, regards and emoluments which any clerk of the staple hath or ought to have heretofore received and enjoyed, which office of clerk and prothonotary of said court, together with the fees, wages, profits and emoluments above thereout appointed, We do annex, conjoin and unite to the said office of the town clerk of the said city of Dublin, to continue for ever, so that said office of clerk and prothonotary of the said court, from the said office of town clerk of the said city of Dublin, shall in no wise be divided or separated: And of our more abundant special grace, certain knowledge and mere motion, by these presents, We do nominate, appoint, ordain and constitute, for us, our heirs and successors, John Kearney, gentleman, to be the modern clerk and prothonotary of the said court, and the modern town clerk for the said city of Dublin, and also the modern clerk of the peace and crown of us, our heirs and successors in our said city and county of Dublin, and clerk of the staple of the said city, to have, occupy and exercise the offices or employments aforesaid, to the said John Kearney, by himself or his sufficient deputy or deputies, and to have, perceive and receive out of and for the offices or occupations, to be as aforesaid exercised, the several fees, wages; regards, emoluments, profits and advantages in these presents above mentioned and appointed, for and during his natural life, unless in the mean time for misconduct in said offices or occupations, or in any of them, or for any other reasonable cause, he be removed therefrom by the mayor, aldermen and the rest of the common council of the said city of Dublin for the time being, or the major part of them, to which mayor, aldermen and the rest of the common council of the said city for the time being, or the major part of them, in such and the like case and cases, We do give and grant, by these presents, full power and authority entirely to expel and remove from their said offices or employments, as well the said John Kearney as any other clerk or prothonotary of the said court, of town clerk for the said city and clerk of the peace and crown of us, our heirs and successors, in the said city and county of the city of Dublin aforesaid, and clerk of the staple, for the time being, who shall be, according to the tenor of these presents nominated and appointed: And fur- ther, We will, and by these presents, for us, our heirs and successors, do grant and confirm to the said mayor, sheriffs, commons and citizens of the city of Dublin, and their succes- sors, that the mayor, aldermen and the rest of the common council of the said city of Dublin, orthe major part of them, from time to time, whensoever and as often as the said office or place of clerk and prothonotary of the said court of record, and of town clerk for the said city, and of clerk of the peace and crown of us, our heirs and successors, and of clerk of the staple aforesaid, shall become void by the death or due removal of the said John Kearney, or of any other such officer, or in whatsoever other manner same may become vacant, that then and so often they shall assign, nominate, constitute and elect another good and discreet man to be clerk and prothonotary of said court of record, and town clerk for the said city, and clerk of the peace and crown of us, our heirs and successors, and clerk of the staple aforesaid in the said city and county of the city of Dublin, and to con- tinue in said offices or occupations, and to hold and exercise the same by himself, or his sufficient deputy or deputies, and to have, receive and perceive the said fees, wages, regards, emoluments, profits and advantages, for and during the natural life of all and every such fit person so into such offices or occupations nominated or appointed, or from time to time to be nominated or appointed respectively, unless in the mean time they or any of them be, as aforesaid, in due form removed: And we will, that as well the said John Kearney as all and every other person or persons nominated and appointed, or hereafter to be nominated and appointed to the offices or places aforesaid, in manner aforesaid, and every of their deputies for the time being, shall take as well their corporal oaths on the Holy Evangelists well and truly to execute said offices or employments in all things, according to the due form of the said offices or employments, as the other corporal oaths aforesaid, before the mayor.
